Proceeding contribution from Maria Eagle (Labour) in the House of Commons on Tuesday, 29 November 2005. It occurred during Adjournment debate on Special Educational Needs.

Special Educational Needs

: Will the hon. Lady let me finish? Under the 2001 Act, schools are not allowed to discriminate against disabled people by excluding them on the basis of behaviour arising out of their disability. I am not saying that that means it never happens; I am not naive enough to think that a change in the law is never broken. However, if such an exclusion happens, there are routes that families ought to take to get redress. It is not right to discriminate against a child on the basis of their disability; that is illegal.
