As set out in the Home Office Strategic Plan 2004–08 (Cm 6287) the target for 2004–05 was £60 million, with more in future years. In 2005–06 we aim to exceed last year's performance where £84.4 million of criminal proceeds was recovered.

The Public Service Agreement (PSA) target was to increase the amount of assets identified from drug traffickers and secured by one
third over a three-year period. The target is measured in terms of receipts from the enforcement of confiscation orders in drug
trafficking cases. The baseline was receipts of £9.5 million during the 1997-98 financial year. The milestone objectives that were
set were receipts of £10.4 million in year one (1998-99), £11.5 million in year two (1999-2000) and £12.6 million in year three
(2000-01).
The outcomes for years one and two were £10.5 million in 1998-99 and £9.3 million for 1999-2000. The outcome for 2000-01 was £11.75
million, a little short of the PSA target but still representing the largest annual return to date.
The Government have since set a new target of doubling the amounts recovered from both drug traffickers and other serious criminals,
from the £29.4 million recovered in 1999-2000 in confiscation receipts and cash forfeited under the Drug Trafficking Act 1994 to £60
million by 2004-05. This is to be achieved through changes in law and practice which the Government are seeking to bring about
through the Proceeds of Crime Bill and the related initiatives published in the Asset Recovery Strategy.

Mr. Bercow: To ask the Secretary of State for the Home Department what estimate he has made of the cost of the Criminal Assets
Recovery Agency. [16909]
Mr. Bob Ainsworth: Our current estimate is that it will cost approximately £3 million to establish the Agency and that its annual
running costs will be around £13 million, assuming around 100 staff. This estimate covers both the Agency's operational activities
and the training and accreditation services which its centre of excellence will provide to other agencies. Based on current
assumptions about caseloads and amounts available for recovery, the Government expect that the Agency's receipts will exceed its
running costs.
The figures given above are subject to revision as our planning for the Agency develops. They do not take into account the
possibility, currently under discussion, that the Agency should assume a major role in the enforcement of confiscation orders other
than those that it has itself obtained.

Mr. Bob Ainsworth: The term money laundering refers to a number of different offences. Information taken from the Home Office court
proceedings database showing the number of persons convicted for money laundering offences during the period 1991 to 2000 in England
and Wales is given in table 1.
Data for other European Union (EU) states are not collected regularly. The data in table 2 have been produced from a paper produced
by the Financial Action Task Force (FATF) and was collected from the mutual evaluations of FATF members of which two rounds have
occurred since 1991.

Miss Melanie Johnson: All persons and institutions subject to the Money Laundering Regulations 1993 must identify their customer at
the start of an ongoing business relationship, when carrying out a one-off transaction of more than 15,000 euro, or where there is a
suspicion that a transaction is related to money laundering. These obligations apply for face to face and distance transactions.

Mr. Charles Clarke: The joint Council of European Union Justice, Finance and Interior Ministers, held in Luxembourg on 17 October,
endorsed the need for the fight against money laundering to be conducted on the basis of a multi disciplinary and co-ordinated
preventive and repressive approach. The joint Council also concluded that, if this were appropriate, this objective should be
achieved in Member States through the creation, or strengthening, of national multi-disciplinary bodies specifically dedicated to
the fight against money laundering. The Government are satisfied that in the United Kingdom these objectives are fully met by the
Economic Crime Unit of the National Criminal Intelligence Service and that no organisational or other changes will be necessary.

Mr. Bercow: To ask the Secretary of State for the Home Department what measures are presently under discussion at EU level for
combating money laundering through (a) the Internet and (b) electronic currency transfers. [134810]
Mrs. Roche: A number of measures have been taken or are currently under consideration in this area.
The revision of the 1991 Money Laundering Directive in the European Union, which has recently received political agreement within
the Council, is designed to ensure that all member states have sufficiently robust national laws and regulations to combat the
increasingly sophisticated methods used in money laundering. As such it includes specific provisions to ensure that there is
adequate identification of customers where no face-to- face contact between bank staff and customer occurs, such as through Internet
banking accounts. Implementation will require the development of specific regulations and guidelines in the United Kingdom, applied
to all those involved in financial transactions. This is currently being considered. It has been agreed that three years after the
adoption of the Directive an examination will be undertaken to consider identification measures for clients involved in
non-face-to-face transactions and the possible implications for electronic commerce.
In a separate measure, the European Union has prepared a comprehensive strategy for dealing with organised crime in a paper entitled
"The Prevention and Control of Organised Crime: A European Union Strategy for the beginning of the new Millennium". The measures
proposed in that document, and to be taken forward in European Union Working Groups, include a specific recommendation to address
the issue of money laundering on the Internet and via electronic money products.
At the joint Council of European Union Justice and Finance Ministers on 17 October, it was agreed that a range of measures be
undertaken against financial crime, with particular attention to be given to measures to facilitate the fight against the abuse of
new information and communications, especially the Internet and electronic transfer of money.

agencies in response to the conclusions reached at the Justice and Home Affairs Council of 17 October. [134812]
Mr. Charles Clarke: At the Justice and Home Affairs Council held on the morning of 17 October formal agreement was given to the
draft Framework Decision covering the exchange of information between the Financial Intelligence Units of member states. It is
unlikely that compliance with this instrument will require any change in the organisation of the National Criminal Intelligence
Service, which performs this function in the United Kingdom.
In the afternoon of 17 October Justice and Interior Ministers came together with their Finance Minister colleagues to discuss the
fight against financial crime. This joint Council invited the member states to have in place special multi disciplinary units to
fight money laundering. However such units could be either new or, where necessary could build upon existing arrangements. In the
United Kingdom we are satisfied that the present anti money laundering role discharged by the National Criminal Intelligence Service
fully meets the objectives identified by the joint Council.

Mrs. Roche: In my reply to the hon. Gentleman of 28 June 2000, Official Report, column 585W, I stated that discussions were taking
place between member states of the European Union with regard to the application of the principle of mutual recognition applied to
restraint of assets.
Since this reply there have been no further substantive discussions on this issue. However, I understand that the Presidency intend
to table a draft legal instrument on the subject shortly.

Mr. Bercow: To ask the Secretary of State for the Home Department if he will make a statement on his policy concerning the extension

Mr. Charles Clarke: The European Council, in its special meeting at Tampere on 15-16 October 1999, invited the Council of the
European Union to extend the competence of Europol to money laundering in general, regardless of the type of offence from which the
laundered proceeds originate. A draft amendment to the Europol Convention which would give effect to the Tampere proposal is
currently under consideration by member states. We support the purposes of the amendment which would enable Europol to provide
member states with more effective support in fighting money laundering which is at the heart of much organised crime. We take the
view, in negotiating the budget for Europol, that it must demonstrate that it is using its resources efficiently and cost
effectively in discharging its mandate. Any proposed increase to Europol's budget is subjected to detailed scrutiny, including by
the United Kingdom's representative on the Europol Management Board.
The European Council at Tampere also attached importance to allowing Europol to ask member states to initiate, conduct or
co-ordinate investigations, each involving a single member state, or joint investigation teams involving two or more member states,
while respecting national systems of judicial control. A draft recommendation reflecting this Tampere conclusion is also under
consideration by the member states. We support the purposes of the recommendation on the basis that any participation by Europol in
investigations or joint investigation teams would, as also envisaged at Tampere, be in a support capacity.

Mr. Bercow: To ask the Secretary of State for the Home Department if he will make a statement on progress made at the Council of
Ministers on fixing minimum standards for tracing and confiscating assets from crime. [128258]
Mr. Charles Clarke: The European Union Heads of State and Government meeting at the special European Council at Tampere in October
1999 called for action with regard to the approximation of criminal law and procedures on money laundering, with particular
reference to the tracing, freezing and confiscation of the proceeds of crime. It has been proposed that a new ad hoc working group,
which has still to be set up, will carry this work forward.
Separate discussions are taking place with regard to the application of the principle of mutual recognition to asset freezing and
restraint. This will involve consideration of the minimum standards which should be applied to permit recognition of orders between
member states.
The incoming French Presidency of the European Union has made action against financial crime and money laundering one of its
priorities and it is clear that this will involve some action in the area of the tracing and confiscation of the proceeds of crime.
