Lady Hermon: To ask the Secretary of State for Northern Ireland, what assessment he has made of (a) Section 2 Paramilitary
violence and (b) Section 3 Systems for investigating deaths of the Chief Commissioner's Overview of the Northern Ireland
Human Rights Commission Annual Report 2004. [202876]
Mr. Paul Murphy: I utterly deplore and condemn the vicious attacks highlighted in section 2 of the Chief Commissioner's overview,
which in many cases have left the victims physically and mentally scarred for life. Despite making every effort to bring to justice
those responsible for these acts, the police can be hampered when in their investigations if the victims fail to cooperate either
through fear or because to do so may implicate them in other crimes. Prosecutions are therefore extremely rare.
However, Government and law enforcement agencies continue to seek ways of addressing the problem effectively. The Independent
Monitoring Commission will continue to monitor the level of paramilitary activity including shootings and assaults and report on
this regularly to the British and Irish Governments.
In relation to Section 3, following judgments of the European Court of Human Rights the Government has put together a package of
remedial measures designed to address the judgments and improve the investigation of deaths including the inquest system. This
package reflects the current position of the Government and remains under the consideration of the Committee of Minister's Deputies
in Strasbourg.
Furthermore, the Government recognises the continuing hurt that many feel about the number of deaths that remain unresolved. For
those who have suffered the loss of loved ones, the possibility of coming to terms with what has happened in the past is made more
remote because there remain significant unanswered questions. We must do everything possible to give those people the best chance of
achieving that.
The Serious Crime Review Team within the Police Service of Northern Ireland was established by the Chief Constable this spring to
re-examine the files on some of these murders, and to establish whether there is any prospect of fuller reinvestigation leading to
an outcome. It is recognised that this is painstaking work and places significant demands on police resources. As a consequence the
Government has been working with the Police Service of Northern Ireland on how this work might be expanded to process greater
numbers of unresolved deaths and to do so in a way that commands the confidence of the wider community.

remit is; and if he will make a statement. [179730]
Mr. Spellar: There is no Victims Commissioner for Northern Ireland. The idea of a Victims Commissioner was first put forward as a
recommendation by Sir Kenneth Bloomfield in his report, "We Will Remember Them", which looked at possible ways of recognising the
pain and suffering of victims of the Troubles. Since its publication in 1998 Government have implemented the majority of his
recommendations. However, the appointment of a Victims Commissioner was not pursued. A Victims Minister was appointed and since then
over £20 million has been allocated to victims initiatives. The role of Victims Commissioner as envisaged in the report was
primarily that of a watchdog over the services and advice available to victims. The Office of the First Minister and Deputy First
Minister are taking much of this work forward in their cross- departmental strategy; the consultation exercise they carried out
indicated no clear view on the establishment of such a post. Government are currently reviewing their strategy for addressing the
needs of victims of the Troubles, including how we deal with the past. This review will inform the development of the next phase of
victims policy. We cannot pre-empt the outcome of the review.
The Domestic Violence, Crime and Victims Bill will make statutory provision for a Victims Commissioner in England and Wales who will
champion the interests of victims and witnesses of all offences. The provisions have not been extended to Northern Ireland as the
Criminal Justice Review made specific recommendations regarding victims and witnesses. The Review recommended that a group
comprising of both statutory and voluntary bodies should be set up to maintain a specific focus on victims issues. The Victims,
Vulnerable or Intimidated Witnesses Steering Group, representative of criminal justice agencies and Victim Support (NI), fulfils
this role. The Review also recommended that the possibility of an advocate should be considered again in the future if new
arrangements on behalf of victims are seen not to be working.

Mr. Rammell: The UK welcomes the constitutional succession and political process now underway in Haiti in order to promote a
peaceful and lasting solution to the current crisis.
The UK welcomes the adoption of UN Security Council Resolution 1529 which authorises the deployment of a multi-national Interim
Force to Haiti and declares the Security Council's readiness, within three months, to establish and deploy a UN stabilisation force
that will support the continuation of a peaceful and constitutional political process.

Jane Kennedy: It is not possible to provide details of the number of persons arrested or charged for such offences as the offences
which they have been charged with are defined as assault occasioning actual bodily harm or grievous bodily harm. Police statistics
do not identify whether such crimes were the result of paramilitary attacks. Police investigations into these crimes are often
hampered by the victims' reluctance to co-operate with them.

Mr. Ingram: Many of the following figures have been compiled under operational conditions and may therefore be subject to future
refinement and revision.
Decisive combat operations in Iraq ceased on 1 May 2003. Figures for the number of attacks on United Kingdom forces were not
collected before 1 June 2003. Between 1 June and 17 October 2003, we assess that there were 101 deliberate attacks on coalition
forces in the UK-led area of operations. Five resulted in the deaths of British personnel.
