DNA Database

- To ask the Secretary of State for the Home Department what assessment he has made of the merits of the practice in Scotland where an individual's profile is removed from the DNA database following acquittal.

The Government have no plans to amend the law in England and Wales relating to the retention of DNA samples taken under the Police and Criminal Evidence Act 1984. Although at present the law in Scotland does not allow for the retention of DNA samples following a person's acquittal, this is currently under review by the Scottish Executive.
