To ask Her Majesty’s Government what regulations govern the right of police cars, ambulances and other emergency vehicles to pass though red traffic lights; and whether any special dispensation governs the liability of the driver of such vehicles if passing through a red light causes a traffic accident. [HL4136]
To ask Her Majesty’s Government what regulations govern the right of police cars, ambulances and other emergency vehicles to pass though red traffic lights; and whether any special dispensation governs the liability of the driver of such vehicles if passing through a red light causes a traffic accident. [HL4136]
In respect of signalised junctions and pedestrian crossings, respectively, regulation 36 of the Traffic Signs Regulations and General Directions 2002, and Regulations 12 and 13 of the Zebra, Pelican Puffin Pedestrian Crossings Regulations and General Directions 1997 allow police cars, ambulances and other emergency vehicles, while being driven for their intended purpose, to pass beyond red light signals, in a manner that does not cause danger to others.
The issue of driver liability in the event of an accident would be a matter for the courts to determine on a case by case basis

My Lords, as noble Lords will see on the Marshalled List, Amendment 165 would insert a new clause entitled “Duty of care”. My Lords, in moving this amendment I am gratified to see so few people in the Chamber. I drafted two amendments in this area of the Bill and found to my astonishment that the Public Bill Office had converted them into 10. The excess is not due to lowly endeavour....

To ask the right hon. Member for Banbury, representing the Church Commissioners what recent assessment he has made of the effects of chancel liability.
To ask the right hon. Member for Banbury, representing the Church Commissioners what recent assessment he has made of the effects of chancel liability.
This is a complex subject. Chancel repair liability is similar to a covenant that runs with the land and is a matter not for the Second Church Estates Commissioner and the Church of England but for the Ministry of Justice and the Land Registry as set out in the Church Repairs Act 1932 and the subsequent changes made under the Land Registration Act 2002 and Land Registration Rules 2003. I refer my hon. Friend and the whole House to the debate in Westminster Hall on 17
October 2012, Official Report, columns 130-38WH, where the Under-Secretary of State for Culture, Media and Sport, my hon. Friend the Member for Maidstone and The Weald (Mrs Grant) explained these issues very clearly.
