The powers of examination contained in Schedule 7 to the Terrorism Act 2000 are an important tool in countering terrorism. Terrorists often need to travel across borders to plan, prepare and initiate their acts and these powers are essential in helping to identify those individuals. The powers within Schedule 7 allow officers to take biometric material in order to determine if someone is, or has been, involved in the commission, preparation or instigation of an act of terrorism. Nationally, from the introduction of the Terrorism Act up to 31 December 2009, fingerprints and DNA samples have been taken under Schedule 7 on approximately 1,200 occasions. I am advised that there have been three individuals who are known to have applied for the samples to be destroyed under the exceptional case procedure. However, as applications are made to individual forces, it is possible that some cases have not been reported centrally. Of these three individuals, two sets of samples have been destroyed and the third case is still under consideration. These cases have taken between six and 12 months to complete. In response to the European Court of Human Rights judgment in the case of S and Marper v United Kingdom [2008] ECHR 1581, and following pubic consultation in May 2009, the Government laid the Crime and Security Bill before Parliament. It contains provisions that would establish a clear statutory framework for the retention, destruction and use of biometric material, including DNA samples, DNA profiles and fingerprints. They strike a proper balance between protecting the pubic from the threat posed by terrorism and other threats to national security and upholding individuals’ rights and liberties. Furthermore, the powers contained in Schedule 7 are kept under scrutiny by the noble Lord Carlile of Berriew, the independent reviewer of terrorism legislation. He has regularly reviewed and made recommendations as to the use of these powers but has consistently found the powers to be necessary and proportionate.

The National DNA Database (NDNAD) does not hold self-reported ethnicity data, but data on the "ethnic appearance" of persons who have a DNA profile on the database. The ethnic appearance data have six broad ethnic categories plus "unknown". They are based on the judgment of the police officer taking the sample and are recorded for police intelligence purposes to assist in subsequent identification. The ethnic appearance data have only been recorded for volunteer samples since 2005. The table below shows the number of DNA profiles on the NDNAD broken down by ethnic appearance, as at 16 October 2009. "Unknown" means that no ethnic appearance was recorded by the officer taking the sample. The number of profiles held is not the same as the number of individuals. This is because some profiles are replicates—ie, more than one profile is held for one individual. This may occur if, for example, an individual gives different names, or different versions of their name, on separate arrests. It is estimated that 13.8 per cent of the subject profiles held on the entire NDNAD are replicates. Data on the number of subject profiles retained on the NDNAD broken down by ethnic appearance are published in the NDNAD annual reports. The latest annual report for 2007-09 is published on the NPIA website at http://www.npia.police.uk/en/14399.htm.

A DNA sample is biological material containing cells with a person's DNA, whereas a DNA profile is a numerical sequence stored on the National DNA database (NDNAD), which is an IT system. DNA samples can be split into two categories. Subject samples are taken from an arrested person (or in some cases from a volunteer), usually by means of a swab which picks up cells from the inside of the cheek. Crime scene samples are retrieved from material at crime scenes, for example blood, semen or saliva. Both types of sample are collected by the police and sent to an accredited forensic supplier for analysis to produce a DNA profile. The profile is then loaded onto the NDNAD where it can be compared with the other profiles held on the database. The original physical sample is retained by the forensic supplier in a secure environment. When a match occurs between profiles held on the NDNAD the relevant police force is informed. The costs of obtaining, analysing and storing DNA samples fall to individual police forces. They vary depending on the contractual relationship between the police force and the forensic supplier, which is commercially confidential. The NDNAD is operated by the National Policing Improvement Agency (NPIA). Capital investment plans for the NDNAD can be broadly separated into maintenance and development. Maintenance costs equate to approximately £200,000 per annum and relate to the in year costs of replacing equipment that has either failed or reached the end of its lifespan. Development costs are determined firstly by the prioritised development requirements of the NDNAD strategy board, and secondly by the available capital funds within the NPIA and their relative prioritisation across the development requirements of the police service as a whole. The NPIA is currently in the process of business planning around budget requirements over the next one to three years. Until this process is complete, precise capital expenditure plans for NDNAD development are not available. The costs of the NDNAD in 2008-09 were £4,290,500 (this includes both capital and running costs; it is not possible to separate the two).
