Proceeding contribution from Lord Bassam of Brighton (Labour) in the House of Lords on Monday, 6 February 2006. It occurred during Debate on bill on Identity Cards Bill.
Identity Cards Bill
moved Amendment No. 14:"Page 30, leave out lines 33 and 34 and insert ““must be considered when determining—" (a) whether a civil penalty should be imposed under this Act; and (b) the amount of such a penalty.”” The noble Lord said: My Lords, I can speak more briefly on this amendment. The amendment makes it clear that the code of practice on civil penalties should be taken into account when it is being considered whether a penalty should be imposed, and not just what the amount of a penalty should be. As noble Lords who have read the draft code and participated in previous debates will know, we have always intended that this should be the case. The amendment simply puts that beyond doubt by clarifying, on the face of the Bill, the scope of the code. I am grateful to the noble Lord, Lord Phillips, for his improving and constructive suggestions in this regard. I beg to move.
