The Crown Prosecution Service (CPS) has a 10 year Public Finance Initiative Partnership with LogicaCMG to modernise information technology within the Service. This is known as the COMPASS Programme.The contract with LogicaCMG covers the provision, support and maintenance of the hardware and software applications used by the CPS. This includes: the case management databases; the COMPASS Case Management System; the Management Information System; the Witness Management System; and the Payroll, Graduated Counsel Fee Scheme and the Corporate Information Systems. The corporate databases provided by suppliers outside of the COMPASS contract are the Finance and Human Resources databases.The other databases in use by small numbers of HQ users are:

The National DNA Database (NDNAD) does not contain information about criminal records, as this is not necessary for its function of matching DNA from crime scenes with DNA from individuals. Criminal record information is held on the Police National Computer (PNC). The information sought could be provided only at disproportionate cost.

DNA samples taken by police forces are sent to accredited forensic suppliers for processing, to produce a profile for loading on the National DNA Database (NDNAD). On behalf of the NDNAD Strategy Board, the Custodian sets the technical and procedural standards to which the laboratories must adhere and monitors their performance against these standards. These standards are all contained within the Custodian's quality management system and shared with the laboratories. Security measures on the NDNAD itself are also managed by the Custodian.Direct access to information on the NDNAD is restricted to a limited number of designated personnel under the control of the Custodian, either directly, or under a contract awarded by the Home Office to the Forensic Science Service (FSS) for operation and maintenance of the NDNAD and development of its IT systems. Throughout the lifetime of the contract, the FSS are required to demonstrate compliance with specified security requirements.Police and law enforcement personnel do not have access to the information on the NDNAD, but receive reports from the Custodian's staff of matches between DNA taken from crime scenes and that taken from individuals.There has been one incident affecting DNA profiles which were to be loaded onto the NDNAD. This was the recent occasion when a disc containing profiles taken from crime scenes in the Netherlands was mislaid and subsequently recovered, though it never left the secure premises of the Crown Prosecution Service. The disc did not contain any personal information, as the DNA profiles were left by unknown persons at crime scenes in the Netherlands.There have been no incidents when data loaded onto the NDNAD has been lost.

[holding answer 15 December 2008]: The National DNA Database (NDNAD) functions by comparing subject profiles taken from individuals against DNA crime scene profiles retrieved from unsolved crimes. It cannot be accessed directly by the police service. The NDNAD currently generates around 3,100 matches per month. Details of matches are sent to the relevant police force, providing key intelligence on the possible identity of the offender.Information on the number of convictions in which DNA profiles from the NDNAD have been used in evidence is not collected by the Home Office, as convictions are obtained by integrated criminal investigation and not by forensic science alone.However, data have been collected since 1998 on the number of crimes detected in which a DNA match was available and/or played a part in solving the crime. It is estimated that over the period April 1998 to March 2008, there have been over 272,000 such detections.Information on the number of detections/convictions in which DNA subject sample profiles on the NDNAD taken from persons with no previous convictions have been used in evidence is not available from the NDNAD, nor is it available from police force data collected by the Home Office on forensic activity and related detections. The NDNAD holds DNA profiles taken from persons arrested for a recordable offence but does not hold data on their criminal histories; this information is held on the police national computer (PNC).

[holding answer 15 December 2008]: At 30 September 2008, there were an estimated 4,631,838 persons with a profile on the National DNA Database (NDNAD). Of these, an estimated 4,355,904 persons had been sampled by forces in England and Wales.Data on arrest and criminal histories are not held on the NDNAD, but are held on the Police National Computer (PNC). Such data are not available routinely, but the National Policing Improvement Agency obtains information periodically on the number of persons on the NDNAD who have a conviction and on the number of those who have not. This information was last obtained at the end of March 2008.On 31 March 2008, there were an estimated 4,116,713 persons on the NDNAD sampled by police forces in England and Wales, of whom 3,832,986 persons had a record retained on PNC. Of these, over 3.25 million persons had a conviction, caution, formal warning or reprimand recorded on the PNC and around 573,600 persons had no current conviction, caution, formal warning or reprimand recorded on PNC.The 573,600 figure includes some persons who may have had a caution or conviction record removed from PNC after five to 10 years in accordance with the Rules for Criminal Record Weeding (which applied prior to April 2006); persons who have been charged and acquitted or proceedings discontinued; persons who have been charged with a recordable offence and proceedings are on-going; and persons who have been arrested but no further action was taken against them.The PNC records for the other 283,727 persons had been removed from the PNC for various reasons, for example, their conviction and caution records had been weeded after five to 10 years, the person had been acquitted or proceedings were discontinued.

It has been assumed that this question refers to the written answer on 10 July 2008, Official Report, columns 1767-8W (as the Official Report for 10 September 2008 does not include a written answer at columns 1767-8W on Genetics: Databases).The written answer on 10 July 2008, Official Report, columns 1767-8W referred to research information on the number of DNA profiles taken from persons arrested, charged but not convicted of an offence that have resulted in a DNA match, providing the police with an intelligence link on the possible identity of the offender and assisting in the detection of crimes. The research information indicated that in the period May 2001 to December 2005, an estimated 200,000 DNA samples taken from people charged with offences had been retained on the NDNAD, which would previously have had to be removed because of the absence of a conviction. From these, approximately 8,500 profiles of individuals have been linked with crime scene profiles, involving nearly 14,000 offences. These offences included 114 murders, 55 attempted murders and 116 rapes.No information is available on how many of the 14,000 offences linked to DNA profiles retained since 2001 were detected and on whether an offender was brought to justice. It is understood that this information would have been too time-consuming for the researchers to collate; it would have involved requesting information on the outcomes of the 14,000 crimes from the 43 police forces in England and Wales and subsequent checks by forces of case record systems.I have asked the National Policing Improvement Agency to look into the possibility of updating the research information on the number of DNA profiles taken from persons arrested, charged but not convicted of an offence that have resulted in a DNA match, providing the police with information on the possible identity of the offender.

The Environment agency has developed and now operates a National Flood and Coastal Defence Database (NFCDD).Insurers are not provided with direct access to extract data from the NFCDD and requests for data are considered on a case by case basis.NFCDD information is used to derive the Environment Agency's national flood risk assessment and other products which are made available to insurers.

[holding answer 11 December 2008]: Accuracy surveys are completed on the vehicle record (annually) and driver record (biennially) but not on the local office casework system record database or driver and vehicle intelligence database. The reported accuracy levels are:
Full vehicles surveys were conducted in late 2003, 2005 and 2007. Figures for 2004 and 2006 are estimates based on internal measures.Surveys reporting on 2008 accuracy of both vehicles and drivers databases are currently being undertaken and are due to report early next year. Surveys are now programmed to be conducted every year.

[holding answer 11 December 2008]: People may be eliminated from inquiries by the use of the National DNA Database (NDNAD) by two different methods.The first method is by the standard operation of the NDNAD. When DNA profiles derived from traces found at crime scenes are loaded on the NDNAD they are automatically searched against the DNA profiles of all persons with a record on the NDNAD. If there is no match between the crime scene profile and the person's record the NDNAD provides no reason for the police to investigate that person. In that sense, all 4.6 million persons on the NDNAD are eliminated by every search of a crime scene profile which does not match them. If there is a match, a report is sent to the police who can carry out further investigation of this lead.The second method is by the use of intelligence led mass screens. These take place if the police may ask members of the public in a particular area to provide their DNA voluntarily. For example, all males under the age of 40 residing within five miles of a murder might be asked to provide a DNA sample to see if it matched DNA found at the crime scene. A cumulative total is kept of the number of such screens kept since the NDNAD was set up in 1995, rather than figures for particular years. Between 1995 and 31 October 2008, there have been 391 screens resulting in the elimination of 95,629 samples. DNA provided voluntarily is used only for that particular investigation and then discarded, unless the person concerned gives explicit written agreement for it to be retained permanently on the NDNAD.Records are not kept of the number of persons charged as a result of use of the NDNAD, as charging reflects integrated criminal investigation which may involve both DNA and non-DNA evidence. However, records are kept of the number of DNA matches and detections. Matches refer to crimes where there is a match between DNA found at the crime scene and the record of a person's DNA on the NDNAD. A detection means that a crime with a DNA match has been cleared up by the police. Crimes with a DNA match often also result in further detections for other offences (known as 'additional' DNA detections) as a result of further investigation linked to the original offence (in other words, the detection of one offence through a DNA match may also lead to other offences being solved e.g. because an offender on being presented with DNA evidence linking him to one offence confesses to other offences). In 2007-08 there were 37,376 matches, 17,614 detections, and a further 15,420 additional detections.

We are carefully considering how best to give effect to the recent judgment of the European Court of Human Rights, but I remind the House that in 2007-08 there were more than 37,000 crimes with a DNA match, 363 homicides and 540 rapes. We will not rush to judgment, and we will not be rushed, either.

The National DNA Database strategy board and the National Policing Improvement Agency are considering the recommendations of the ethics group annual report and will advise Ministers on the issues raised in the new year. The Government will publish their response early next year.
