Mr. David Evans: To ask the Secretary of State for the Home Department what estimates he has made of the effect on immigration
levels of the abolition of the primary purpose rule and the admission of immediate members of the same family already resident in
the United Kingdom. [19807]
Mr. Kirkhope: If the primary purpose rule were to be abolished it is estimated that currently between 1,200 and 2,200 applicants
would be eligible for admission each year. It is not possible to estimate the effect of easier admission for the immediate family
members of persons settled in the United Kingdom.

Dr. Godman: To ask the Secretary of State for the Home Department what recent discussions have taken place with the Scottish Prison
Service about the detention of persons awaiting deportation. [19803]
Mr. Kirkhope: Discussions took place with the Scottish Prison Service last summer about the detention of persons awaiting
deportation. These discussions found that due to the relatively low numbers of persons held in Scottish prisons under sole
immigration powers, there were no grounds on which to consider a custom built facility solely for Immigration Act detainees.

Mr. Cohen: To ask the Secretary of State for the Home Department what assessment he has made of the compliance of his Department's

Mr. Kirkhope: It is for the prosecuting authorities to decide whether to prosecute a person for using false documents. The
prosecution of people who have not sought asylum in the United Kingdom, but have attempted to enter or leave the country using false
documents, is not a breach of article 31 of the United Nations convention. Any subsequent application for asylum in the United
Kingdom would be determined on its individual merits. Detention solely under Immigration Act powers would be authorised only if
there were good grounds for believing that the person would not comply with the terms of temporary admission.

Mr. Kirkhope: The immigration status inquiry unit dates from the late 1970s, although it was known as the overstayer tracing and
information section until 1994.
The unit currently has a complement of 42 administrative staff. A total of 251 local authorities, principally housing authorities,
have registered with it. Other bodies do not register as such but may receive information from immigration and nationality
directorate records only where they have an entitlement within established disclosure policy. The remainder of the information
requested is not available.

Mr. Kirkhope: [holding answer 27 January 1997]:
Information on the average length of time an asylum seeker has been kept in prison can be obtained only by examination of individual
case records. The information requested is, therefore, available only at disproportionate cost.
As at 24 January 1997, the longest currently detained person who had sought asylum, irrespective of their detention location, has
been held--solely under Immigration Act powers--since 12 October 1993. The individual concerned was detained at the end of his
prison sentence following a court recommendation for deportation following his conviction for supplying class A drugs. He
subsequently claimed asylum and the application was refused in February 1994. After exhausting rights of appeal before the domestic
courts, he made an application to the European Court of Human Rights and a date for the full hearing is awaited.

Dr. Lynne Jones: To ask the Secretary of State for the Home Department how many people detained under Immigration Act powers in the
United Kingdom were held in detention at the end of (i) October, (ii) November and (iii) December; in which establishments were they

Mr. Kirkhope: The available information on persons in detention is given in the tables. The numbers of persons who had been detained
at any time and subsequently removed from the United Kingdom under the deportation process were 47 in October and 69 in November
1996. These figures are provisional and include persons departing voluntarily after deportation action had been initiated, but
exclude persons removed as illegal entrants or under port refusal procedures. A corresponding figure for December 1996 is not yet
available. An analysis of the deportation data, showing where the person had been detained, could be provided only at
disproportionate cost.

Mr. Kirkhope: Taking their respective caseloads together, the two directors of the immigration service reviewed detention in 718
cases in 1996. Cases are referred for review by the directors once detention exceeds six months, and monthly thereafter.

Dr. Lynne Jones: To ask the Secretary of State for the Home Department what was the total number of asylum seekers held in detention
at the end of (i) October, (ii) November and (iii) December; in which establishments they were held; what were their (a)
nationalities and (b) gender; and how many were deported and from which establishments. [12321]
Mr. Kirkhope: The available information on asylum seekers detained, and on the number deported from detention, is given in the
tables. The number deported does not include those who are removed as illegal entrants or under port refusal procedures.
A comprehensive breakdown of those recorded as deported from detention, by location of detention, is available only at
disproportionate cost.
