There is already legislation in place to deal with the welfare of dogs in dog breeding establishments. Local authorities have powers to respond to concerns about the welfare of dogs in breeding establishments through specific legislation that regulates commercial dog breeders and through the Animal Welfare Act 2006. In addition, the independent Dog Advisory Committee is working with interested parties to improve the standards of welfare in dog breeding establishments. DEFRA is also working with the independent Pet Advertising Advisory Group to see how dogs can be advertised and sold in a responsible way.

We will be publishing our response to the consultation, together with the way forward, shortly. The Government is serious about tackling irresponsible ownership and we want to make sure that any proposals will deal with the problem effectively.

In April this year, the consultation on the Government's proposals to tackle irresponsible dog ownership was accompanied by an impact assessment on the microchipping of dogs. Within this, we estimated that the dog population in England is 6.7 million and that around 58% of these are microchipped.

DEFRA has proposed a package of measures aimed at tackling irresponsible dog ownership. We have also been working closely with the Home Office to ensure that their new measures to deal with antisocial behaviour will also include such behaviour where it involves dogs. DEFRA’s proposals were subject to recent public consultation and we are finalising the analysis of the 27,000 or so responses before making an announcement on a way forward shortly.

There are no proposals to introduce new measures governing the welfare of dogs in breeding establishments. The Government consider that the existing law on dog breeding and general animal welfare, coupled with the work of the Advisory Council on the Welfare Issues of Dog Breeding and representative bodies of the industry, provides appropriate protection for dogs in breeding establishments.
