Any compulsorily transferred staff would have their pay, terms and conditions protected under Transfer of Undertakings Protection of Employment legislation and have continued access to the NHS Pension Scheme under the Government’s New Fair Deal guidance.

Making available independent advice would be a matter for their employer to consider.
Any staff considering changes to their pay and pensions arrangements should be encouraged by their employer to take independent advice from an approved provider. The NHS Business Services Authority which administers the NHS Pension Scheme provides a range of information about the NHS Pension Scheme which could be used to help inform any independent advice.
The Secretary of State will be aware of the crisis engulfing members of the British Steel pension scheme, with advisers cashing in by persuading them to sink their pensions into all manner of dodgy, high-cost schemes, and he will be aware of the Financial Conduct Authority’s apparent failure to deal with the situation effectively. He will know that today the negotiations on the future of the universities superannuation scheme are coming to a head, with the threat of industrial action—something that should be interesting the Government. I am surprised that he is simply sitting back and leaving these matters to those who are directly involved. Surely, he can tell us today how he is going to get involved and take action to protect members of both schemes.

The Department, NHS Business Services Authority (NHSBSA) which administers the NHS Pension Scheme (NHSPS) on behalf of the Secretary of State and National Health Service employers are not authorised to provide advice to staff on the merits of the NHS Superannuation Scheme. However, the NHSBSA provides comprehensive online only information to members, potential members, and employers about the NHSPS covering the following:
- Joining the Scheme;
- Membership of the NHS Pension Scheme;
- Cost of being in the Scheme;
- Transferring into the Scheme;
- Increasing your pension;
- Getting an estimate of your pension;
- Family and your pension;
- Applying for your pension;
- Leaving or taking a break from the Scheme;
- Divorce or dissolution of a civil partnership and your pension;
- Annual Allowance;
- Lifetime Allowance; and
- Information for Practitioner, locum and non-general practitioner members.
In addition, the NHSBSA provides scheme members with an annual total reward statement, which outlines their pension savings to date.

The UK will contribute its share of the financing of the Union’s liabilities incurred before 31 December 2020, including pensions, as they fall due.
The current liability associated with pensions is given in the Annual Accounts of the European Union 2016. As the Joint Report states, this liability has a long time-span and the forecast of its net present value depends on a number of assumptions and is sensitive to, in particular, the real discount rate, which has a historically low value at the time of drafting of the report.

Ministers and officials of the Department regularly meet with representatives from the pensions industry and will continue to do so ahead of the introduction of the new single financial guidance body and development of the pensions dashboard. The Single Financial Guidance Body aims to simplify the existing public financial guidance landscape, including pensions guidance, and will provide even more opportunities to support people to make better informed decisions about their pension. The Department is committed to ensuring that there is adequate provision of high quality information and guidance for those preparing to access their pension.
