Mr. Allen: To ask the Parliamentary Secretary, Lord Chancellor's Department what steps the Lord Chancellor is taking to reduce
delays in cases caused by lawyers unreasonably requiring witnesses repeatedly to attend court. [114241]
Yvette Cooper: Witnesses are usually only required to attend court on the day the case is listed for trial. However, occasionally
the needs of justice may require adjournment of a case to allow for re-examination of a witness. An adjournment would only be made
on the request of the parties and it would be entirely a matter for the judge hearing the case to decide whether or not such a
request was reasonable. Judges are mindful of the distress and inconvenience that can be caused by delay and wherever possible will
work to avoid unnecessary adjournments.

Yvette Cooper: I have been asked to reply.
Each Crown court centre has a Child Liaison Officer, although in some courts the responsibilities will have been taken on by the new
Witness Liaison Officers who were appointed in 2002. The Witness Service fulfils this role in the Magistrates' courts.

Mr. Frank Field: To ask the Parliamentary Secretary, Lord Chancellor's Department how many (a) magistrates and (b) crown courts do

Yvette Cooper: The crown court sits at a total of 94 localities of which seven do not provide dedicated facilities for the
separation of witnesses from the general public. In those cases other arrangements are made to provide for the necessary
separation--for example using CPS or police rooms by arrangement. There are 402 magistrates courts of which 40 do not provide
dedicated facilities for the separation of witnesses from the general public. Appropriate segregation arrangements are made there
also.
Over the last three years £5.3 million has been invested to provide 133 Video Link rooms in magistrates courts. In the last year a
further £4.3 million has been invested in 27 crown courts and 21 magistrates courts to provide separate witness facilities at each
court.

David Davis: To ask the Parliamentary Secretary, Lord Chancellor's Department how many youth court cases in the East Riding of
Yorkshire have had to be abandoned because the (a) accused and (b) witnesses failed to attend in each year since 1997. [105198]
Yvette Cooper: This information is not held centrally, and could be provided only at disproportionate cost. Data on the reasons why
trials fail to proceed has been collected from all Magistrates' Courts Committee (MCC) areas since 1 April 2002. In the Humberside
MCC area, (which includes the East Riding of Yorkshire) 1 April and 31 December 2002, 2,043 trials were recorded. None were recorded
as discontinued, but 170 had to be adjourned due to the absence of the defendant. Forty three were discontinued by the prosecution
due to the absence, or withdrawal, of witnesses. A further 206 were adjourned because of the absence of prosecution witnesses. These
figures include adult and youth cases and they cannot be apportioned between the two categories, without incurring disproportionate
cost.

Geraint Davies: To ask the Parliamentary Secretary, Lord Chancellor's Department if she will provide additional funding to extend
the use of live links to enable witnesses other than the defendant to give evidence through a live link in criminal proceedings.

Yvette Cooper: Video link equipment is used in the Crown and magistrates' courts for two purposes: to enable defendants held in
custody to participate in pre- trial hearings without having to attend court; and to allow vulnerable or intimidated witnesses to
give evidence from outside the courtroom.
All Crown Court centres have TV link equipment, which allows witnesses to give evidence from outside the courtroom but within the
court building. 12 Crown Court centres have video conferencing facilities, which allow witnesses to give evidence from a remote
location. In addition, equipment linking courtrooms with specific vulnerable and intimidated witness rooms will be installed in 29
Crown Court centres by the end of 2003. This equipment will also allow witnesses to give evidence from a remote location.
133 vulnerable and intimidated witness rooms had been installed in magistrates' courts by the end of September 2002. Work is
currently under way to establish the number of additional video links that are required to meet current and future demand. The Court
Service will then liaise with Criminal Justice System partners, including the Crown Prosecution Service and the Home Office, on how
to take this forward.

Yvette Cooper: 81,437 trials were listed in the magistrates courts during the period April 2002 to September 2002, of which 2,875
(3.53 per cent.) did not continue due to the absence or withdrawal of a witness. 6,780 trials (8.32 per cent.) became ineffective
due to the absence of the defendant. It is not possible to break down these figures into those relating specifically to youth cases.
My Department is currently undertaking a Case Preparation Project with CJS partners, which includes work on identifying reasons why
defendants and witnesses fail to turn up for hearings.

Yvette Cooper: In 1997-98 56,116 cases were listed for trial in the Crown Court of which 1,967 (3.50 per cent.) failed to take place
due to the accused, and 3,848 (6.85 per cent.) due to the witness(es), failing to attend.
Between April and September 2002 (the most recent data currently available) 27,427 cases were listed for trial in the Crown Court.
1,024 (3.73 per cent.) failed to take place due to the accused, and 1,717 (6.26 per cent.) due to the witness(es), failing to
attend. Data on why cases fail has only been collected nationally by magistrates' courts from 1 April 2002.
For the six month period April to September 2002 81,437 trials were listed for trial in the magistrates' court, of which 6,780 (8.32
per cent.) failed to take place due to the accused, and 2,875 (3.53 per cent.) due to the witness(es), failing to attend.
Action is being taken across Criminal Justice Agencies to reduce the failure of court cases due to non attendance of witnesses, in
particular the use of video links for vulnerable and intimidated witnesses, and the introduction of Victim Support into all courts.
My Department is currently undertaking a Case Preparation Project with CIS partners which includes work on identifying reasons why
defendants and witnesses fail to turn up for hearings
