The rules on eligibility for free national health service hospital treatment were published in ‘Implementing the Overseas Visitors Hospital Charging Regulations: Guidance for NHS Trust Hospitals in England' in April 2004. This document provides guidance on how to interpret the NHS (charges to overseas visitors) regulations 1989, as amended. It is available in the Library and on the Department's website at: www.dh.gov.uk/assetRoot/04/10/60/24/04106024.pdf.It is these regulations which govern who is entitled to free NHS hospital treatment in England.

The cost of Herceptin will need to be met from the existing settlement agreed for the national health service.We understand that some trusts are already under financial pressures and may have to make difficult decisions in achieving this. However, we have greatly increased the amount of money going into the NHS and those trusts with deficits have financial recovery plans in place.Funding of the NHS has increased from £34.7 billion in 1997–98 to £69.7 billion in 2004–05. By 2007–08 spending on the NHS will have increased to £92 billion.

This includes expenditure on services provided by all non-NHS bodies, including local authorities, other statutory bodies, and the independent sector.NHS spending on the nationally procured independent sector services was £78.8 million in 2004–05 and is included in the above figure.

Since August 2001, a penalty charge system has been in place in respect of those falsely claiming exemption to national health service pharmaceutical charges. Since its introduction, more than 160,000 penalty notices have been issued. The total amount recovered to date is over £2,950,000. These figures are national and are not broken down into the age categories and regions as requested. Penalties are sanctioned through the civil courts as criminal prosecution of offenders would not be a cost-effective way of dealing with such high volume but low-value frauds.The introduction of the penalty charge system has enabled the money recovered to be re-invested in providing better patient care within the NHS.

Forty-two local improvement finance trusts (LIFT) have reached financial close in three waves. The total capital value of financially closed schemes undertaken by these trusts is over £740 million. The following table gives the total capital value of these schemes for each trust.Total investment figures for each scheme are not collected centrally. However, as a general rule, private investment is 96 per cent, and the public sector investment is 4 per cent, of the total value.

It is currently possible for some secondary care schemes to be taken forward by a local improvement finance trust (LIFT) company. However, it is for local health economies to determine their best procurement option for delivering new health care facilities. Their options could include LIFT, the private finance initiative or public capital with consideration given to achieving an optimum level of risk transfer and appropriate payment and performance mechanisms to deliver a value for money project.

The NHS Litigation Authority was established on 20 November 1995 by the Secretary of State for Health to perform such functions in connection with the establishment of a scheme under Section 21 of the National Health Service and Community Care Act 1990 (scheme for meeting liabilities of health bodies), and such other functions as the Secretary of State may direct the authority to perform on his behalf. Five schemes were established (the existing liabilities scheme, the ex-regional health authority scheme, the clinical negligence scheme for trusts, the liabilities for third parties scheme and the property expenses scheme) and the NHSLA were required to administer these schemes.The Government have not placed any duty upon the NHSLA to reduce the level of claims sought against the NHS for clinical negligence and performance of the authority is not assessed in this area. However, the NHSLA promotes good practice in the NHS by risk assessing all scheme members once every two years against a set of risk management targets. Trusts are incentivised in two ways: first, the level of risk management is assessed against three levels of attainment, achieving a discount of contributions into the clinical negligence scheme for trusts as attainment increases. Secondly, the risk management systems assist NHS scheme members to drive down the levels of incidents, which in turn reduces the levels of compensation claims.

For most hospital trusts, payment by results applies only to elective admissions. We are introducing the new tariffs gradually, over a four-year period, so that national health service organisations can get used to the new system. By 2008, payment by results will apply to the vast majority of acute services.

I think that I heard the Minister say a moment ago that one digital hearing aid was being fitted every minute. A quick calculation will establish that the NHS is spending about £200,000 per minute, and I am pleased that some of it is being devoted to hearing aids. I have impaired hearing myself, with chronic tinnitus.
Is the Minister aware that some of the NHS hearing aids that have become available recently have a facility that suppresses some annoying background noises, such as tinnitus? Does he intend to acquire some of those new hearing aids, and tune them to suppress the background noise that we hear from Opposition Members who whine about a lack of investment in the health service, but oppose every opportunity for proper funding?

My hon. Friend surely has a point. We know that a policy commission has been set up by the Conservatives under the chairmanship of the right hon. Member for Chingford and Woodford Green (Mr. Duncan Smith) and everything is apparently up for grabs. I look forward to finding out whether we shall hear any more about the pledge to abolish all targets, including waiting lists, which was point No. 1 in their timetable for action. I also look forward to hearing about the death knell of the patient's passport.
