Mr. Hood: To ask the Secretary of State for Environment, Food and Rural Affairs what the outcome was of the Agriculture and
Fisheries Council on 22 and 23 November; what the Government's stance was on the issues discussed, including its voting
record; and if she will make a statement. [199752]
Margaret Beckett: My hon. Friend the Under- Secretary and I represented the United Kingdom at a meeting of the Agriculture and
Fisheries Council in Brussels on 22 and 23 November 2004. The Scottish, Welsh and Northern Irish Ministers with
responsibility for agriculture and fisheries were also present.
The Council opened on the first day in office of the new Commission. The Council welcomed Commissioners Mariann Fischer-Boel, Markos
Kyprianou and Joe Borg to their new posts. The Presidency secured qualified majority support for a political agreement on a
compromise text updating the current rules on the welfare of animals during transport. I supported the proposal, which contains
significant improvements to the current rules, including a strengthening of the enforcement rules in Europe, stricter rules for
journeys of more than eight hours and new rules for the transport of horses. The proposal also sets out a clear timetable for the
review of the new rules together with a commitment to address the issue of journey times, space allowances and rest periods no later
than four years after they have come into effect.
The Council had a lengthy exchange of views on reform in the sugar sector, based on the Commission's communication of July 2004. The
Commission indicated that it would not make formal proposals until May or June next year when the result of the EU's appeal against
a WTO panel ruling on the sugar regime had been received. The Commission would press for political agreement before the WTO
Ministerial scheduled for Hong Kong in December 2005. A majority of member states were critical of the Commission's approach thus
far and argued for minimal change, principally aimed at maintaining production in all those areas of the EU where it is currently
found. I argued that the current regime was unsustainable and that reform was inescapable. The EU needed to honour its external
obligations and I welcomed the Commission's commitment to bringing forward a draft action plan for assistance to the ACP countries
by the end of the year.
In a brief discussion of the rural development and CAP financing proposals, there was general support for the rural development
measures, although concerns were expressed on a number of specific issues such as the proposed structure for the new regulation and
the treatment of less favoured areas. I stressed the importance of further transfers to Pillar 2 measures, the case for a more
objective allocation of funds and the need for equitable treatment of the non-euro member states. Discussion will continue at
official level.
The Presidency drew attention to its initiative for member states to co-operate on agricultural research in order to avoid
duplication and to maximise value for money. I supported this initiative and expressed our readiness to co-operate with Luxembourg
in taking it forward next year.
Under Other Business, Estonia described its problems relating to a Russian ban on imports of plant material, Spain called for
collaboration with Morocco in the field of animal health, Germany asked the Commission to bring forward legislation on the marketing
of seeds of plant varieties of conservation importance, and Slovakia requested funding under the natural disasters heading
following gales in the High Tatras national park.
The Commission reported progress in the bilateral negotiations on a 2005 fisheries agreement with Norway. Good progress had been
made in a first round of negotiations on 15-19 November, including provisional agreement on some of the more contentious
issues. My hon. Friend and other member states congratulated the Commission on progress so far while underlining the importance of
concluding the negotiations rapidly so that EU fishermen are able to fish in Norway waters from 1 January.
The Council had a first debate on the Commission's proposals for a European Fisheries Fund (to replace the existing fund for
structural improvements in the fisheries sector from 2007). My hon. Friend made clear that the proposal from certain other member
states that this should provide for subsidies for fleet renewal would mean going back on a key plank of the 2002 reform of the
Common Fisheries Policy and was not acceptable. Discussions will continue next year.
The Council reached agreement by qualified majority on a proposal to allocate quotas to deep sea species to certain new member
states, based on a presidency compromise tabled at the meeting. Although the compromise went some way towards requests from the
United Kingdom and others that new allocations should be on the same basis as allocation to the EU15, the UK abstained in the vote
because the proposal had not cleared Parliamentary Scrutiny and because the Government have concerns about the management regime for
deep sea species.
The Council held a discussion on management measures for fisheries in the Baltic Sea.

Mr. Bradshaw: The conservation of marine biological resources under the common fisheries policy has been an exclusive competence of
the Community since 1979. This competence is derived from a combination of the EC Treaty and the language negotiated in 1973 in the
UK Act of Accession and endorsed by all the then member states. This has been confirmed by the European Court of Justice.
The new Constitutional Treaty has been drafted to reflect this position and does not extend competence in fisheries.

Mr. Bradshaw: The proposals for creation of a Community Fisheries Control Agency are still subject to negotiation. However, they
will not alter the responsibilities of the United Kingdom or other member states to ensure effective policing of fisheries activity:
we will want to be satisfied that the final regulation is compatible with our national arrangements.
The creation of an agency is intended to assist in, for example, joint planning for the deployment of inspection resources. This
might involve member states contributing resources to agreed monitoring programmes for specific fisheries. In many respects this
would be little different from ad hoc arrangements for joint working in which the UK has participated over recent years.

Margaret Beckett: My hon. Friend the Parliamentary Secretary and I represented the United Kingdom at a meeting of the Agriculture
and Fisheries Council in Luxembourg on 18 October 2004. The Scottish Minister for Environment and Rural Development was also
present.
As this was the last Council expected to be attended by Commissioners Franz Fischler and David Byrne, the Council took the
opportunity to pay warm tribute to the contribution that they had made during their time in office.
As to the agenda, the Council responded to a number of key questions arising from a Commission report on the simplification of the
common market organisation in fruit and vegetables. I joined several delegations in noting that, while changes to the regime agreed
in 1996 have had a positive effect, we need to look constructively at the scope for further changes, including increased flexibility
and subsidiarity in the regime. Its impact on developing countries and on the Doha Development Agenda would also be important
factors. We should be wary of further intervention in the market but we could look at the scope for promotion of fruit and vegetable
consumption. The Commission will reflect upon the exchanges before tabling any proposals for further reform. Discussion will resume
at official level.
The Council took note, without discussion, of discussions on the European Action Plan for Organic Food and Farming and agreed
conclusions supporting a range of further actions.
On fisheries, my hon. Friend the Parliamentary Secretary emphasised the importance of consistent and effective enforcement of the
Common Fisheries Policy (CFP), and welcomed the proposal for a Community Fisheries Control Agency. However, he emphasised that the
Agency should act in a co-ordinating, not instructing role; that it should build on work to develop a regional input to the CFP; and
that it should be cost neutral. Many delegations made similar points. Discussion will continue between officials.
The Council held an initial exchange of views in preparation for this year's negotiation on a fisheries agreement with Norway. My
hon. Friend made clear the high priority the United Kingdom attaches to ensuring that the EU has access to the full amount of Arctic
cod quota it is entitled to under the terms of the EEA Agreement, and identifying stocks that the EU can offer Norway in exchange
without making use of mackerel which is a fully utilised quota stock. There was general agreement that the Commission needed to take
a robust line with Norway. Further preparations for the negotiation will be taken forward by officials.
The Council held a policy debate on Commission proposals for recovery plans for hake and Norway lobster in the Cantabrian Sea and
for sole stocks in the Western English Channel and Bay of Biscay. My hon. Friend made clear the United Kingdom's commitment to
sustainable management of western Channel sole which is an important stock for fishermen in south-west England, but that we do not
believe western Channel sole should be a recovery stock or that the Commission's effort control proposals are appropriate. He drew
attention to the advice on this stock delivered by the International Council for the Exploration of the Seas (ICES) in August which
suggests that this stock is less likely to be outside safe limits than other sole stocks, confirming the results of collaborative
research carried out with commercial fishing vessels in the south-west. He called for inconsistencies between this advice and the
most recent ICES draft advice to be clarified urgently. Other member states expressed a range of views on the recovery plan
proposals. Discussions will continue among officials.
The Commission reported on the state of play on a number of important trade negotiations. On the WTO, Commissioner Fischler welcomed
the framework agreement reached in Geneva in the summer as a basis for continued detailed negotiations which safeguard essential
European interests. He also reported on the continuing attempts to make progress in the EU/ Mercosur negotiations; on work to agree
a tariff-only arrangement for reform of the banana regime; and on resolving outstanding negotiations with certain third country
suppliers of rice. Among a long list of many other business items, I and several others supported a Danish request to consider how
best to include low fat dairy products in the school milk programme. Several, mostly central European, member states drew attention
to the problems on the EU cereals market following this year's harvest. Other matters raised were: the impact of the US
Bio-terrorism Act, implementation of the reformed CAP in Denmark, state aid for weather damage in Lithuania, the co-existence of GMO
and other crops, the impact on fishing of increased diesel prices in France and the EU/Angola Fisheries Agreement. The Commission
tabled a written report on continuing BSE control measures. France reported on its action to deal with a recent case of rabies in an
imported dog. Spain reported an outbreak of blue tongue disease in cattle in southern Spain and drew attention to a forthcoming
conference on plant genetic resources.

Mr. Carmichael: To ask the Secretary of State for Environment, Food and Rural Affairs what role the Government intends regional
advisory councils to have in the management of fisheries; and what steps they are taking. [190635]
Mr. Bradshaw: The Common Fisheries Policy (CFP) needs better stakeholder engagement and a more regional focus, and Regional Advisory
Councils (RACs) are a key part of the reforms agreed in 2002. They are international stakeholder-led organisations that will advise
the Commission and the Member States on sustainable fisheries management.
The Government is taking a leading role to facilitate the establishment of RACs (the North Sea RAC will be the first) and will
continue to support them as they become functioning advisory bodies. We have worked closely with the Commission and other Member
States as well as the Scottish Executive, provided funding for stakeholder meetings and secured a three year contribution to the
running costs of the North Sea RAC from Member States. As the RACs become functioning advisory bodies, we will continue to work with
