Mr. Bill O'Brien: To ask the Secretary of State for Defence how many members of Gurkha regiments who were prisoners of the Japanese
in the Second World War and their widows will receive compensation; and if he will make a statement. [138618]
Dr. Moonie: As I announced on 7 November 2000, Official Report, columns 159-70, the Government are making a single ex gratia payment
of £10,000 to each of the surviving members of the British groups who were held prisoner by the Japanese during the Second World
War, in recognition of the unique circumstances of their captivity. Those who are eligible to receive this payment include former
members of HM Armed Forces who were made prisoners of war.
Prior to 1947 there were no Gurkha Regiments in the British Army. The (old) Indian Army, which included Gurkha regiments, was
separate from the British Army and responsibility for it passed to the new Governments of India and Pakistan when those countries
became independent. Former members of the (old) Indian Army generally did not receive payments under UK auspices under the 1951 San
Francisco Treaty of Peace with Japan and are not eligible for the current ex gratia scheme.

Mr. Spellar: Common law claims against the Ministry of Defence are handled centrally and compensation is paid from central funds.
Our claims databases do not, at present, record information in such a way that it can be comprehensively broken down into the
categories set out in the question. Additionally, our records do not go back as far as the ten years requested. The following table
does, however, set out the total number of claims of all types received, the total number settled and the overall in-year claims
expenditure since 1992-93. When reading these figures it must be borne in mind that claims may not always be settled in the year
they are received. There is therefore no direct correlation between the numbers received and settled in any one year.

Dr. Harris: To ask the Secretary of State for Defence what the additional cost to public funds was in (a) legal costs incurred by
the (i) Government and (ii) applicants and (b) damages awarded to the applicants by the decision to continue to contest cases
relating to homosexuals in the armed forces (i) between 16 February 1996 and 1 May 1997 and (ii) after 2 May 1997. [138466]
Mr. Spellar: Compensation and legal costs have been paid in the four cases covered by the European Court of Human Rights judgment of
27 September 1999 and the figures are shown in the table. In addition, in light of the ECHR judgment, the Secretary of State for
Defence authorised that settlement negotiations commence with those individuals discharged from the armed forces as a result of
their homosexuality who had submitted Employment Tribunal applications and whose account is accepted as being substantially
factually true. The level of compensation paid to those applicants who settled their cases during the periods in question, together
with legal costs incurred by the Minister of Defence, are also shown in the table. Legal costs incurred by Employment Tribunal
applicants are not normally recoverable from the Defendant and therefore the Ministry of Defence has no record of such costs.
Settlement negotiations on the remainder of the outstanding cases remain ongoing.

Dr. Moonie: A central record of complaints from service personnel and their families alleging medical negligence is kept only of
those cases where compensation is being sought. However, prior to 1996-97 such claims were not recorded separately from other common
law claims for compensation. The vast majority of the claims detailed in the table have been the subject of legal proceedings, but
this does not necessarily mean that they were all heard in court. The majority of claims are settled amicably on a legal liability
basis without recourse to the courts. The payment of compensation does not necessarily occur in the financial year that the claim
was received.

Dr. Moonie: In 1964 the German Government agreed a £1 million settlement to compensate British victims of Nazi persecution. All
those, including British service personnel, who were held in Nazi concentration camps were eligible under this scheme.

Dr. Moonie: This is a matter for the Chief Executive of the Defence Evaluation and Research Agency. I have asked the Chief Executive
to write to the hon. Member.
Letter from Sir John Chisholm to Mr. Alex Salmond, dated 25 July 2000:
I am replying to your question about CBW experiments as the Chemical and Biological Defence sector at Porton Down is now part of the
Defence Evaluation and Research Agency.
Since 1916, establishments based at Porton Down have been involved in the research and development that has underpinned the UK's
chemical and biological defence capability. Throughout Porton Down's history, volunteers from the services have been a vital part of
the research programme. Over 20,000 individuals have participated in projects aimed at developing protection against and treatment
for the effect of chemical and biological agents. The majority have had no complaint about their attendance at Porton Down. We are,
however, aware that there are some former volunteers who believe that they have suffered ill-health as a result of the trials in
which they took part. I am afraid we are unable to provide the exact number of complainants as they have made their representations
through a number of different channels.
Since 1 March 1998, we have responded to 42 enquiries from the War Pensions Agency concerning claims arising from taking part in the
service volunteer programme at Porton Down. In each case, we have provided information about the particular trials in which an
individual participated but we have not been informed whether these claims have been successful. We are, therefore, unable to answer
your specific questions about the number of pensions and expenditure on them in Scotland.
We are not aware of any other establishments in the UK that have carried out chemical and biological defence research involving
service volunteers.
I hope this explains the position.

Mrs. Ewing: To ask the Secretary of State for Defence if he will give a breakdown of the cost of potential claims resulting from

Mr. Spellar: As at 4 July 2000 the Ministry of Defence had received 1,841 notices of intention to claim from veterans and members of
their families in respect of illness allegedly arising from the Gulf conflict, although no writs or properly formulated claims have
so far been received. It will not be possible to estimate the overall cost of these claims until such time as specific allegations
of negligence have been submitted together with an indication of an individual's symptoms, degree of disability and personal
circumstances, which would determine the level of any award.
The Ministry of Defence does not record the number of intentions to claim by region.

Mr. Spellar: [holding answer 28 January 2000]: My right hon. Friend has been considering draft proposals from the Joint Compensation
Review. He believes, however, that it will be possible to reach final conclusions about attributable benefits only in the context of
proposals about the future of the Armed Forces Pension Scheme as a whole, which will emerge from the parallel Review of the Armed
Forces Pension Scheme (AFPS). That Review is still in progress. My right hon. Friend will therefore make an announcement once he has
considered the draft recommendations of the AFPS Review. The announcement will be followed by a period of public consultation.
