That this House is concerned that the latest Statement of Changes in Immigration Rules, HC 556, which will prevent overseas care workers from bringing their dependants to the UK and makes substantial changes to the Ukraine schemes, will have a negative impact on migrant families; notes in particular that the changes will likely force carers into acquiescing to exploitative conditions at work or plunge them into destitution; recognises the importance of family members to carers often carrying out low-paid but crucial work in the UK’s social care sector; further notes with concern the lack of opportunity for the abrupt changes to the Ukraine schemes to have been scrutinised properly within the usual 21-day period before implementation; further recognises the stress and harm that the changes will cause by separating Ukrainian families, particularly where one or more family members are left behind in Ukraine; also notes the harm that will be caused by no longer permitting Ukrainian nationals to sponsor family members under the Homes for Ukraine scheme; and calls on the Home Office to properly tackle migrant worker exploitation and urgently reconsider its changes to the Ukraine schemes.

The Home Office does not publish data concerning farm visits under the seasonal workers scheme.
The Seasonal Worker team undertakes farm visits to check sponsor compliance by interviewing farm managers, checking worker accommodation and speaking to sponsored seasonal workers.
If evidence of underpayment is identified, that is investigated in line with published Sponsor Guidance and action taken if necessary. UKVI do not compensate sponsored workers for loss of earnings.
Anonymity is offered to workers speaking to our officers; workers are also able to report concerns via the online reporting tool. Full details of how to report information to the Home Office are available at: www.gov.uk/reportimmigration-crime
Allegations of abuse should also be reported to the Gangmasters Labour Abuse Authority. Details of how to do this are available on the GLAA website, at: www.gla.gov.uk/report-issues/english-report-form/

That this House notes the recent report by the Bureau of Investigative Journalism and the Independent which identified issues of racism, wage theft and threats of being sent back home in 19 farm inspection reports produced by the Home Office between 2021 and 2022; recognises that migrant seasonal workers are integral to the UK’s horticultural sector and that working conditions under the seasonal worker visa must urgently be improved; further recognises that the current iteration of the seasonal worker visa is due to expire at the end of 2024 and that improvements to working conditions must be implemented before any decision to extend the scheme is made; calls on the Government to urgently complete and publish a review of the seasonal worker visa scheme in line with the recommendations that it accepted by the Independent Chief Inspector of Borders and Immigration in the report entitled An inspection of the immigration system as it relates to the agricultural sector, published in December 2022; further calls on the Government to implement the recommendations on the seasonal worker visa scheme of the report by the House of Lords Select Committee on Horticulture entitled Sowing the seeds: A blooming English horticultural sector (November 2023); and calls on the Government to engage with independent civil society organisations advocating for the rights of migrant seasonal workers in the recently formed Seasonal Worker Interest Group to address the design-related issues from the seasonal workers visa scheme.

There is no legal requirement for labour abuse authorities, agencies, or inspectorates, to share information with Immigration Enforcement in relation to the personal data or immigration status of workers. Referrals may be made to Immigration Enforcement via the ‘Report Immigration Crime’ tool on gov.uk, or in the format of an intelligence report. These referrals may include personal data which could relate to immigration offenders.

We cannot publish any numbers with regards to the Seasonal Workers visa route which are outside of official approved Home Office published statistics. Details of the numbers of visas granted for seasonal workers, through the Seasonal Worker visa route, have been published in the usual way via the Home Office’s quarterly immigration statistics.

The Gangmasters and Labour Abuse Authority (GLAA) does not routinely inspect farms employing people with Seasonal Workers Scheme visas, as the workers are employed directly by the farms or growers.
The GLAA does not hold site specific data in a format that can be extracted from their systems and will not only visit agricultural settings, but also food processing and shellfish gathering sites. Where an EEA citizen has reasonable grounds for missing the EUSS application deadline, they will be given an opportunity to make a late application.
Any EEA citizen encountered by Immigration Enforcement after 30 June 2021, who may be eligible to apply to the EUSS, will be issued with a notice which provides a further 28 days for the individual to submit their application. Further information will be provided to employers shortly about what they should do if they have an employee who finds themself in this situation.
