Does my right hon. Friend recall that nearly 10 years into the life of the previous Government, it suddenly emerged by chance that foreign prisoners were not being considered for deportation when they should have been, and that there was a backlog of 400,000 asylum cases and other cases owing to incompetence? Will he ensure that there is a culture of openness, transparency and efficiency in the Home Office right from the start of this Government?

My hon. Friend makes a good point with characteristic trenchancy and passion. He is right. The situation with foreign national prisoners was a disaster, as was the asylum delay backlog. We are getting to grips with these problems. It is very important not only that we have the right number of people coming to this country but that the people of this country have confidence in the administration of the immigration system, because without that we will never have people assured that the borders of this country are as secure as they should be. That was one of the great failures of the previous Government.

Under the Immigration and Asylum Act 1999 asylum seekers and their dependants are not permitted to access the mainstream system of welfare benefits.Asylum seekers and their dependants who need support to avoid destitution are given it by the UK Border Agency from the time they arrive in the UK until their claim is fully determined. Support takes the form of subsistence, accommodation or both.Accommodation is fully furnished and includes all utilities and council tax payment. It is provided through a series of target contracts which the UK Border Agency has entered into with both public and private sector accommodation providers.From 6 July 2009, levels of subsistence support will be per week £35.13 for a single asylum seeker aged 18 to 24 or £42.16 for a single asylum seeker aged over 25; £69.57 for an asylum seeker accompanied by a spouse or partner; £120.38 for an asylum seeker with a partner and one child under 16; £171.19 for an asylum seeker with a partner and two children under 16; £222.00 for an asylum seeker with a partner and three children under 16From 5 October 2009, all new single applicants without children will receive £35.13 a week regardless of age.The regulations updating asylum support rates were laid before Parliament on 11 June 2009.

The United Kingdom Border Agency does not keep a record of the numbers of properties transferred to the private rented market. However I do refer the hon. Member to the answer given on 11 June 2008, Official Report, column 336W.The number of private sector accommodation providers used since the inception of the National Asylum Support Service in 2000 has changed over the years. During the whole period 2000 to 2003 there were 10 private sector providers providing property to NASS. The numbers of private providers reduced to nine in 2004 and the original 10 providers reduced to seven in 2005. In 2006 replacement accommodation contracts were awarded to nine private sector providers. This figure has recently reduced to eight.We do not hold records of the numbers of properties procured by accommodation providers because the contracts are framed in terms of outcomes.

Information on the number of nationals from Ghana, Nigeria and Poland who have received indefinite leave to remain in the UK through the 1998 backlog clearance exercise and the 2003 family indefinite leave to remain exercise is as follows. Information on the nationality breakdown of grants of leave to remain under the UKBA’s case resolution programme were provided in the response given to the hon. Member on 29 September 2008, Official Report, columns 2348-49W.Information on asylum initial decisions for nationals of Poland for 2005 and 2006 is as follows. Information for previous years and for nationals of Ghana and Nigeria are available from the annual Statistical Bulletin Asylum Statistics United Kingdom.Since the accession of Poland to the EU on 1 May 2004 Polish nationals have not been subject to immigration control and have had the ability to exercise EU rights of movement and residence in the UK. The information is as follows:(i) The following tables show the number of principal asylum applicants who have been granted leave to remain in the UK through the pre-1996 asylum application backlog exercise (referred to in the question as the 1998 backlog exercise) by nationality during 1999 and 2000. The backlog clearance exercise ran for these two years only.Information on dependants granted leave to remain in the UK through the backlog exercise is not available by nationality and can be obtained only by examination of individual case records at disproportionate cost. Total figures for principal applicants including dependants granted exceptional leave under the backlog exercise were 15,195 and 14,045 in 1999 and 2000 respectively.(ii) For information on the 2003 family indefinite leave to remain exercise, I refer the hon. Member to the reply my right hon. Friend the Member for Birmingham, Hodge Hill (Mr. Byrne) gave on 16 January 2008, Official Report, column 1298W.UKBA is no longer reporting on the performance of the Family ILR Exercise. The small number of remaining cases are being processed with other legacy cases, not as a separate workstream, and will be reported on as part of normal business.(iii) Information on the legacy exercise by nationality is not available and could be obtained only by examination of individual case records at disproportionate cost.(iv) Discretionary leave to remain has only been granted since April 2003. For information on the numbers granted discretionary leave to remain from April 2003 to 2006, I refer the hon. Member to the reply my right hon. [holding answer 17 September 2008]: UK Border Agency achieves this by excluding those who have participated in terrorism from asylum under article 1F of the UN Convention Relating to the Status of Refugees. The statistics relating to exclusion from the 1951 Convention under article 1F do not differentiate between those who are refused asylum on grounds of participation in terrorism or for other grounds which are covered within article 1F. It is therefore not possible to give a precise figure in answer to the hon. Gentleman's question, except at disproportionate cost.

The UK Border Agency (UKBA) has worked with local authorities to develop local solutions to mitigate any potential impacts of the work to clear the backlog of older cases. The precise nature of any schemes adopted by authorities is a commercial matter between them and the providers with whom they deal.There is no separate budget for any element of the support being offered to local authorities as a result of the legacy exercise. UKBA is expected to contain expenditure on such support within its overall budget for accommodating asylum-seekers.No amounts have yet been paid to local authorities. In her letter of 17 December 2007 to the Home Affairs Select Committee, Lin Homer, Chief Executive of the UK Border Agency stated that of the 52,000 older asylum cases that had been concluded, 19,000 had led to grants of leave, 16,000 had led to removals and 17,000 had been closed due to previously erroneous or duplicate records. Lin Homer is due to update the Home Affairs Select Committee on the work to clear the backlog next month.
