To ask His Majesty's Government, further to the Written Answer by Baroness Merron on 19 September 2024 (HL968), why the Privacy Enhancing Technology data protection impact assessment has not been published, and when they plan to publish it.
NHS England has recently completed a substantial update to the suite of Data Protection Impact Assessments (DPIAs) relating to the Privacy Enhancing Technology (PET). These updates were necessary to ensure that the DPIAs reflect the latest technical developments and governance requirements.
These comprise: a Technical DPIA; a Local Operational DPIA; and a National Operational DPIA. NHS England is now undertaking the final stages of review and preparation to ensure that these documents meet all publication standards and accessibility requirements. It is anticipated that the updated PET DPIAs will be published in December 2025.

NHS England has published on its website an overarching National Health Service Federated Data Platform (FDP) data protection impact assessment (DPIA), an overarching NHS FDP information governance framework, and overarching NHS FDP privacy notice and privacy notices, for each national FDP product.
NHS England plans to publish an overarching NHS Privacy Enhancing Technology DPIA, and a DPIA for each national FDP product on the NHS England website in autumn 2024. These will be placed in the library of the House.

Section 5.1, in the minutes from NHS England’s Advisory Group on Data meeting on 13 June 2024, was a discussion of a proposal that is still in consultation. Therefore, areas including but not limited to types of data use and individual subject rights are still under review and development.
Currently, the only data from NHS Spine used in NHS App analytics is related to the general practice (GP) surgery with which the user is registered. This includes the name of the GP surgery, its postcode, its Organisation Data Service code, and whether the surgery is operational.
NHS App users are informed about what the NHS App offers, and the personal data it requires to function. This information is provided through the NHS App Terms of Use and Privacy Notice, which can be found on the NHS.UK website, in an online only format. These provide details on the use of analytical data, and how users can exercise their rights. Users can also choose whether to allow the NHS App to collect performance data, with further information on this available in the NHS App cookies policy, also available on the NHS.UK website, in an online only format.
