Since March 2021, the Department for Work and Pensions (DWP) has been corresponding with the Equality and Human Rights Commission (EHRC) about the Department’s duty to make reasonable adjustments for disabled people pursuant to the Equality Act 2010.
The Department is committed to continuously improving services and delivering in a way that is compassionate and responsive to claimant needs. However, DWP considers it complies with the requirements of the Equality Act 2010 and has not identified any systemic unlawful action.
For that reason, DWP has not reached or entered into a legal agreement with the EHRC and therefore there is no timetable planned for publishing a legally binding commitment.
The Department will continue to work collaboratively with the Commission towards fulfilling shared goals and addressing any of their concerns.

The Department collects data in relation to people with a learning disability where it is relevant to their claim to certain health and disability benefits, as well as making use of the Office for National Statistics Labour Force Survey.

Detailed information about the primary disability of those on Universal Credit receiving the Limited Capability for Work or Limited Capability for Work Related Activity element, and those receiving Employment and Support Allowance is not readily available and has not previously been published.
The Department already publishes annual Official Statistics on the employment of disabled people. These include employment levels and rates for disabled people with severe or specific learning difficulties.

The Government, through the Cabinet Office chaired Accessibility of Elections Working Group, has taken a number of steps to remove barriers that people with a learning disability face in registering to vote and voting at elections. These include:
(a) Facilitating direct engagement between the Royal Mencap Society and political parties through the Westminster Parliamentary Parties Panel on the benefits and timings of producing Easy Read versions of party manifestos, to assist people with a learning disability to make an informed decision when voting at elections.
(b) Introducing on the Register to Vote homepage an ‘Easy Read’ guide produced in partnership with the Royal Mencap Society, to enable people with learning difficulties to apply online without difficulty.
(c) Improving training materials for polling station staff, including the Electoral Commission and the Royal Mencap Society producing videos setting out the voting experience of people with a learning disability at the polling station. A disabled voter can be assisted to vote in the polling booth to mark their ballot paper by the presiding officer or their companion.
