Mr. Morley: The review team completed Stage II of their Quinquennial Review of the Royal Botanic Gardens, Kew earlier this year.
I am placing in the Library of the House a copy of the review team's Stage II report together with the Government's response to both
Stages of the Review. The response has been agreed jointly with the Board of Trustees of the Royal Botanic Gardens, Kew.

Vernon Coaker: To ask the Secretary of State for Environment, Food and Rural Affairs if she will make a statement on farm incomes.

Mr. Morley: Revised estimates of farm income, output and productivity of agriculture during 2001 were published on 31 January. These
confirm the increase in farm incomes forecast last November and indicate a modest rise of 13 per cent. (11 per cent. in real terms).
This increase is due to improved prices leading to higher values of output for milk, potatoes and horticulture outweighing lower
values of output for cereals and livestock. Incomes are forecast to show a further rise in 2002 as the volume of cereal production
returns to more normal levels and the industry starts to recover from the effects of FMD.
Details have been placed in the Library of the House.

Vernon Coaker: To ask the Secretary of State for Environment, Food and Rural Affairs what plans she has to review the options for
further decentralising handling of forestry policy and management. [26399]
Mr. Morley: When I announced the completion of the first stage of the review of the Forest Enterprise executive agency on 10 May
2001, Official Report, column 301W, I said that we intended to review the options for further decentralisation of forestry policy
and management. The Scottish and Welsh Forestry Ministers and I have decided that the review will start shortly and report to us in
the spring. It will consider the current administrative arrangements for delivering sustainable forestry policies in England,
Scotland and Wales and the UK's international forestry commitments, including options for further devolution of these arrangements.
The review will be undertaken by officials from the Forestry Commission, the Department for Environment, Food and Rural Affairs,
Scottish Executive, the National Assembly for Wales, the Cabinet Office and the Treasury. The Northern Ireland Department of
Agriculture and Rural Development will also be involved in the review. Views will be sought from interested parties during the
course of the review.

Mr. Morley: The Rural Payments Agency was launched as an executive agency of the Department for Environment, Food and Rural Affairs
on 16 october 2001. It received accreditation as an EU paying agency on the same date. The chief executive is Mr. Johnston McNeill.
Since that date and until 15 November, when the Intervention Board for Agricultural Produce (Abolition) Regulations 2001 came into
force, the agency has been operating as a joint enterprise between the Intervention Board for Agricultural Produce and the
Department under a single management structure headed by the chief executive.
The House has already been informed of the agency's performance targets on 17 October 2001, Official Report, column 1247W. I am
arranging for copies of the framework document, the corporate plan and the business plan for 2001-02 to be placed in the Library of
the House.

Vernon Coaker: To ask the Secretary of State for Environment, Food and Rural Affairs what the outcome was of the Fisheries Council
held in Brussels on 18 June. [772]
Mr. Morley: I represented the UK at the Fisheries Council on 18 June together with Ms Rhona Brankin, the Deputy Minister for
Environment and Rural Development in the Scottish Executive and Ms Brid Rogers, Northern Irish Minister for Agriculture and Rural
Development.
The Council had a full discussion of the Commission's Green Paper on the 2002 Review of the Common Fisheries Policy. There was
considerable support for the UK's major concerns: to work towards a policy which is economically and environmentally sustainable; to
retain the system of total allowable catches and quotas distributed according to relative stability; to continue with existing
restrictions on access, in particular the six and 12-mile limits which we argued should be established permanently; to provide for
increased involvement of fishermen in developing fisheries policy, in particular through a regionalised approach; to address more
effectively the environmental impacts of fishing, reducing discards, recognising the value of low impact fishing and angling, and
minimising the adverse effects of fishing on non-target species such as small cetaceans; to ensure more consistent and effective
enforcement across all member states; and to tackle more effectively the imbalance between fishing capacity and stocks, not least by
ending the use of subsidies by grant aiding more powerful and efficient vessels.
The work on the Green Paper will continue under the Belgian Presidency and the Commission is expected to produce detailed
legislative proposals later this year.
The Council agreed conclusions on the Commission's action plan on biodiversity. We welcomed these, in particular the commitment to
give priority for action for the most sensitive species listed in the Habitats Directive.
The Commission introduced a communication setting out their thinking on the longer term multi-annual recovery plans for cod and hake
stocks. There was also some discussion of the more immediate measures for North Sea cod which are currently being negotiated with
Norway. The Commissioner emphasised the serious state of the stocks and the need to take substantial measures if the stocks are to
be able to recover. We supported the development of action plans and the inevitable constraints on fishing which would be required
if they were to be effective. But at the same time we stressed the importance of engaging the fishing industry in the development of
plans and the need to take sufficient account of their impact on returns from fishing. The Commission is expecting to conclude
negotiations on North Sea cod with Norway shortly and to introduce measures applicable in 2002; detailed proposals on longer term
measures will be put to the Council for consideration in the autumn.
In view of the failure to establish a new fisheries agreement with Morocco the Council agreed that the existing provision for
structural funds to be made available to support the fishing fleets affected would be extended until the end of 2001. The Commission
plans to make proposals shortly for a restructuring scheme.
Finally, the Commission presented a proposal to extend the multi-annual guidance programme (MAGP IV) for one year until the end of
2002. This will be considered in detail by the Council in the autumn.

We strongly supported the requirement in Article 8 of Directive 98/58/EC for the European Commission to report on the scope for
developing wider international acceptance of EU farm welfare standards. Their report-- which is overdue--will be a key element in
defining how to approach this issue. For our own part, we have argued for the Office International des Epizooties to extend its
activities to animal welfare: and we will take all opportunities offered by international gatherings such as the Animals 2000 World
Congress of the World Society for the Protection of Animals to make contracts and advance this question.

Mr. Morley: The Reports of the Chief Veterinary Officer have recorded the following figures for prosecutions relating to the welfare
of animals on farm in Great Britain in which the State Veterinary Service (SVS) has been involved:

1994: 112
1995: 127
1996: 105.
The figures are for prosecutions on which the State Veterinary Service has worked in liaison with the police, local authorities and
other agencies.
The figures for 1992-94 are for successful prosecutions; those for 1995 and 1996 are for prosecutions initiated.
The relevant powers are contained in the Protection of Animals Act 1911, the Protection of Animals (Scotland) Act 1912, and the
Agriculture (Miscellaneous Provisions) Act 1968.
