Mr. Drew: To ask the Secretary of State for the Home Department if he will make a statement on discretionary powers available to prison governors. [77851] Hilary Benn: [holding answer 29 October 2002]: When exercising their discretion, prison governors must act in accordance with the policies and procedures of the Prison Service as prescribed by the Prison Act 1952, the Prison or Young Offender Institution Rules, and operational instructions.
