Annualised assault rates for each prison for the period April to September 1996 are given in the attached table. Mr. McFall: To ask the Secretary of State for Defence what are the standard disciplinary procedures for his Department's police force; who is the nominated disciplinary officer; and who deputises in the absence of the nominated disciplinary officer. [8935] Mr. Soames: This is a matter for the chief constable chief executive of the Ministry of Defence Police. I have asked the chief constable/chief executive to write to the hon. Member. Letter from W.E.E. Boreham to Mr. John McFall, dated 17 December 1996: I am replying to your Question to the Secretary of State for Defence about disciplinary procedures within the Ministry of Defence Police, as this falls within my area of responsibility as Chief Constable/Chief Executive of the Ministry of Defence Police Agency. The Ministry of Defence Police (Discipline) Regulations 1985, (as amended 1988) are based on the Home Office Police Discipline Regulations. The Deputy Chief Constable is responsible for deciding the level of disciplinary action to be taken in complaints against police and reported disciplinary matters. If it is decided by the Deputy Chief Constable that formal disciplinary proceedings by way of a hearing are required, the officer(s) will appear before either the Chief Constable or a nominated Assistant Chief Constable depending on the seriousness of the matters complained of, and the levels of punishment thought appropriate. However, all complaints against police matters in England and Wales are referred to the independent Police Complaints Authority in the same way as for all other Home Department Police Forces. Complaints matters in Scotland are dealt with in exactly the same way as those considered by Scottish Chief Constables with their Forces. There is no provision in Scotland for an independent body for complaints against the police other than Her Majesty's Inspectorate of Constabulary (Scotland) to whom a complainant may refer if dissatisfied with the Chief Constable's decision. In Northern Ireland complaints are referred to the Independent Commission for Police Complaints for Northern Ireland.

Letter from Richard Tilt to Mr. John Battle, dated 13 December 1996: The Home Secretary has asked me to reply to your recent Question about how many prison staff have been injured due to physical assault from inmates in England and Wales; how many of these cases were pursued in the courts; and how many were dealt with under Prison Rule 47 in each year since 1990. The Prison Service expanded its Incident Reporting System to include the monitoring of injuries resulting from physical assaults by inmates from September 1995. Information prior to this date was not centrally recorded, and could only be provided at disproportionate cost. The number of reported injuries sustained by prison staff for each month since September 1995 is given in the attached table. Information concerning cases of assaults by inmates which were pursued through the courts is not collected centrally and could also only be provided at disproportionate cost. It is not possible to differentiate between inmates who have been dealt with under Prison Rule 47 in cases of assault on prison staff that have resulted in physical injury separately from those where no physical injury was sustained. The number of assaults on prison staff and others proven at adjudication in each year since 1990 are provided in the attached table. Officers are suspended on full pay except where they may be detained in pursuance of a sentence of a court or are in custody between conviction of a court and sentence, or in circumstances where they may have absented themselves from duty and their whereabouts are unknown to the chief officer. Table 1 gives details of the numbers of Metropolitan police officers, including those attached to the south-east regional crime squad, who are currently suspended, and the length of the suspension. [6691] Mr. Maclean: [holding answer 2 December 1996]: Tables 1(i) and 1(ii) set out the numbers of investigations into allegations of corrupt practice against Metropolitan police officers arising from complaints from members of the public or arising from internal sources or internal investigations into corrupt practice, and the outcome of the investigations. The National Criminal Intelligence Service was formed 1 April 1992 and the south-east regional crime squad was set up on 1 April 1993. Police officers are seconded to these organisations from the Metropolitan Police service and from provincial forces. The responsibility for the conduct of any criminal or disciplinary investigation and, if appropriate, the suspension of seconded officers, rests with an officer's home force. Figures for NCIS and SERCS are included, therefore within the Metropolitan police service figures. I understand that there have been no other corruption investigations or allegations relating to officers seconded to these organisations from other forces. Table 1(i) and 1(ii) give figures from 1987 and 1994 onwards. Figures before these years are not readily available and can be obtained only at disproportionate cost. A recorded case may include more than one allegation. In general terms, because of the nature of the investigations, an investigated case is unlikely to be completed in the year in which it is recorded. Table 1 also gives details of the outcome of the investigations, including the numbers of those under investigation who were required to resign or who resigned from the service before their case was heard by a disciplinary board.
