Ms Dari Taylor: To ask the Secretary of State for Culture, Media and Sport for what reasons he requested that the scrutiny reserve
be lifted on the EU Declaration on Sport. [143663]
Mr. Chris Smith: The European Scrutiny Committee have recommended that the Declaration on Sport be debated with the Helsinki Report
on sport, and the Community Support Plan to combat doping in sport. It is planned that the debate be held in the new year. I believe
that it was important for the Prime Minister to be able to agree the Declaration at the Nice European Council Meeting, particularly
as it would have been viewed as a reversal of our position should the UK not have been in a position to support it. We have argued
long and hard to secure the changes which meet the Government's objectives.
The declaration fully acknowledges the prerogatives of sports organisations; it underlines that while commercial sport should be
subject to EU regulations, those regulations must be applied in a way that recognises the special nature of sport; and it does not
envisage any expansion of the role of the Commission in relation to sport. The declaration creates no new obligations for the UK and
in essence reinforces the message of previous statements at Helsinki and Feira.

Mr. Clifton-Brown: To ask the Parliamentary Secretary, Lord Chancellor's Department what guidance he has issued on sentencing policy
for those dealing with intent in proscribed drugs. [141600]
Jane Kennedy: I refer the hon. Member to the written answer I gave him on 25 July 2000, Official Report, column 538W.
Sentencing is a matter for the courts. Parliament lays down the parameters within which sentencers must work. It is then for the
courts to decide on the sentence in the light of the facts of the case and after taking into consideration the circumstances of the
offence and the offender. The Government cannot issue guidance to sentencers as it is a fundamental principle that the Executive
does not interfere with judicial discretion.

Mr. Simon Hughes: To ask the Secretary of State for the Home Department what plans he has to extend drug referral schemes to include
referral for alcohol abuse; and if he will make a statement. [142609]
Mr. Charles Clarke: The drug arrest referral schemes, promoted and supported by the Home Department, with £20 million from the Crime
Reduction Programme, encourage the referral worker to assess the needs of those who have been arrested. While the focus is on drugs,
the assessment will identify alcohol and other issues with which the individual has problems. The arrestee is referred to
appropriate services, including those which can respond to alcohol abuse where they exist.
The Home Department is committing some £140 million over the next three years to help meet the treatment needs of drug misusers.
This will include those referred through arrest referral schemes.

"Statistics on Race and the Criminal Justice System" to be published in January 2001 will provide some related information. For the
first time, it will show, by police force area and ethnic appearance, the number of persons arrested and the number cautioned by the
police in England and Wales for drugs offences in general. Copies of this publication will be available in the Library.

Dr. Tonge: To ask the Secretary of State for the Home Department what plans the Government have to audit the costs of enforcing the
law relating to illegal drugs. [142212]
Mr. Charles Clarke: [holding answer 13 December, 2000]: Assessing the costs of anti-drugs activities is inherently difficult because
these often form part of wider functional service expenditure. For instance, up to one third of all property crime is thought to be
drugs related, imposing a considerable burden on the Criminal Justice System. Broad assessment of the costs imposed by illegal abuse
on public services and the proactive measures centred on tackling their root causes were made in the 2000 Spending review.
Indicative spending totals for the latter were published in the Spending Review White Paper (Cm 4807).
The Government are committed to improving their understanding of these totals. As part of its Service Delivery Agreement, the
Cabinet Office, which is responsible for the United Kingdom Anti Drugs Co-ordination Unit, will implement a robust system for
tracking total anti-drugs related expenditure and outputs by March 2002 and demonstrate that by March 2004 there will have been a 45
per cent. increase in spend on proactive effort on a 2000-01 base.

Mr. Dalyell: To ask the Secretary of State for Defence if he will make a statement on the role of drug rehabilitation activity in
the Armed Forces. [143101]
Mr. Spellar: The Armed Forces regard drug taking as a matter of the utmost seriousness. A comprehensive drugs education and
awareness programme, together with a random Compulsory Drugs Testing (CDT) programme is employed to dissuade Armed Forces personnel
from taking drugs. A positive CDT test result by a member of the Services will, in most cases, lead to an administrative discharge
which no rehabilitation offered. Those few personnel who test positive, and are retained under exceptional circumstances, receive a
formal warning and are closely monitored and subject to no-notice drug re-testing for a period of between two and five years. They
also attend the routine Services' drug education and awareness programme during the monitoring period.
The position for those Service personnel who are detained at the Military Corrective Training Centre (MCTC) following a conviction
for a drug related criminal offence is slightly different. MCTC employ a civilian drugs counsellor to provide confidential
counselling and advice to drug offenders. This support is enhanced further by a civilian medical officer and welfare officer.

Mr. Charles Clarke: There is little I can usefully add at this stage to my reply to my hon. Friend's question on 29 November 2000,
Official Report, column 681W. The Advisory Council on the Misuse of Drugs (ACMD) and the European Monitoring Centre on Drugs and
Drug Addiction (EMCDDA) have concluded, separately, that the available data do not support calls to increase the controls on GHB.
But both organisations have decided to see if additional data can be obtained to better inform their decisions. I look forward to
receiving their further advice in due course.
I have seen the report of the World Health Organisation recommending that GHB should be scheduled under Schedule IV of the United
Nations (UN) Convention of Psychotropic Substances 1971. I understand that all parties will be voting on this recommendation at the
meeting of the UN Commission on Narcotic Drugs in March 2001. In order to assist the Commission in making a decision the United
Nations International Drug Control Programme has asked for further data from parties' Governments about GHB in general, but
specifically about seizures. We are in the process of collating data from a range of sources in order to comply with this request.

Yvette Cooper: Routine surveillance of hepatitis B infection is based on laboratory diagnoses. Data on injecting drug users from
1995 to 1999 are given in the table. These data are subject to under-reporting as about 60 per cent. of adult infections are
asymptomatic and information about risk factors that may be relevant to the acquisition of infection is not available for about 40
per cent. of reports.

Routine surveillance of hepatitis C infection is based on laboratory reports of antibodies to hepatitis C. Data on injecting drug
users from 1995 to 1999 are given in the table. These data do not distinguish between resolved and chronic infections and are
subject to under reporting as most infections will be asymptomatic. Information about the acquisition of risk factors that may be
relevant to the acquisition of infection is available only for about 50 per cent. of reports.

There have been 14 laboratory reports of acute hepatitis B infections in diabetics in the period 1990 to 1999. However in only three

Mr. Boateng: The drug treatment and testing order was only rolled out to all courts in England and Wales from 1 October. It had
previously been piloted between 1 October 1998 and 31 March 2000 in three areas: Croydon, Gloucestershire and Liverpool. By the end
of the pilots 31 offenders had successfully completed their orders or were nearing completion.
It is estimated that on average an order costs approximately £6,000.
Statistics on orders made, breach and revocation in each of the pilot areas are given in the table.

Mr. Boateng: The information for each local probation board is set out in the table. No decision has yet been taken on whether
expenditure on Drug Treatment and Testing Orders (DTTOs) will continue to be ring-fenced after 2001-02. The roll out of DTTOs has
occurred, and only from 1 October will it be necessary to consider the implications of this roll out before a decision is made for
2002-03 and beyond.

Mr. Boateng: The information requested is not available. No statistics are collated centrally on offences committed to support the
use of illegal drugs and tobacco. However, information on persons who have been convicted of drug offences is contained in the Home
Office Bulletin on Drug Seizure and Offenders, a copy of which is in the Library. Reference was made in a written answer on 27
November 2000, Official Report, column 441W, to the hon. Member about information bearing on the relationship between drug use and

Mr. Bayley: Incapacity Benefit replaced Sickness Benefit and Invalidity Benefit in April 1995. As separate figures for Sickness
Benefit are not available, the table shows the number of people with a diagnosis of alcoholism or drug abuse as the main medical
condition who, at a date in each year since 1990, were entitled to Invalidity Benefit or the Incapacity Benefit equivalent (either
short-term higher or long- term rates).

Letter from John Pullinger to Mr. Paul Flynn, dated 30 November 2000:
The National Statistician has been asked to reply to your recent question on the trend in the number of deaths in the UK resulting
from heroin use between 1990 and the most recent year for which figures are available (137468). I am replying in his absence.
Methods for identifying deaths related to heroin differ among the constituent countries of the UK. Figures on the basis currently
used in all countries are only available from 1994 onwards.
For Britain (England & Wales and Scotland), these figures represent the number of deaths where the underlying cause of death is
regarded as resulting from drug-related poisoning, according to the current National Statistics definition, and heroin or morphine
were either mentioned on the death certificate, or in additional available information. As heroin breaks down in the body into
morphine, the latter may be detected at post mortem and recorded on the death certificate. Figures are therefore provided for deaths
with a mention of either substance.
Figures for Northern Ireland represent deaths where the underlying cause was due to poisoning by opiates and related narcotics, code
N965.0 in the International Classification of Diseases, Ninth Division, (ICD9).
The figures requested are presented in the table below:

Mr. Mackinlay: To ask the Solicitor-General what was the cost to the Crown Prosecution Service of the attempted prosecutions in
relation to Operation Nectarine; and if he will make a statement. [140071]
The Solicitor-General: The Crown Prosecution Service prosecuted eight defendants, one of whom pleaded guilty, following a police
investigation into the alleged importation of cannabis.
This joint investigation between Kent police, the National Crime Squad and the Metropolitan police CIB3 was known as Operation
Nectarine.
The total cost to the CPS of the trial and the pre-trial case preparation amounted to £481,891. This comprised £82,000 resource
costs directly attributable to the CPS and a further £399,891 in Counsel's fees.
