To ask His Majesty's Government how many prisoners in England and Wales received "two-strike" sentences between 21 March 1997 and 4 April 2005; and how many of that number have (1) never been released, or (2) been recalled to prison following release.
To ask His Majesty's Government how many prisoners in England and Wales received "two-strike" sentences between 21 March 1997 and 4 April 2005; and how many of that number have (1) never been released, or (2) been recalled to prison following release.
Data on individuals serving specifically “two strike” life sentences is not readily available from within centrally collated statistical data. As a result, to identify from the life sentence population those serving “two strike” life sentences, and of those, the individuals who have subsequently been recalled following release, would only be possible at disproportionate cost.
My Lords, I am grateful to all noble Lords who have spoken in this group. I have listened carefully, especially to the Minister, and I am disappointed that he has not accepted my Amendment 52. The purposes of sentencing do not go far enough and bringing clarity to what prison...

My Lords, I am bringing back this amendment on Report as I do not think it was adequately addressed in Committee. Amendment 52, in my name and that of the noble Lord, Lord Moylan, would define in law the purposes of imprisonment and require the courts and the Secretary of...

My Lords, I will make a few brief comments; I am aware of time, and there is a lot to get through. I wholeheartedly agree with the remarks made by the noble Lord, Lord Marks, and I thank him for his kind comments.

My Lords, I declare an interest as Anglican bishop to His Majesty’s prisons in England and Wales. I, too, pay tribute to the late Baroness Newlove, not least in her role as Victims’ Commissioner. I want to echo so much of what the noble Lord, Lord Beith, and the noble...

My Lords, like other noble Lords, I have already registered my feelings about the Bill at Second Reading and in Committee. Now that we have had the publication of the Independent Sentencing Review and the Government’s response, I reiterate the point that, like others, I simply do not believe that...

I am minded not to move this, given what we have seen already, but I did just want to say to the Minister that there has been real confusion here, and I am really disappointed that this is undermining something that is already in existence. The Minister said the pre-sentencing...

My Lords, I will not repeat the arguments I made at Second Reading. However, as other noble Lords have said, I still do not believe that we need this Bill—and even less so, as the noble Lord, Lord Marks, said, given that the independent sentencing review will be published imminently....

I appreciate that the Minister is in an interminable situation, but he did not actually respond to my key point, which is that there is an existing protection including the current mitigating factor for pregnancy. I drew attention to what was published in April last year, which already directs sentencers...

My Lords, taking into account what has been said already, I welcome the enactment of the provisions in the Victims and Prisoners Act, passed by the last Government, allowing termination of licence conditions for IPP prisoners. However, there are huge legal complexities involved, so I wonder what steps the Government are taking to
ensure that those eligible to terminate their licence conditions actually understand their rights and are able to exercise them.

I thank the right reverend Prelate for her question, and I agree with her. I have met IPP prisoners, both in prison and in the community, who are not fully aware of the situation they are in and what they need to do from here, so she raises a good challenge to me and my colleagues in the Ministry of Justice, which I will take away and reflect on and get back to her.

My Lords, I congratulate the noble Lord, Lord Timpson, on his superb maiden speech, and I refer to my interest as stated in the register as Anglican bishop for prisons.
The gracious Speech began with the principles of
“security, fairness and opportunity for all”.
What does that mean for our criminal justice system?...

My Lords, I fully support the amendment. Sometimes I feel a bit as if I am in “Groundhog Day” as we listen to things that are said again and again. When we first discussed the Bill in this House, many people far more learned than me commented on all the...

My Lords, I agree with much of what has been said. On Amendment 82A I reiterate what has been said, and I hope will be said later, about primary carers. We know the damage short sentences do to families. We also know that close to half of those leaving custody...
