Recognising the challenging economic backdrop environment, we continue to work with local areas to find practical solutions to project delivery issues. We are working with projects to make sensible adjustments to the scope and phasing of their Levelling Up Fund (LUF) projects where necessary to mitigate delivery challenges whilst maintaining value for money. To date the Levelling Up Fund has received 61 project adjustment requests – 37 have been approved, 1 has been rejected, 16 were withdrawn, and a further 7 are currently being considered.

In the last two years the Flood Recovery Framework has been activated twice – following Storm Babet in October 2023 and Storm Henk in January 2024. The decision to accept or reject applications for flood recovery funding is made by local authorities who are responsible for administrating all schemes, apart from the Farming Recovery Fund. To date, eligible local authorities have made payments of over £7.8 million to 8,510 impacted households and businesses. We expect this figure to rise substantially as further payments are made over the next 18 months.
With regards to the specific question on the £25,000 available under the Farming Recovery Fund scheme. DEFRA have only opened this once within the last two years on 9 April 2024 to provide farmers support to recover from uninsurable damage. The scheme provides grants of between £500 and £25,000 to return land to the condition it was before exceptional flooding of Storm Henk. The fund was initially opened in nine English local authority areas, however, DEFRA committed actively to review the areas to be included in the fund. Those farmers who were initially identified as eligible farmers have been contacted directly by Rural Payments Agency. DEFRA will be contacting all eligible farmers following completion of our review.

Local authorities are responsible for delivering the scheme in line with the guidance provided by Department for Business and Trade as administrators of the Business Recovery Grant (BRG) scheme.

If an Applicant changes managing agent, they will need to assure the department and its delivery partners that funds already paid are properly accounted for and (if applicable) transferred to the service charge account of the new managing agent. Subject to appropriate diligence checks, future payments can be made into the new managing agent’s account.
In the event of the resignation of the company secretary, Gallions Approach Management Ltd will remain the entity responsible for the project and the Building Safety Fund (BSF) application, and subject to the entity’s obligations under the Grant Funding Agreement and any other relevant contracts. There is no need to submit a new application to the BSF.
The department has entered into a Grant Funding Agreement with Gallions Approach Management Ltd. Their corporate governance is primarily a matter for the Applicant. The Applicant may wish to seek independent legal advice.

We are working closely with the Ministry of Justice and the First-tier Tribunal so the courts and tribunals are fully prepared for the changes introduced by the Renters (Reform) Bill on the justice system.

The application to the Building Safety Fund for Drift Court, Beckton, Newham has been assessed as eligible for funding and a grant funding agreement was completed on 12 January 2023. Work to remediate unsafe cladding on the building has commenced and is expected to complete in July 2024.
A change of directors at Gallions Approach Limited will not affect the application to the Building Safety Fund as the grant funding agreement remains legally extant.
We recommend any new directors of an organisation that has applied to the Building Safety Fund seek to familiarise themselves with their application, in recognition of their legal duty, as directors of the Responsible Entity, to make their building safe.
