Ms Atherton: To ask the Secretary of State for Environment, Food and Rural Affairs what surveys she has undertaken to investigate radon in homes in Cornwall; and what those surveys have concluded. [179462] Mr. Morley :[holding answer 18 June 2004]: Since 1987 successive Governments have run radon measurement programmes to identify the extent of the radon problem in the UK. Initially, these focused on areas of England such as Cornwall, Devon and Somerset where dwellings were most likely to be at risk from the naturally occurring radioactive gas. By 1998, every home in England with a greater than 5 per cent. probability of radon levels being at or above the National Radiological Protection Board's (NRPB) recommended radon `Action Level' (200 becquerels per cubic metre of air--Bq m-3) had been offered a free radon test. In accordance with NRPB's recommendation, we advise that remedial action is taken to reduce radon levels in any home at or above the Action Level. The measurement campaigns have revealed and confirmed that Cornwall is an area that is significantly affected by radon. Data published in the NRPB's "Radon Atlas of England and Wales" (NRPB-W26) in December 2002 showed that 97 per cent. of dwellings in Cornwall are likely to be in radon-affect areas. Of the 220,500 homes in the county, some 67,640 had been measured, mostly from Government-funded tests. Nearly 16,000 homes had been found to have radon concentrations at or above the Action Level. At that time, the highest level recorded in the UK of 10,000 Bq m-3 had been found in the district of Kerrier. It is estimated that up to 41,000 dwellings in Cornwall may have radon levels exceeding the Action Level. Defra's latest programme continues to offer free radon measurements to the most at risk households in England. However, the initiative places greater emphasis on helping home owners to take action to reduce radon levels in their homes. This is being achieved in partnership with 27 local authorities who joined the initiative when it commenced in July 2000. In Cornwall, we started work with Kerrier district council at the end of 2003 to roll out a programme of action designed to raise awareness and promote radon remediation in the community. This has included over 31,000 invitations sent to householders offering free tests and retests (upon completion of satisfactory remedial work); and workshops providing information and advice on remediation for those householders recommended to take action to reduce radon levels in their homes. Over 11,000 householders have accepted the offer and to date results from around 4,000 measurements are available. Some of the results reveal particularly high radon levels, and measurements taken in three dwellings are well above the previously highest recorded level of 10,000 Bq m-3. Kerrier district council, together with NRPB and the Building Research Establishment (BRE), are providing the support to the occupants of these dwellings that is available under Defra's programme, to enable prompt remedial action to be taken to reduce the risk to their health.

Andrew George: To ask the Secretary of State for Environment, Food and Rural Affairs (1) what efforts her Department has made to ensure that EU accession states have the required technical capacity and advice to ensure their compliance with (a) testing, (b) labelling and (c) traceability of GM crops and foods under EU regulations; [167418] (2) what discussions she has had with (a) the EC and (b) her counterparts in the 10 EU accession states to seek a timetable for the compliance of the accession states with regulations (EC) 1829/2003 and (EC) 1830/ 2003 on the labelling and traceability of genetically modified crops; [167419] (3) what efforts her Department is making to ensure that (a) EU member states and (b) EU accession states comply with EU rules on genetically modified crops, including regulations (i) (EC) No.1829/2003 and (ii) (EC) No.1830/2003 under directive 2001/18/EC on traceability and labelling. [167420] Mr. Morley: Directive 2001/18 on the deliberate release into the environment of Genetically Modified Organisms (GMOs) is part of the aquis communautaire for the new member states. New Regulations on traceability and labelling of GMOs (Regulation (EC) 1830/2003) and GM food and feed (Regulation (EC) 1829/2003) are not formally included in the "aquis communautaire" for accession states as negotiations were closed in December 2002. However, the regulations will apply in new member states from 1 May 2004, and new member states will be required to have appropriate legislative frameworks in place. The new Regulations took effect in existing member states from 18 April 2004. All these Regulations require member states to introduce a proportionate and effective hierarchy of offences and penalties related to the potential seriousness of the failure to comply with the various EU requirements. The Commission is required to produce Community- wide guidance in relation to the new Regulations, including guidance on sampling and testing, to ensure a co-ordinated approach between member states. Work on this is still under way. The Secretary of State has not explicitly discussed the application of these Regulations with current or accession member states. However, officials from my Department and the Food Standards Agency continue to liaise with their counterparts in other member states through Regulatory and Standing Committees and informal contacts.

[159893] Mr. Morley: [holding answer 11 March 2004]: Since 1987 successive Governments have run a radon measurement programme to identify the extent of the radon problem in the UK. During that time 450 thousand of the 25 million UK homes have been tested. Over the last eight years Government-funded measurement programmes have mainly focused on homes likely to be at most risk. In England and Northern Ireland, for example, that has meant every home with a greater than 5 per cent. probability of radon levels being at or above the National Radiological Protection Board's (NRPB) recommended radon "Action Level" (200 becquerels per cubic metre of air) has been offered a free radon test. In accordance with NRPB's recommendation, we advise that remedial action is taken to reduce radon levels in any home at or above the Action Level. It is estimated that over 100,000 homes in the UK are likely to be at or above the Action Level and, of those, around 43,000 have been found. Approximately 90 per cent. of the homes above the Action Level are likely to be in England. The following table sets out the number of homes tested by NRPB for radon gas in the UK since 1996 up to the present date. The figures from 1998 onwards include radon tests that have been offered to householders as part of pilot studies and a wider on- going programme where the Government are working in partnership with nearly 30 local authorities in England to help householders in radon-affected areas to take action to cut levels of radon in their homes. This supports the Government's policy of encouraging more radon remediation amongst householders in order to reduce the risk that high radon levels pose to their health. The pilot studies run between 1998 and 2000 showed that working at a local level worked well and could double the amount of radon remediation. This success led to the rolling out of the current programme based on the experiences and lessons learned from the pilot studies. We shall be reviewing the initiative before it ends in March 2005 to allow us to determine how successful it has been. We will then make a judgment on the future direction of the Government's radon programme. In Northern Ireland, the Department of the Environment is continuing to make free radon tests available to householders in areas where radon concentrations in homes have a 1 per cent. or greater probability of being at or above the Action Level. In addition, radon awareness campaigns will be conducted in selected areas of Northern Ireland in partnership with local authorities. These will target areas where there is a greater than 10 per cent. probability of radon levels in a home exceeding the Action Level. Plans to encourage the testing of dwellings for radon in Scotland and Wales rest with the Scottish Executive and National Assembly for Wales respectively. _________________________________________________________________________________________________. Tom Brake: To ask the Secretary of State for Environment, Food and Rural Affairs what percentage of companies producing tap water are tested by the Drinking Water Inspectorate; what the frequency of testing is; how many companies producing tap water have failed these tests in each of the last six years; and what the safe limits are used by the Drinking Water Inspectorate for (a) minerals and (b) other trace elements found in tap water. [126625] Mr. Morley: The role of the DWI is to audit all the statutory water companies in England and Wales. The companies are required to undertake sampling and analysis of public water supplies in accordance with the Water Supply (Water Quality) Regulations 1989 and subsequent amendments. These Regulations set out the frequency of monitoring, the locations where the samples have to be taken and the standards that have to be met. The regulatory standards incorporate those set out in the EC Directive on the quality of water intended for human consumption (80/778/EEC), which in turn are based on the World Health Organisation guideline values for drinking water quality. There are currently 26 water companies. In the last six years water companies have only experienced occasional failures of a standard. The level of compliance for all water companies rose from 99.75 per cent. in 1997 to 99.87% in 2002. The WHO guideline values for various constituents of drinking water, including certain minerals, represent the concentration of a constituent that does not result in any significant risk to consumers' health, usually over a lifetime of consumption.

Andrew George: To ask the Secretary of State for Environment, Food and Rural Affairs how many beef carcases from Brazil were tested for disease in each of the last 10 years, broken down by type of disease; and what proportion were found to pose a health risk. [116856] Mr. Morley: There are no provisions for beef imported from Brazil or any other approved countries to be routinely tested for disease. Other controls are designed to prevent serious exotic diseases entering the country via imported meat. All meat imported from third countries must be accompanied by official veterinary certification. This must confirm that the meat is derived from animals which have been subjected to a veterinary inspection during the 24 hours prior to slaughter and showed no signs of diseases. Meat from Brazil must have been matured and tested to confirm that it has reached a sufficiently low pH (acidity) and then de-boned so as to remove any risk of the FMD virus being present. Whole carcase meat and bone-in cuts are not permitted. European Community law requires that all meat imported into the UK from third countries must enter at designated Border Inspection Posts (BIPs) where it is subject to veterinary inspections. All consignments are subject to documentary and identity checks and at least 20 per cent. of consignments undergo physical checks, which may include taking a sample for testing. It is the responsibility of the Official Veterinary Surgeon to decide what type of test might be carried out. These checks ensure import conditions are met and that the products remain in a satisfactory condition during transport.

Mr. Luff: To ask the Secretary of State for Environment, Food and Rural Affairs (1) if she will place in the Library copies of the licences her Department has issued for traps to catch and kill wild mammals that are in force; [110750] (2) if she will publish performance data on each trap for catching and killing wild mammals that has been tested and licensed by her Department; [110752] (3) what assessment she has made of the compatibility of the standards applied by her Department and its predecessor to traps for catching and killing wild mammals as licensed by her Department with the International Trapping Standards; and if she will make a statement; [110751] (4) whether she has assessed the compliance of traps used to catch and kill wild mammals for which a license is not necessary with (a) the criteria her Department applies to licensed traps and (b) the International Trapping Standards; [110749] (5) when her Department most recently carried out tests on traps used to catch and kill wild mammals licensed by her Department; what the purpose of such tests were; where the tests were conducted; what criteria were applied in assessing the results of these tests; and if she will place in the Library details of the conduct of these tests. [110753] Mr. Morley: All traps must be submitted for approval and are tested for humaneness and efficacy by experts. Traps are approved by Orders made under The Pests Act 1954 which specify the traps that may be used, the manner of use and the species against which the trap may be used. The conditions of any approval are designed to ensure humane and selective operation. The use of unapproved spring traps has been prohibited in England and Wales since 1958. Spring traps specified by the Department as being adapted solely for the destruction of rats, mice or other small ground vermin, and for moles are exempted under the Small Ground Vermin Trap Order 1958. Particulars of the approvals given for traps to catch and kill wild mammals are detailed in the Spring Traps Approval Order. This is submitted to Parliament on a periodic basis, depending on the submission of traps, and lists all traps, manufacturers and terms of approved use at that time. Some further minor changes to this list (such as changes to a manufacturers trading details) were published by way of a MAFF press release dated February 1997. The performance of design is commercially confidential. Non disclosure of such commercial information is in accordance with Reg. 4(2)(e) of the Environmental Information Regulations. The Agreement on International Humane Trapping Standards: http://www3.oup.co.uk/envlaw/ hdb/Volume 12/Issue 03/supp data/harrop supp.pdf has been agreed by the European Commission, Canada and the Russian Federation but has yet to be enacted by the member states of the EU. As presently proposed, this agreement only applies to fur-bearing species. The only species currently listed in this agreement that occur in Britain are the otter, badger, pine marten and stoat, although additional species will be added in future. These species receive protection under The Badger Act 1992 and The Wildlife and Countryside Act 1981 and, with the exception of the stoat, may not be trapped without a licence. The current testing procedures proposed within Annex 1 of the Agreement have been carried out on new traps since 1992. However, as this agreement has not yet been enacted, approval of such traps has been made on the basis that they are, at least, as humane as traps already approved for the same target species. This is only an interim arrangement. The Department will shortly attend an expert working group meeting on the implementation of humane trapping standards in the EU. This will offer an opportunity to discuss how the agreement might best be enacted and implemented in the UK. The enactment of the Agreement would require traps approved using earlier criteria to be retested and reapproved as appropriate. Trap testing is conducted on a regular and ongoing basis as new trap designs are submitted for approvals by commercial companies. I am not prepared to discuss details in view of security considerations.

A confirmed TB incident is one in which (i) visible lesions are found in at least one of the slaughtered animals at post- mortem examination, and/or (ii) Mycobacterium bovis is cultured from the tissue samples of at least one reactor animal. Separate data on the two categories can be provided only at disproportionate cost.
