Compensation Act 2006

My right honourable friend the Lord Chancellor and Secretary of State for Justice (Kenneth Clarke) has made the following Written Ministerial Statement. I am today laying before the House the Government’s memorandum to the Justice Committee on post-legislative scrutiny of the Compensation Act 2006. Copies have been placed in the Libraries of both Houses. The Compensation Act 2006 contains provisions relating to two separate and distinct areas; Part 1 contains provisions restating and clarifying the law of negligence and breach of statutory duty, and provisions addressing a practical difficulty that had arisen in relation to proving liability for the asbestos-related disease of mesothelioma; and Part 2 provides the framework for the regulation of claims management services. These reforms have been implemented, in line with the stated objectives of the Act, as detailed in the memorandum.
