Localism Bill [HL]

- To ask Her Majesty’s Government what estimate they have made of the potential liability of the United Kingdom to pay fines to the European Union; and what proportion they anticipate would fall to be paid by local authorities under the provisions of the Localism Bill.

The United Kingdom has never incurred a financial penalty under Article 260 of the Treaty on the Functioning of the European Union (or under the former Article 228 (ex Article 171) of the Treaty Establishing the European Community) and no such fines are anticipated. In the event of such a financial penalty, it is not possible to anticipate what proportion would fall to local authorities under powers proposed in the Localism Bill.
