Mrs. Curtis-Thomas: To ask the Secretary of State for the Home Department (1) what powers police officers have to establish a person's identity; [159755] (2) if he will make a statement on how identity cards will assist the police in stop and searches if carrying a card is to be voluntary. [159756] Beverley Hughes: The police have powers to take steps to identify a person who has been arrested including checking biometric information. There are also classes of criminal offences which are non-arrestable and are enforced by sending a summons. In these situations, the police have to be certain of a person's name and address. If a person refuses to identify themselves in these circumstances or the police are not satisfied with the information given, they have a power of arrest after which biometric checks can be made. Sections 9 and 10 of the Criminal Justice Act 2003 has extended the circumstances in which the police may record biometric information without consent to include recording from a person arrested for a recordable offence and detained in a police station. This addition to s61 and 63 of the Police and Criminal Evidence Act (PACE) 1984 will prevent persons who come into police custody and who may be wanted on a warrant or for questioning on other matters from avoiding detection by giving the police a false name and address. These provisions come into effect on 5 April 2004. The National Identity Register will link each individual's record to a biometric that is unique to that person. This means that even without a card being produced, it will be possible to check someone's biometric information directly with the National Identity Register to establish his or her identity. This could be done with the person's consent or without consent in certain limited circumstances such as establishing the identity of arrested persons in line with the powers set out above.

Mr. Wray: To ask the Secretary of State for the Home Department what training is available for immigration and police officers in identifying a trafficked child; and what powers can be used to protect trafficked children discovered at ports and airports. [110783] Beverley Hughes: Training provided to police and immigration officers is through the practical sharing of skills and experience across agencies. There is, for example, work underway involving key agencies at principal entry points to identify children at risk, including pilot projects involving the immigration service, police and social services at Heathrow and Dover. Furthermore the Home Office has recently published the `trafficking toolkit' providing guidance for immigration and police officers on how to recognise a victim of trafficking and what to do if such a victim is encountered. In addition all United Kingdom immigration officers at ports of entry have been issued with a profile of potential child trafficking victims. In the event of specific intelligence coming to light about the potential arrival of trafficked children all UK immigration service offices are quickly notified. Two immigration officers on attachment to the National Crime Squad Immigration Crime Team (ICT) have attended a week-long multi-agency course on trafficking held by the Child and Women Abuse Studies Unit of the London Metropolitan University. They have cascaded the training to ICT colleagues. A vice team consisting of specifically selected immigration officers has also been established in London. The team is fully aware of the procedures with regard to the identification of trafficked children. It is an offence under Section 25 of the Immigration Act 1971, as amended by Section 143 of the Nationality, Immigration and Asylum Act 2002 to assist in unlawful immigration to the United Kingdom, and Section 145 of the Nationality, Immigration and Asylum (NIA) Act 2002 has also made it an offence to traffic in prostitution. Anyone convicted of either offence is liable to imprisonment for up to 14 years. There is however no current evidence to indicate that trafficking in children is a large-scale problem in the United Kingdom.

Ms Buck: To ask the Secretary of State for the Environment, Transport and the Regions what steps he is taking to ensure local authorities have a strategic role in managing their local area. [139793] Ms Beverley Hughes: The 1998 White Paper, "Modern Local Government: In Touch with the People", set out the Government's long-term vision for the modernisation of local government, emphasising councils' local leadership role. The Local Government Act 2000 helps to achieve this by giving principal local authorities broad powers to take new action to promote the economic, social, and environment well-being of their local communities. This new power greatly strengthens the scope for authorities to work in partnership with other bodies to deliver real improvements in local quality of life. Linked to the new power is a duty for local authorities to prepare a community strategy, based on local priorities and engaging local people, to improve community well-being and contribute to sustainable development. The local strategic partnerships with which local authorities should work to prepare community strategies will bring together all the public, private, voluntary and community sector bodies which have a stake in the area. In the longer term, community strategies could thus provide a sustainable framework which encompasses not only the mainstream activities of local authorities but also all their partner bodies, including businesses. Local strategic partnerships should provide an overriding framework within which other, more specific, partnerships can operate; they offer a single local co-ordination framework to make sure that services, in particular core public services, work together. The new constitutions which councils are required to adopt under Part II of the 2000 Act, including the option of a directly elected mayor where local people want one, will mean they can deliver more clear and accountable corporate leadership and are well fitted for their new strategic role.
