We condemn any acts of disrespect towards any patients including military and members of the United Kingdom Armed Forces in general. However, for operational security reasons, it would be inappropriate to discuss the specific details of measures currently in place to protect military patients being treated by University Hospitals Birmingham NHS Foundation Trust at the Selly Oak and Queen Elizabeth hospitals.
Security, as at all hospitals, is kept under constant review at Selly Oak Hospital. Liaison arrangements are in place between the Royal Centre for Defence Medicine, the hospital, Special Branch, and the local police.
Later this year, the new military ward will be in use at the new Queen Elizabeth Hospital, Edgbaston. Here military patients will typically be accommodated together in four-bedded rooms, which will further reduce the risk of abuse by civilian patients or visitors. All staff are appropriately trained and briefed in how to respond to such situations.

The role of the police is to facilitate peaceful protest, to keep the peace, to uphold the law and to prevent the commission of offences. Police tactics and decisions on how to achieve this difficult balance are a matter for the independent judgement of chief officers of police.
While the Government and police are committed to facilitating peaceful protest, we are clear that people have the right to go about their lawful business without fear of harm or intimidation. It is unacceptable for protest to cross over into violence or intimidation and the police will use the range of powers they have to deal with any activity that crosses this line.

The civil maritime industry takes the threat of piracy very seriously and is working with the UK Government to revise the Marine Guidance Note 298 on counterpiracy, through the DfT-led National Maritime Security Committee (NMSC). Industry representatives have also recently updated the Best Management Practice to Deter Piracy in the Gulf of Aden and off the Coast of Somalia (BMP) and have ensured that advice and guidance is widely circulated, encouraging its adoption by both UK and non-UK flagged ships.
An increase in the numbers of reports to the UK Maritime Trade Organisation (UKMTO Dubai) from ships transiting through, and reports of pirate activity in, the Gulf of Aden region illustrates that industry is both aware of, and following, the above guidance.

My Lords, I know I have this information somewhere at my fingertips but I cannot find it at the moment. By narrowing this function down to the ISA, compared with the old system we will have fewer people, it will be easier to do the training and the costs will be slightly less. However, there will be one focus and it will pull in evidence from all the various departments. Perhaps I may get back in writing on the specifics of the specialist training.

The safety of UK personnel serving overseas is of paramount importance. We constantly monitor the threats faced by our personnel in Iraq, Afghanistan and the Persian Gulf to ensure that they have the necessary protection to operate effectively in the environments in which they serve.

My Lords, the Government have spent some money researching the health of victims’ children, but so far we have not found causal relationships. Obviously, if there were to be new evidence, we would be more than willing to look at it. We accept that there are still many puzzling features and indeed much contradictory evidence about many of the inquiries that have taken place.

My Lords, the noble Lord is right to say that there are several aspects to the international effort on piracy and the Chinese have recently indicated their willingness to help in this situation. We are trying to make sure that we have an international contact group so that those countries that wish to make a positive contribution can do so.
We have had extremely good co-operation between the NATO force that was in the area until December and the EU mission that we now have, as well as the combined maritime force which has been ongoing for some time. We are extremely hopeful that the Chinese will wish to participate in the co-operating mechanisms to make sure that we maximise the effort and international co-operation.

The threat assessment for all tactical landing zones (TLZs) is continuously updated and is used to provide guidance on the measures required to provide adequate force protection. The deployed command will normally allocate force protection duties for a TLZ to the unit which has responsibility for the area in which the TLZ is located. This may be a unit from the RAF regiment, but could be a suitably trained Army or Royal Marine unit.
The brigade air liaison officer, working in conjunction with the air component commander and the brigade operations staff, will be responsible for ensuring that the unit tasked with providing force protection is trained and equipped for this role.

Yes, my Lords, I am confident.The provision of protected patrol vehicles such as Bulldog, Mastiff and Vector is a top priority for me. The progress that we have made—for example, fielding Mastiff from start to finish in under six months—shows the priority that we give to this.

The recent provocative Iranian exercises in the Gulf, with new anti-ship missiles and practice attacks on barges, demonstrate an ability to disrupt sea traffic in that vital international waterway. Can the Minister confirm that we have sufficient Royal Navy ships in the area to protect our right of free passage?

My Lords, I understand that the Iranian navy has traditionally been the smallest element of its armed forces, but with a significant headquarters in the Strait of Hormuz and smaller bases in the Caspian Sea and the northern Gulf. It plainly has an ability to exercise considerable influence over waterways in that area, and could have the ability to disrupt shipping in the Strait of Hormuz. There are grounds for thinking that our forces and forces of other members of the international community could dissuade it from doing so, but that would depend to some extent on whether it showed good sense and international community spirit in how it operated.

UK Armed Forces use a combination of equipment, procedures and intelligence to mitigate against the risk posed by improvised explosive devices and suicide bombings. Full details cannot be provided owing to operational security but I can outline the approach.
UK forces deployed on operations are equipped with suitable equipment—including personal protection and armoured vehicles—for the job in hand. All personnel deploy with enhanced combat body armour as standard, and enhanced, fit-for-purpose body armour is available for higher risk tasks such as top cover sentry duty on vehicles. In addition, the Defence Secretary announced enhancements to the armoured fleet including 100 additional VECTOR patrol vehicles, which afford greater protected mobility. (Official Report, cols. 74-77, 24 July). Electronic countermeasures on vehicles are constantly being developed to counter the threats identified and we constantly engage with industry to identify better capability.
Our forces undertake comprehensive pre-deployment training on tactics, techniques and procedures to counter the threats they may face. We constantly seek to improve these measures as the threat evolves. Crucial to the methods we employ is intelligence on the emerging threats and we work closely with coalition partners to share such intelligence and identify methods best suited to counter the likely threat.
While we do our utmost to mitigate the risk our forces face, we cannot eliminate the threat posed by suicide bombers and improvised explosive devices.

I thank the Minister for his reply and understand completely that any answer that he gives must not prejudice troop protection, but the Snatch Land Rover is not remotely adequate for patrolling areas where insurgents use landmines. Can the Minister assure the House that the Government will provide our soldiers with equipment that is fit for this role? What assessment have the Government made of the RG-31 which, with its V-shaped undercarriage, has a greater resilience to IEDs and which the Americans have bought in large numbers just for this role?

My Lords, I do not accept that Snatch Land Rovers are not appropriate for the role. We must recognise the difference between protection and survivability. It is important that we have the trade-offs that we need for mobility. The Snatch Land Rover provides us with the mobility and level of protection that we need.
We had 14 RG-31s in Bosnia, which we took out of service some time ago due to difficulties with maintenance. We have looked at the RG-31 alongside a number of alternatives for our current fleet and concluded that the size and profile did not meet our needs. Size is important in the urban environment. The RG-31 cannot access areas that Snatch Land Rovers can get to.

My Lords, I am sure the House will wish to join me in expressing our sincere condolences to the families and friends of the soldiers killed and injured in Afghanistan yesterday. We do not comment on the level of protection of specific vehicles, for obvious reasons. Protected patrol vehicles are only one of a range of vehicles available to commanders to allow them to balance mobility, protection and profile based on the threat, the terrain and the task. PPVs offer a level of protection commensurate with their weight, size and role, together with good mobility and a low profile.

Following a public consultation exercise on the operation of the Protection of Military Remains Act 1986 held in 2001, Ministers decided that a small representative number of wrecks, lost when on military service as defined in the Act, would be designated as controlled sites (on which any activity without a licence is prohibited).Statutory Instrument 2002 No. 1761 designated 11 wrecks—the remains of HMS ““Bulwark””, HMS ““Dasher””, HMS ““Formidable””, HMS ““Hampshire””, HMS ““Natal””, HMS ““A7””, HMS ““Vanguard””, HMS ““Affray””, HMS ““Exmouth””, HMS ““Royal Oak”” and the submarine ““H5””—as controlled sites. The statutory instrument also designated six wrecks as protected places (where diving activity is permitted on a ““look but don’t touch”” basis)—HMS ““Hood””, HMS ““Prince of Wales””, HMS ““Repulse””, HMS ““Gloucester””, RFA ““Sir Galahad”” and the U-Boat ““U-12””.Ministers also announced that all other military vessels that met the criteria outlined in the consultation document would be designated as protected places as part of a rolling programme of assessment. Following consultation with a number of bodies, a second tranche of designations comprising 30 candidate wrecks, all considered to be on military service when lost, has been drawn up. Once the list has been finalised, ministerial approval will be sought to the designation of the vessels as protected places. Further tranches will follow.

Candidate vessels for designation as protected places are identified as part of a rolling programme of assessment. The assessment is made against the criteria set out in the report of the 2001 Public Consultation on Military Maritime Graves and the Protection of Military Remains Act 1986 at www.mod.uk/consultations/maritime-graves/index.htm. Once approval by Secretary of State is given, designation is effected by means of a statutory instrument.
