Government is committed to building transport networks that work for everyone, including ensuring that disabled people have the same travel choices as other members of society.
I am committed to commencing Sections 165 and 167 of the Equality Act, making it unlawful for drivers of wheelchair accessible taxis and Private Hire Vehicles to refuse to provide assistance to passengers in wheelchairs or to charge them extra.
We will shortly be consulting on Regulations regarding the exemption certificates for drivers unable to provide such assistance, and on relevant guidance. We will commence the Sections once the Regulations and guidance are ready for issue.

Government is committed to building transport networks that work for everyone, including ensuring that disabled people have the same travel choices as other members of society.
Nobody should face discrimination when accessing transport services, and it is unacceptable for any provider to charge a disabled person extra on account of their disability.
The Equality Act 2010 requires service providers to make reasonable adjustments to enable disabled people to access their services, and Sections 168 to 173 specifically prevent a taxi or Private Hire Vehicle driver from charging an assistance dog owner extra.
I have also committed to commencing Sections 165 and 167, which will require drivers to provide assistance to passengers in wheelchairs and prevent them from charging more.

To ask the Secretary of State for Justice, what recent discussions he has had with the Sentencing Council on the offence of refusing carriage to an assistance dog.
It is an offence under section 168 of the Equalities Act 2010 to refuse to take an assistance dog in a taxi or private hire vehicle. The maximum penalty is up to £1,000. Sentencing is a matter for the independent courts. There is no evidence that courts are finding their sentencing powers insufficient. The Sentencing Council considers the case for guidelines on the basis of a number of factors, including where data suggests there may be inconsistency in sentencing.

The Department for Transport does not hold details of the checks that individual local licensing authorities undertake on taxi and private hire vehicle drivers.
All taxi and private hire vehicle drivers can be subject to an enhanced criminal record check, which includes a check of the children’s and adults barred lists, through the Disclosure and Barring Service (DBS). In the Department’s Best Practice Guidance for taxi and private hire vehicle licensing and through engagement with licensing authorities, we strongly encourage licensing authorities to carry out an enhanced DBS check on all applicants.
