The Chief Executive of Roads Service (Dr. Malcolm McKibbin) has written to the hon. Gentleman in response to this question.Letter from Dr. Malcolm McKibbin, dated 25 January 2007:"You recently asked the Secretary of State for Northern Ireland a Parliamentary Question pursuant to the Answer of 15th January 2007, Official Report, column 935w, regarding, how many of the newly installed machines were reported as not operating properly in the first month after installation.""As this issue falls within my responsibility as Chief Executive of Roads Service, I have been asked to reply.""As you will be aware, National Car Parks Ltd (NCP) is responsible for managing machine faults and their repair, which normally relate to ticket jams and coin jams. I am advised that in the first month after installation, all 70 new pay and display machines were reported as experiencing faults. This was as a result of a specific unforeseen problem identified with the newly installed machines relating to the ticket paper quality, which resulted in a much greater number of ticket jams than would usually be expected. I understand that NCP trialled a number of different types of ticket paper to resolve this issue and, while doing so, provided a sufficient maintenance resource to deal with these additional faults. These teething problems have since been resolved and the newly installed machines are now operating to a satisfactory level.""I would add that the satisfactory maintenance of pay and display machines is a Key Performance Indicator in our enforcement contract with NCP. NCP performance in this area is being measured against fault response times detailed in the contract and will be continually monitored by Roads Service’s Parking Enforcement Unit."

Gentleman in response to this question.Letter from Dr. Malcolm McKibbin, dated 4 December 2006:"You recently asked the Secretary of State for Northern Ireland a Parliamentary Question regarding how many residents parking schemes are under consideration by the Department for Regional Development in each Northern Ireland council area. As this issue falls within my responsibility as Chief Executive of Roads Service, I have been asked to reply.""By way of background, I should explain that the Department took powers in the Road Traffic Regulation (NI) Order 1997 to permit the introduction of residents’ parking schemes in Northern Ireland. However, one of the key success factors for residents’ parking schemes is effective enforcement. At that time, the Police Service of Northern Ireland was responsible for the enforcement of parking restrictions, but indicated that they could not provide resources to carry out this enforcement. No schemes have therefore been implemented to date.""You will be aware that, on 30 October 2006 parking offences were decriminalised and Roads Service took over responsibility for the enforcement of parking restrictions. On 17 November 2006 we launched a draft policy consultation on residents’ parking, which will end on 9 February 2007.""While we have received a number of enquiries in relation to residents’ parking schemes, none of these will be considered in detail until the consultation has been completed and a policy developed. However, I can advise that following publication of the residents’ parking policy, it is intended that the first residents’ parking schemes will be implemented towards the end of next year."

Gentleman in response to this question.Letter from Dr. Malcolm McKibbin, dated 28 November 2006:"You recently asked the Secretary of State for Northern Ireland a Parliamentary Question regarding how many pay and display machines located in Limavady Central car park were out of order on a daily basis between 13 October and 17 November. As this issues fall within my responsibility as Chief Executive of Roads Service I have been asked to reply.""As you are aware Roads Service transferred responsibility for the operation of pay and display car parks to the private contractor, National Car Parks (NCP) on 30 October 2006. Prior to the transfer, Roads Service conducted twice weekly inspections / cash collections at the three pay and display machines in the Central car park, Limavady.""The table below details the number of pay and display machines working on each date Roads Service conducted an inspection/cash collection."

"Since the new operation started on the 30 October 2006 NCP has experienced some difficulties in relation to machine maintenance and this has resulted in some machines being out of order for longer than we would like. This is in part due to the huge task of transferring the management of maintenance and replacement of all parking equipment in Northern Ireland to one central control point. The pay and display machines currently operating in Limavady Central car park are relatively old and are soon to be replaced. A computer monitoring system, linked to the new pay and display machines will enable faults to be detected as soon as they occur. It is hoped this improved system will reduce the time machines are out of order."

Drivers of vehicles in Northern Ireland, where the driver is not resident in Northern Ireland, or where the vehicle is not registered in the United Kingdom, are subject to the provisions of the Road Traffic (Northern Ireland) Order 1981.A community licence holder (i.e. a person who holds a licence issued by any of the member states of the European economic area—EEA) may drive a vehicle which that licence authorises him to drive, provided he is not disqualified from holding or obtaining a licence in Northern Ireland (e.g. he may be subject to a disqualification imposed by a NI court). However, that person is not so authorised where the licence is not valid in the state which issued it (e.g. the RoI authorities may have imposed a disqualification—this would prevent that person from applying for an NI licence or from driving on the basis of the disqualified RoI licence). Article 15A of the Order refers.A person from outside the United Kingdom driving in Northern Ireland must be insured or secured against third party risks as prescribed by article 90 of the Order, and to the standard prescribed by article 92 of the 1981 Order. Under article 181 of the Order, police have the power to arrest without warrant and detain a person resident outside the UK for committing an offence under article 90 until he enters into a recognisance under the Magistrates Courts (Northern Ireland) Order 1981 to appear before a magistrates court to answer a complaint charging that offence.Failure to comply with any of the requirements specified aforementioned is an offence. These offences, and the punishments associated with them, are specified in schedule 1 to the Road Traffic Offenders (Northern Ireland) Order 1996.Vehicles that are parked illegally are issued with a non-endorsable fixed penalty notice (FPN) irrespective of the country of origin. However, it is not possible to summons to court the owners of vehicles resident in the Republic of Ireland for the non-payment of FPNs.

Gentleman in response to this question.Letter from Dr. Malcolm McKibbin to Gregory Campbell, dated 27 October 2005:"You recently asked the Secretary of State for Northern Ireland a Parliamentary Question regarding, what steps are being taken to ensure that those using disabled parking bays in car parks open to the general public in Northern Ireland are drivers with a valid disabled Blue Badge applicable to the vehicle in question.""I have been asked to reply as these issues fall within my responsibility as Chief Executive of Roads Service.""Firstly, I should explain that a Blue Badge is issued to a disabled person for their personal use. It does not limit the disabled person to a particular vehicle and can legitimately be used in any vehicle in which the disabled person in question is travelling. When a Blue Badge is displayed on a vehicle, only the serial number and date of expiry are visible to someone making a routine inspection. Other information, such as a photograph of the disabled person and their signature, are not immediately visible.""The purpose of the Disabled Persons Badge Scheme (the Blue Badge Scheme) is to give disabled people the ability to park on-street, close to the facilities and services they need so as to improve their lifestyle, independence and freedom of choice. The scheme only applies to on-street car parking. A Blue Badge does not entitle the holder to free parking within a Roads Service off-street fee paying public car park. Therefore, there is no monetary benefit to be gained from the improper use of a Blue Badge within a fee paying public car park. For other off-street private car parks, such as shopping centres and multi-storey car parks, badge holders must check the concessions offered, as these can vary widely.""Responsibility for the enforcement of off-street disabled parking spaces in public car parks currently rests with Roads Service. Article 6 of the Off-Street Parking (NI) Order 2000 prohibits the driver of a vehicle, other than a disabled person's vehicle, to park in a disabled parking space. Contravention of this Article is an offence, and in such circumstances, Roads Service has the power to remove the vehicle or instigate proceedings to prosecute the individual involved.""However, our experience is that there is not a major difficulty with the misuse of off-street disabled parking spaces. This may be explained by the considerable concessions for Blue Badge holders at on- street parking facilities, including free unlimited parking at on-street ‘pay and display' equipment. Other on-street parking concessions also permit a Blue Badge holder to leave their vehicle without time limit in a street where waiting is normally allowed only for limited periods. Blue Badge holders may also, in some areas, leave their vehicle for up to 3 hours on many yellow lines.""It is therefore our policy to discourage potential offenders and where disabled persons' interests can be protected by persuasion, rather that prosecution, so much the better. To this end when car park attendants discover a vehicle parked in a disabled parking space without having a Blue Badge on display, they place a notice on the vehicle advising the driver that he/she is parked in a space reserved for disabled people. The notice also advises that such parking is an offence that may result in a fine or the vehicle being removed.""I should also advise that following the PSNI's decision to withdraw from the enforcement of on-street parking restrictions, to enable policing resources to be focused on areas of greater policing priority, DRD has introduced new primary legislation, the Traffic Management (NI) Order 2005. This legislation provides the necessary legislative power to introduce civil enforcement of certain road traffic offences, initially enforcement of parking and waiting prohibitions and restrictions. Decriminalised Parking Enforcement (DPE) is likely to become effective in late September/early October 2006.""Under DPE, traffic attendants will be able to inspect Blue Badges to check for abuse of the system and may issue a Penalty Charge Notice if misuse is suspected. If this happens, Roads Service will write to the holder of the badge and inform them that it has been used inappropriately. Should this happen on a number of occasions Roads Service may withdraw the disabled persons' badge. Vehicles not displaying a Blue Badge, but parked in an on-street disabled parking space, will be issued with a Penalty Charge Notice.""I hope this information is helpful."
