Proceeding contribution from Lord De Mauley (Conservative) in the House of Lords on Monday, 19 June 2006. It occurred during Debates on delegated legislation on Enterprise Act 2002 (Disqualification from Office: General) Order 2006.
Enterprise Act 2002 (Disqualification from Office: General) Order 2006
I thank the Minister for introducing the order. These proposals are sensible and we support the order in principle. However, I have questions in just three areas. First, how is it to be decided whether a bankrupt is culpable or merely unfortunate? We agree that there should be differentiation between those who become bankrupt inadvertently and those who have clearly shown culpable behaviour. Although we agree that it is desirable that a distinction is made, it is not always an easy decision to make, there being degrees of culpability. Does the framework now allow for a graduated response? [The Sitting was suspended for a Division in the House from 4.49 to 4.59 pm.]
