Proceeding contribution from Lord Sainsbury of Turville (Labour) in the House of Lords on Monday, 19 June 2006. It occurred during Debates on delegated legislation on Enterprise Act 2002 (Disqualification from Office: General) Order 2006.
Enterprise Act 2002 (Disqualification from Office: General) Order 2006
As I understand it, in all these cases, when the bankruptcy restriction order comes to an end, the person can once again take up the post. So I would assume that in that case he could come back then. The final question concerned parish councillors. They have the same disqualification provisions as those of local councillors: that is, those who are bankrupt are allowed to retain their seat but those subject to the bankruptcy restrictions regime lose it. Those points were covered in a letter from Jim Fitzpatrick to Charles Hendry on 5 June 2006. I hope that that deals with all the points raised. This is an extremely sensible piece of legislation, which helps to remove the sting from bankruptcy, while at the same time keeping those who are culpable from taking on particular offices. On that basis, I commend the order to the House. On Question, Motion agreed to.
