Criminal Justice and Immigration Bill
My Lords, I am grateful to the noble Lord, but I would like to consider further what he has said. However, if the opposition amendment is successful, Clause 10 will be removed from the Bill; that is it, it is not there. There is no chance of any Secretary of State bringing it in, because it will not exist. That is why I ask the House not to vote for the amendment of the noble Lord, Lord Kingsland, but to vote to keep Clause 10 in the Bill. I am certainly not going to be long now in addressing the House, which was very patient earlier. We are suggesting, if our amendment is passed, that Clause 10 stays in the Bill and we have the option of revoking it at some stage if both Houses agree. An alternative course would be to do as the noble Lord, Lord Elystan-Morgan, says, which is an attractive proposition but I have not had the opportunity to take advice or consult about it. The bottom line is that if we agree to the Motion of the noble Lord, Lord Kingsland, Clause 10 is out, and then the type of option proposed by the noble Lord, Lord Elystan-Morgan, is a non-starter. That would be very unfortunate. For that reason, I invite noble Lords not to vote for the Motion of the noble Lord, Lord Kingsland, but for ours instead.
