To ask the Secretary of State for Communities and Local Government, what assessment he has made of the potential risk of legal proceedings against his Department as a result of non-implementation of EU Directive 41/2003 on Institutions for Occupational Retirement Provision.
I am satisfied that the potential risk of successful legal proceedings against the Department in relation to implementation of EU Directive 41/2003 is low, because it has been properly implemented in respect of the local government pension scheme.
To ask the Secretary of State for the Home Department, what recent representations she has received on disparities between the level of pensions paid to the widows of police officers in Northern Ireland and the rest of the UK; and if she will make a statement.
To ask the Secretary of State for the Home Department, what recent representations she has received on disparities between the level of pensions paid to the widows of police officers in Northern Ireland and the rest of the UK; and if she will make a statement.
The Home Secretary received representations under the last Government setting out a compelling case on behalf of widows and widowers of police officers about their pension entitlement. In the Budget on 18 March, the Chancellor announced that widows, widowers and surviving civil partners of police officers who have died on duty in England and Wales will no longer lose their survivors’ benefits in future if they remarry, form a civil partnership or cohabit. The Home Office will consult the Police Advisory Board for England and Wales (PABEW) shortly on proposals to implement this change. As policing is a devolved matter in Northern Ireland and Scotland, the Northern Ireland Executive and Scottish Government respectively are responsible for the design and funding of police pensions in those parts of the United Kingdom.

To ask the Secretary of State for the Home Department, what the implications for her Department's policies are of the decision of the Pension Ombudsman in the case of Mr Milne on 15 May 2015; and if she will make a statement on that ruling.
The Government accepts the Ombudsman's determination in full and recognises that there are other individuals, including retired police officers, who are affected by the principles set out in this determination. The Government is working with pension administrators to identify affected individuals and ensure that the appropriate payments are made as quickly as possible.

There are no direct implications for civil servants employed in DECC as staff are members of the Principal Civil Service Pensions Scheme or for the pension arrangements for staff employed in DECC’s Arm’s Length Bodies.

My Department will be working with representative bodies and the employers in the fitness working group facilitated by the Chief Fire and Rescue Adviser to provide good practice on the application of the firefighter fitness principles now incorporated into the Fire and Rescue National Framework for England. We have also agreed to set in train an independent review of the operation of these principles in three years time, and in the light of that review, to take such additional action as might be required to ensure the commitments made to Parliament are secured.

I refer the hon. Member to the answer I gave on 1 July 2014, Official Report, column 610W. The consultation on the draft regulations has now concluded and it remains premature to pre-empt its outcome. Progress towards resolving this dispute remains entirely in the hands of the Fire Brigades Union.

To ask the Secretary of State for Communities and Local Government if he will facilitate negotiations between employers and trades unions on pensions in the fire service.

The pension on offer to firefighters is one of the most generous in the public sector. A firefighter who earns £29,000 and retires at age 60 after a full career will get a £19,000 a year pension, rising to £26,000 with the state pension.
The Government has been discussing reform of the Firefighters' Pension scheme with employers and trades unions for over two years, including meeting the Fire Brigades Union last week, and made significant improvements to the offer over that time.
Discussions on the detail of the reforms will continue as part of implementing the 2015 scheme.
To ask the Secretary of State for Defence for what reasons Ghurkas were historically not allowed to access pensions or social security benefits when made redundant.

Before 1 July 1997, when the Brigade of Gurkhas moved permanently from Hong Kong to the United Kingdom, Department of Social Security rules excluded them from paying national insurance contributions, even if serving temporarily in the United Kingdom. For this reason they were ineligible for state benefits. However, those that qualified by length of service would have received payments from the Gurkha Pension Scheme at that time, if they were made redundant.
Since May 2009 all ex-Gurkhas with more than four years service, may apply to settle in the United Kingdom. Once settled they are eligible for state benefits.

The Office for National Statistics is currently consulting on the methodology for reflecting owner occupiers' housing costs in a new additional measure of consumer price inflation. We will need to consider the range of issues, including the outcomes of this consultation, before coming to any conclusion about the most appropriate measure for the purposes of uprating state benefits and pensions and public sector pensions in the future.
