European Union (Amendment) Bill

Does not my noble friend agree that what the noble Lord has just read out rather supports my noble friend’s case? It says, "““except in so far as Poland or the United Kingdom has provided for such rights””." Where the United Kingdom has provided for such rights, there is a justiciable issue. The court is able to rule where the UK has provided for such rights in its own law—that is, the ECJ has jurisdiction over UK law. That is repeated in subsection (1) of Article 1 as well.
