Mr. McNamara: To ask the Secretary of State for Defence (1) how many soldiers have been discharged from the Army in each of the last five years for (a) murder and (b) possession, use or trafficking in drugs; [141018] (2) how many members of the Army have been retained in service in each of the last five years having been convicted of (a) murder and (b) possession, use or trafficking in drugs; [141014] (3) how many soldiers found to be (a) in possession of, (b) using and (c) trafficking drugs have been retained in service for exceptional circumstances; and what are the circumstances in each case. [141016] Dr. Moonie: The Army monitors centrally only statistics of those who have been tried by court martial. Records of those who appear in civilian courts are held at individual regiments and to interrogate those would incur disproportionate costs. We are aware, however, of two people who have been retained in the Army following a conviction of murder in a civilian court. Any murder committed in the UK or Cyprus comes under the jurisdiction of the civil police and is tried in a civilian court. Any murder committed in Germany would, however, be subject to court martial action. No soldier has been tried for murder, by court martial, in the last five years. Up to May 2000, the Army monitored only those cases tried by court martial and those drug offences related statistics are set out in the table: _________________________________________________________________________________________________. The retention of individual soldiers in relation to drug offences is a matter between the employer and employee. Disclosure of the personal circumstances of such cases is inappropriate. Soldiers caught using drugs can also be tried summarily by their Commanding Officer. Since May 2000, the Army has been monitoring cases of summary dealing and recorded figures to date show that 24 soldiers have been dealt with summarily. The Commanding Officer's powers of discipline do not include the power to dismiss. There is, however, a system for administrative dismissal which could be implemented as a result of the soldier's overall performance. The Army's Compulsory Drug Testing programme also highlights those guilty of drug abuse and those caught will normally, but not always, be administratively discharged.

Mr. Hancock: To ask the Secretary of State for Defence what current ISTAR capability and UAVs are available; what Smart Procurement guidelines have been set for the UAV acquisition project; and if he will make a statement. [139654] Dr. Moonie: This is a matter for the Chief Executive if the Defence Procurement Agency. I have asked the Chief Executive to write to the hon. Member. Letter from Robert Walmsley to Mr. Mike Hancock, dated 28 November 2000: I am replying to your question to the Secretary of State for Defence on the current Intelligence, Surveillance, Target Acquisition and Reconnaissance (ISTAR) capability and the Unmanned Air Vehicle (UAV) acquisition project. This matter falls within my area of responsibility as Chief of Defence Procurement and Chief Executive of the Defence Procurement Agency. The current ISTAR capability contributes in both the imaging and electronic analysis areas using a range of platforms across the three environments. These include the long range aircraft such as the SENTRY E-3D, tactical reconnaissance aircraft such as the Jaguar and the Royal Navy's Sea Harrier, and land-based systems such as the recently introduced ODETTE electronic support system. In the future, the Airborne Stand-Off Radar (ASTOR) platform with its synthetic aperture radar and moving target indicator capability as well as improved tactical reconnaissance systems and enhanced land and maritime electronic analysis systems, will be introduced into service. The PHOENIX system is currently the only UAV asset within the ISTAR inventory. Originally developed as a Target Acquisition and Surveillance system, PHOENIX has now completed two operational tours where it has been used as part of the overall requirements for ISTAR. Within the context of Smart Acquisition guidelines and to optimise the overall requirements for a future ISTAR capability, a series of studies is in place aimed at identifying the most effective mix of both manned and unmanned assets. With regard to UAVs, the WATCHKEEPER project, as a part of this overall investment analysis, is seeking to establish the most cost-effective whole-life solutions and the optimum balance of investment in new, existing assets or a combination of the two. The UAV programme is being managed by an Integrated Project Team (IPT) bringing together the main stakeholders who have an interest in the ISTAR assets and the products they deliver. Industry has been involved from an early stage in an open and constructive relationship and has assisted in the development of the emerging requirements.

The charge to customers for the use of the NBC Training Facility at DERA Porton Down, known as the Battle Run, comprises range maintenance and manpower operational costs as well as an element of profit as agreed between DERA and MOD in their Terms of Business Agreement (TOBA). The actual amount of usage and the associated cost are agreed on a yearly basis within an agreed limit of liability which is specified in the contract for use. The basis for the calculation of charges for each of the three years and the current year is the same apart from adjustments for inflation, the amounts of which are also agreed between MOD and DERA. The charges to HQ Land Command, the Ministry of Defence budget holder for these units, for each of the three years were £48,928, £42,118 and £51,715 respectively. Costs are not attributed to individual Units. Costs include elements for facility maintenance and improvements to overall capability as well as the actual operational cost for the conduct of the Battle Run training.

The figures do not include ex-Regular personnel who are not in a Reserve Force, but who retain a general liability to recall to the Regular Services in a serious crisis as defined in the Reserve Forces Act 1996.
