As outlined in the National Cyber Security Strategy, the Government is undertaking an extensive cyber security skills programme to ensure the UK has a self-sustaining pipeline of talent providing the skills the economy needs. As part of this programme, we have ensured all Further Education digital courses have a mandatory cyber security component, while Computing Science degrees accredited by the British Computer Society must now include comprehensive teaching on cyber security and have generated some material to support this. This is helping to ensure the current and future generation of IT graduates and professionals have the skills needed for secure programming when developing web-based products.
As part of our cyber skills programme, we are also undertaking extensive work in schools, with apprentices and helping non-cyber professionals, ensuring the UK workforce continues to have the skills needed to keep the digital economy secure. In addition, the Government works closely with industry to promote the need for good cyber security practices. The National Cyber Security Strategy makes it clear we are building a secure Internet and sets out an objective for “the majority of online products and services coming into use [to] become ‘secure by default’ by 2021.

The Government’s Road Safety Statement published in December 2015 committed to increase the fixed penalty notice for using a mobile phone when driving. A public consultation closed in March 2016 and the response published 8 November 2016. Legislation to increase the fixed penalty notice to 6 points (from 3 points) was laid before Parliament on 8 November. The fixed penalty fine will increase to £200 (from £100). The new rules are expected to come in in spring 2017 accompanied by a THINK! Campaign to alert drivers to the new rules and raise awareness of the danger of using a mobile when driving.
Specifically regarding drive safe modes on mobile phones, no government research has been commissioned but we are aware of the RAC Foundation report published in August. It explored how drive safe modes were being considered as part of product design for both vehicles and devices. The government will shortly be meeting with the mobile phone providers and manufacturers to consider drive safe modes, or other practical applications, when a person is driving.

The Government has been working with the police and the motor industry to develop a clear and common understanding of the changing nature of vehicle theft, including through the compromise of modern electronic security systems. This has helped us to form a clearer and shared understanding with the police and industry of the methods used and what can be done to tackle these crimes, including through security improvements by manufacturers, targeted enforcement action by the police and changes in the way that consumers protect their vehicles.

The Government's Open Standards Principles are helping to level the playing field for open source and proprietary software, and disaggregating government IT into smaller, more manageable components.
The Government IT Strategy states ‘Where appropriate, government will procure open source solutions. When used in conjunction with compulsory open standards, open source presents significant opportunities for the design and delivery of interoperable solutions.’
To support interoperability in the public sector, we have a preference for royalty-free software generated in an open and transparent manner, which is often open source.

The Department has worked with industry and security experts, including GCHQ, to design a smart metering system that has robust security controls in place. System security is based on international standards. It includes encryption of sensitive data, protection from viruses and malware, access control, two-party authorisation of important messages to the meters and system monitoring.

Under the Consumer Rights Act 2015 software must be of satisfactory quality, which includes durability for a period a consumer can reasonably expect. If it is not, the consumer may be entitled to a remedy under the Act, for example, a repair or replacement of the software or, if this is not possible, the right to demand some money back. The Government has no plans to require the release of the source code of unsupported software to a third party.

All users, including Members, agree to abide by Parliament’s Acceptable Use Policy every time they log on to the Parliamentary Network. This policy makes clear that the Parliamentary Digital Service provides systems to protect Parliamentary users (and the network) from malicious attack.
The Messagelabs service is an important part of the infrastructure protecting Members and the wider Parliamentary Network against malicious attack. It is a fully automated scanning service which scans for and blocks emails that are potential vectors for cyber-attack. It also scans for and quarantines emails that are suspected spam, again using fully automated systems. It does not involve any other form of monitoring of the content of parliamentary email.

The UK is part of a collaborative partnership on F-35 and therefore pays a shared contribution to the development of capability beyond the Block 3F capability. The cost of this activity, although provisionally estimated, has yet to be finalised with industry and is the subject of on-going discussion with the eight Partner Nations. As these costs will be the subject of commercial negotiations over the coming year, they cannot be made public at this time.

The Sentencing Council has launched a new fines calculator, which is freely available on its website to assist magistrates when imposing fines. This takes account of the changes to the surcharge introduced on 8 April and enables calculations for multiple fines and rounding where appropriate. The calculator is a tool to assist sentencers and is not intended to replace the role of the court in determining the appropriate sentence in line with any relevant sentencing guidelines. Courts can only depart from sentencing guidelines if it is in the interests of justice to do so.

Electrical and electronic equipment in the Waste Electrical and Electronic Equipment Directive is defined as that “which is dependent on electric currents or electromagnetic fields in order to work properly" and "equipment for the generation, transfer and measurement of such currents and fields” below specified voltages.
Whilst the Directive does provide for certain exclusions, the Government believes that the definition is already sufficiently broad to embrace technological change and computer hardware that incorporates browsers and operating systems.

The UK’s Vehicle Certification Agency issued the type approval for some Volkswagen Group vehicles. For these the agency is working with the manufacturer to review and approve the proposed fixes. They are carrying out tests to ensure that after the fix is applied the vehicles meet all the legal requirements including emissions, and that other vehicle characteristics are unchanged, including power output, fuel consumption and engine noise.

The Government has committed to ensuring free software is available for those with the simplest affairs in order that businesses can meet the requirements of Making Tax Digital. In addition, many businesses are already using digital record-keeping tools to deal with their tax affairs.
The Government has received a number of representations from individuals, businesses, professional bodies and the software industry about Making Tax Digital. Both I and officials from HM Treasury and HM Revenue and Customs have discussed the reforms with a wide range of professional bodies and advisory groups representing small businesses and the self-employed. Extensive consultation will take place throughout 2016.
