- To ask the Parliamentary Secretary, Department for Constitutional Affairs, who is responsible for the enforcement of section 125 of the Political Parties, Elections and Referendums Act 2000; what the consequences are of breaching Section 125 of the Political Parties, Elections and Referendums Act 2000; and what measures are in place to prevent such a breach.

Mr. Jenkin: To ask the Parliamentary Secretary, Department for Constitutional Affairs (1) who is responsible for the enforcement of section 125 of the Political Parties, Elections and Referendums Act 2000; [198164] (2) what the consequences are of breaching Section 125 of the Political Parties, Elections and Referendums Act 2000; and what measures are in place to prevent such a breach. [198163] Mr. Leslie: It is the responsibility of those to whom section 125 of the Political Parties, Elections and Referendums Act 2000 applies to ensure that they comply with the requirements of that provision. A person alleging a breach of section 125 could seek to bring a judicial review. It would be for the courts to decide the consequences of a breach according to the circumstances of the challenge.
