At the end of each tax year HMRC reconciles the PAYE accounts of individual customers who are outside Self-Assessment. This exercise is called End of Year Reconciliation. Information used includes the final pay and tax deductions for the year as reported by employers, alongside taxable benefits and any additional income/benefits supplied by the individual customer. In addition, HMRC carries out assurance checks to ensure that the calculation is correct. Some re-calculations may be necessary if the position has changed, for example, due to further changes to income, expenses claims, or benefits.

My hon. Friend makes a very good point. One of the areas of good news about universal credit is the fact that it will enable us to reduce fraud by over £1 billion. That in itself is an important step, and there are of course many other very positive reasons why universal credit is a good thing.

The Department estimates that around 270,000 cases need to be looked at again and that around 75,000 of those cases (5% of the population transferred over from incapacity benefits) may have been underpaid. The Department has already started contacting individuals to establish if there has been an underpayment of premiums and a small number of claims have already been corrected and the arrears that are due have been paid. The Department expects to complete the review and correct cases by April 2019. We will update the House shortly.

To ask the Secretary of State for Work and Pensions, what recent estimate his Department has made of the number of incorrectly filled out personal independence payment applications by assessors in Wales.
To ask the Secretary of State for Work and Pensions, what recent estimate his Department has made of the number of incorrectly filled out personal independence payment applications by assessors in Wales.
Assessors do not fill out Personal Independent Payment applications therefore we are interpreting this to mean incorrectly filled out Personal Independent Payment assessment reports.
The Department has set standards for the quality of assessments that both Personal Independence Payment providers must meet, which the Department monitors. The standards require assessment providers to provide the Department’s Case Managers with an assessment that is clear and medically reasonable. We are continually working with the assessment providers to further improve the quality of assessments including clinical coaching, feedback and support available to each assessor.
To ask the Secretary of State for Health, what steps he is taking to reduce the incidents of official error leading to overpayment by the NHS Pension Scheme.
To ask the Secretary of State for Health, what steps he is taking to reduce the incidents of official error leading to overpayment by the NHS Pension Scheme.
The National Health Service Pension Scheme is administered by the NHS Business Services Authority. The Authority is improving its quality assurance processes and investing in additional staff training to reduce the risk of errors leading to overpayments by the National Health Service Pension Scheme.
Progress in their quality assurance process improvements is overseen by the NHS Pension Board, a statutory board set up under the Public Service Pensions Act 2013 and responsible for overseeing scheme governance and administration, by the Department through Service Level Agreement reviews with the Authority and by the Pension Regulator through its annual survey of pension scheme governance.
To ask the Secretary of State for Health, what steps he is taking to ensure that there is adequate accountability for errors made within the NHS Pension Scheme.
To ask the Secretary of State for Health, what steps he is taking to ensure that there is adequate accountability for errors made within the NHS Pension Scheme.
The NHS Pension Board, a statutory board established by the Public Service Pensions Act 2013 and reporting to Secretary of State for Health, works with the Pensions Regulator to ensure adequate accountability for errors made within the National Health Service Pension Scheme by monitoring the performance of the scheme administrator, the NHS Business Services Authority.
Through regular liaison and referrals, the NHS Pension Board and the Pension Regulator assess compliance by the scheme administrator with the Pension Regulator’s codes of conduct and relevant pension law.
To ask the Secretary of State for Health, under what circumstances the NHS Pension Scheme would write off an overpayment due to official error.
To ask the Secretary of State for Health, under what circumstances the NHS Pension Scheme would write off an overpayment due to official error.
The NHS Business Services Authority administers the National Health Service Pension Scheme. As a public body it is required to act in accordance with the document Managing Public Money, issued by Her Majesty’s Treasury, when considering writing off an overpayment due to official error. A copy is available at:
https://www.gov.uk/government/publications/managing-public-money
Paragraph A4.11.2 states, ‘In principle public sector organisations should always pursue recovery of overpayments, irrespective of how they came to be made. In practice, however, there will be both practical and legal limits to how cases should be handled. So each case should be dealt with on its merits’. In doing so, the NHS Business Services Authority would take into account the following factors:
- The nature and complexity of the overpayment;
- The value of the overpayment;
- The length of time since the overpayment was made to ensure the Limitations Act is considered;
- Whether there is a case of that the legal defences of change of position or Estoppel could be reasonably relied upon; and
- The potential hardship caused by reclaiming the overpayment, and the ability of the individual to repay.
Therefore the NHS Business Services Authority would consider writing off an overpayment where, having assessed the above factors and taken legal advice, there may be sufficient grounds not to pursue further.
