Mr. Paice: To ask the Secretary of State for the Home Department if he will list the performance of each constabulary in recording conviction data on the police national computer under the court results 90 per cent. data targets for the latest month available. [90306] Mr. Denham: [holding answer 14 January 2003]: The particular data to which the hon. Member refers relates to recording not only convictions but all court results. It shows the time taken from the completion of court proceedings to record the quickest 90 per cent. of cases entered during the period in question. The data reflects the longest time taken to record any case within the quickest 90 per cent. The figures include the time taken by courts to notify results to the police, and will be affected by factors such as delays due to a need to clarify results, or undertaking back record conversion exercises. The following table shows the results for forces in England and Wales in December 2002. The average figure for the nine-month period from April to December 2002 was 71 days. This compares with an average of 220 days for the period from April 2000 to March 2001, and of 196 days for the period between April 2001 to March 2002. We have made clear our determination that the timeliness of inputting data onto the police national computer should be improved. Her Majesty's Inspectorate of Constabulary (HMIC) reported (Police National Computer Data Quality and Timeliness-- Second Report December 2002) that substantial progress had been made following the inspection and review exercise that we commissioned, but that more needed to be done. To this end, we are working with the Association of Chief Police Officers to implement HMIC's recommendations. _________________________________________________________________________________________________. Mr. Paul Marsden: To ask the Secretary of State for the Home Department what plans he has to introduce a national database of missing persons. [88186] Mr. Denham: There are already arrangements nationally to record missing persons. Details of all missing persons should be recorded on the Police National Computer (PNC) as soon as possible and in any case within 48 hours of their disappearance. Notification of all outstanding missing persons should be sent to the Police National Missing Persons Bureau (PNMPB) within 14 days. Most missing persons are found locally within this period. Forces will not, however, be precluded from forwarding information to the PNMPB in a shorter time if a particular case appears to warrant more urgent attention. The National Missing Persons Helpline (NMPH) also maintain a database for all missing persons reported to them and these files are not closed until there is a definite resolution to each case. The Home Office is currently working with key stakeholders within the area of missing persons, which includes the police and the NMPH, to increase co-operation and information sharing between Government Departments, and statutory and non- statutory agencies. £810,000 has been made available from the Invest to Save Budget (ISB), to put in place a new system for handling missing person cases. The aim of the project is the establishment of joint working arrangements between the United Kingdom police service and NMPH, together with improved recording and information sharing, to improve the service to missing persons and their families and to inform our understanding of the problem and develop strategies to address it. One of the key objectives of this project is to establish a unified national database of missing and unidentified people reported either to the police or to the NMPH.

Harry Cohen: To ask the Secretary of State for the Home Department in relation to personal data linked to fingerprints or DNA stored on national police computers, whether the personal data are marked to identify those personal data which are associated with individuals who are not criminals or who are not suspected of any criminality; and if he will make a statement concerning compliance with the Third and Fifth Data Protection Principles in relation to these personal data. [74484] Mr. John Denham: The Criminal Justice and Police Act 2001 allows for the retention of all fingerprints and DNA samples taken on suspicion of involvement in a criminal offence. These may be used only for the purposes of prevention and detection of crime, the investigation of an offence or the conduct of a prosecution. The legislation has been challenged in the courts under the European Convention of Human Rights. On 12 September 2002 the legislation was ruled in the Court of Appeal to have not contravened the Convention. The Association of Chief Police Officers (ACPO) and the Home Office have been looking at how the police can best use the opportunities provided by the Criminal Justice and Police Act 2001. A revision of the rules governing the weeding of records from the Police National Computer is being examined in parallel with consideration of the best way to retain data on fingerprints and DNA from individuals who have been acquitted. The Information Commissioner's Office is being fully consulted on this exercise. The DNA profiles of individuals who have had samples taken lawfully under the Police and Criminal Evidence Act 1984, but against whom the prosecution was not proceeded with or who were subsequently acquitted by the courts, can be identified on the National DNA Database. DNA samples are retained and used solely for the purposes of prevention and detection of crime, the investigation of an offence or the conduct of a prosecution and such use does not contravene data protection legislation. Currently the fingerprints of persons who are acquitted or against whom charges have not been proceeded with are weeded from the National Automated Fingerprint Identification System (NAFIS) system. Once the acquittal/not proceeded with information is put on the Police National Computer a message is sent to NAFIS and the fingerprint record deleted. In light of the changes in the Criminal Justice and Police Act 2001, further proposals are under consideration in relation to the system to allow for the retention of fingerprints on NAFIS in such cases.

Norman Baker: To ask the Secretary of State for the Home Department which organisations have access to (a) fingerprints and (b) DNA samples held by the police. [64245] Mr. Denham: [holding answer 25 June 2002]: Under the Police and Criminal Evidence Act 1984 (as amended) retained fingerprints and DNA samples can be used only for purposes related to the prevention or detection of crime, the investigation of an offence or the conduct of a prosecution. Fingerprints and DNA samples, and the profiles derived from them, which are held by or on behalf of police forces in the United Kingdom and Islands, may be accessed only by relevant law-enforcement authorities. Relevant law-enforcement authorities are listed in section 63A of the 1984 Act. They are: (a) a police force{1}; (b) the national criminal intelligence service; (c) the national crime squad; (d) a Public Authority (not falling within paragraphs (a) to (c)) with functions in any part of the British islands which consist of or include the investigation of crimes or the charging of offenders; (e) any person with functions in any country or territory outside the United Kingdom which (i) correspond to those of a police force, or (ii) otherwise consist of or include the investigation of conduct contrary to the law of that country or territory, or the apprehension of persons guilty of such conduct; (f) any person with functions under any international agreement which consist of or include the investigation of conduct which is (i) unlawful under the law of one or more places, (ii) prohibited by such an agreement, or (iii) contrary to international law, or the apprehension of persons guilty of such conduct. {1} The reference to a police force is a reference to any of the following: (a) any police force maintained under section 2 of the Police Act 1996 (c 16)(police forces in England and Wales outside London); (b) the Metropolitan police force; (c) the City of London police force; (d) any police force maintained under or by virtue of section 1 of the Police (Scotland) Act 1967 (c 77); (e) the police service of Northern Ireland; (f) the police service of Northern Ireland Reserve; (g) the Ministry of Defence police; (h) the Royal Navy regulating branch; (i) the Royal Military police; (j) the Royal Air Force police; (k) the Royal Marines police; (l) the British Transport police; (m) the States of Jersey police force; (n) the salaried police force of the Island of Guernsey; (o) the Isle of Man constabulary.

Harry Cohen: To ask the Secretary of State for the Home Department how many vehicles' details are recorded on the Police National Computer; what data categories describe these vehicles and what types of markers are used in connection with vehicles; and how many vehicles (a) carry a particular marker and (b) fall within a particular category. [59256] Mr. Denham: As of 23 May 2002 the estimated number of vehicles registered on the Police National Computer (PNC) database was 50,444,691. The database includes information on the make of the car, the model code, the colour, body type and engine size. The PNC database stores information, which identifies each vehicle. For example there are four groups, which are used as types of markers, and the categories associated with these markers are as follows: Vehicle state markers Scrapped Notification of a total loss of a vehicle by an insurer (V23) marked as likely to be an insurance loss Statutory of Road Notification (SORN) is current Vehicle Excise Licence (VEL) expired VEL is void. Exceptional characteristics Foreign vehicle A direct export A personal export Diplomatic privilege A cherished transfer A permanently exported vehicle. Of interest Stolen Police eyes only Record query Driving Vehicle Licence Agency (DVLA)-related status Notified as Void by DVLA DVLA notified that keeper has changed by owner DVLA notified of a keeper has changed by police/local authority The vehicle is In Trade If the vehicle has not been registered at DVLA (i.e. a V5 registration document has not been issued for it). Statistics are not maintained on either markers or the number of vehicles in each category due to the dynamic nature of the database. In addition to the `markers' above, vehicles held on the PNC have `Police Interest' reports in the following categories: LOS (lost/stolen), FOU (found), INF (information), SEE (seen and checked), COR (correction), REM (removed), DES (destroyed). The number of vehicles with `Police Interest' reports as at 23 May 2002 was 894,549.

Mr. McNamara: To ask the Secretary of State for the Home Department what steps he has taken since October 1997 to establish a central register of persons who have (a) applied for a licence and (b) to whom a licence to carry a firearm has been granted; what consideration he has given to extending the register (i) to Northern Ireland and (ii) to Scotland; and what information will be retained on this register. [21307] Mr. Denham: The central register is being developed by the Police Information Technology Organisation as part of the PHOENIX database on the Police National Computer (PNC). Following receipt of an agreed user requirement, a detailed impact assessment was carried out of the work which needed to be done to link the PNC to existing firearms systems in forces. Work is planned for completion in November 2002. Section 39 of the Firearms (Amendment) Act 1997 which requires the establishment of a register, does not apply to Northern Ireland, which has separate firearms controls. Scottish forces already have a centralised database which is likely to meet the requirements of section 39, except that it is only accessible on-line to Scottish forces. Work is in hand to determine the detailed technical issues involved in making the necessary links with PNC. The register will record full details of all persons whose applications for grant or renewal of a firearm or shot gun certificate have been accepted or refused; and also of those whose certificates have been revoked. It will also bring to notice the details of any certificate holder who is arrested/summonsed, together with details of any subsequent conviction or other disposal.
