To ask the Secretary of State for Housing, Communities and Local Government, if he will make it his policy to take steps to remove regulatory barriers to the installation of air conditioning in (a) dwellings and (b) business promises including those in the London Plan.

Part O of the Building Regulations requires that new residential buildings are built to mitigate the risk of overheating.
Part O does not prevent the installation of air conditioning. It encourages passive design measures, such as limiting solar gain and enabling heat to be removed naturally, before relying on mechanical systems. This reflects the Government’s commitment to improving energy efficiency and reducing carbon emissions. Mechanical cooling can be used where all reasonably practicable steps have been taken to minimise overheating through passive means.
Part O does not apply to most non-domestic buildings, including business premises. These are subject to different requirements under the Building Regulations. Mechanical cooling can be installed, so long as the building’s design complies with these requirements, in particular, requirements for energy efficiency.
The Government keeps the Building Regulations under review. The Building Safety Regulator is currently undertaking a technical review of Part O to consider whether changes may be needed, informed by evidence and stakeholder feedback.
The Mayor of London is in the process of replacing his current London Plan, with consultation on a draft plan expected in the near future. I will review the draft with a view to ensuring that it is provides an ambitious framework for growth in London which is consistent with national policy.
