Mr. Simmonds: To ask the Secretary of State for Foreign and Commonwealth Affairs what discussions his Department has engaged in with
the Government of Brazil regarding computer hacking. [189883]
Mr. Rammell: We are in close contact with the Brazilian Government on a number of organised crime issues including hacking and other
hi-tech crime. In mid-September, the head of the UK's National Hi-Tech Crime Unit (NHTCU), and representatives from the British
embassy attended the first International Conference on Cyber Crime Investigations in Brasilia. We hope that the Brazilian Federal
Police will also attend the NHTCU's E-crime Congress to be held in the UK in April 2005.

Statistics on court proceedings for 2003 will be published in the autumn.

Mrs. Curtis-Thomas: To ask the Secretary of State for the Home Department what penalties will be applicable to hackers attempting to
access the National Identity Register. [170326]
Mr. Browne: Clause 31 of the draft Identity Cards Bill published by my right hon. Friend the Home Secretary on 26 April (Cm
6178) deals with cases where someone modifies information held on the Register to falsify it. This includes hacking into the
Register. Such an act would be an offence under the Computer Misuse Act 1990, however it would attract only a maximum penalty of
five years.
The draft Identity Cards Bill includes a provision to increase the maximum penalty in cases involving the National Identity Register
to 10 years to ensure consistency with the false identity documents offences in the draft Bill.

Mr. Watson: To ask the Secretary of State for Trade and Industry what discussions she has had with the mobile telephone industry to
reduce the vulnerability to hacking of Bluetooth-enabled telephones and wireless headsets. [169237]
Mr. Timms: DTI officials are in regular contact with mobile industry bodies and have raised this issue with them.
All Bluetooth devices adhere to the Bluetooth technical specification in order to ensure worldwide compatibility. Action to address
the vulnerability of Bluetooth enabled devices to hacking would therefore need to be taken at the international level to be
effective across all devices. However, not all Bluetooth devices are vulnerable to this security threat.
I understand that the industry is working both to address the vulnerability of all new devices (of the type affected) to hacking,
and to tackle the present threat.

Michael Fabricant: To ask the Secretary of State for the Home Department what measures he plans to increase the number of arrests of
hackers who send viruses via spam advertising. [159750]
Caroline Flint: The investigation and arrest of individuals who disseminate viruses is a matter for law enforcement. Where
individuals are discovered to have disseminated viruses which cause the unauthorised modification of data they can be prosecuted
under Section 3 of the Computer Misuse Act.
We have set up the National Hi Tech Crime Unit (NHTCU) as part of the National Crime Squad to combat national and transnational
hi-tech crime within or which impacts upon the UK. This includes the investigation of hacking and virus writing. The Unit, together
with the specialist units within local forces which also deal with such investigations, have established good international links
with overseas industry and law enforcement, necessary to follow the evidence trail to discover and prosecute the perpetrators of
such offences.
There have been a number of successful prosecutions against virus writers and disseminators.
In December 2003, the UK introduced new controls on unsolicited direct marketing e-mails, under the Privacy and Electronic
Communications Regulations. Direct marketing e-mails may not now be sent to individual subscribers without their prior consent. The
new opt-in rules do not apply to direct marketing e-mails sent to corporate subscribers (e.g. limited companies and other
organisations). However, all direct marketing e-mails, regardless of who they are sent to, are required by the regulations to
contain proper sender and contact details for opt out purposes.

Beverley Hughes: The security and integrity of the database are integral to maintaining trust in the Identity Cards scheme. The
specifications and design of the database and its security features have not yet been established but will take into account
security advice from the earliest stages and the design process will include threat and vulnerability assessments. Threats which
will be assessed will include unauthorised internal and external access to data.
Home Office officials are already working with security experts to ensure that security issues are considered from the start of the
database design, and with other government departments which have similar databases with similar security needs, such as the United
Kingdom Passport Service.
The Identity Cards Programme takes risk management extremely seriously and has developed its approach to risk management in line
with Home Office best practice. The Programme Board and Ministers are considering the Governance arrangements for the ID Cards
scheme and will consider what the risk management system should be in order to ensure the security of the Identity Card scheme.

Mr. Alexander: I have been asked to reply.
The Cabinet Office provides all Government Departments with comprehensive guidance on information security which is regularly
updated as required. This includes advice on how to protect against internet hackers and fraudsters. Departments also subscribe to
UNIRAS, the Government's incident reporting and alert scheme, which provides immediate warnings and advice on how to protect against
the latest threats.
