My Lords, I am grateful for that welcome reply from the Minister, which I am sure will be greeted with great gratitude by Hisham and his family, who will no doubt wish to come and discuss the matter. Will the Minister give an assurance that no EU framework agreement will be entered into with Libya until it can be demonstrated that Libya, which has made only small progress so far in human rights, will comply fully with its international human rights obligations?

I thank the noble Lord for making that important point. The UK is a strong supporter of the EU’s attempts to negotiate with Libya the framework agreement to which the noble Lord alluded, which in our view will provide a platform for dialogue and co-operation on areas including human rights and fundamental freedoms. Establishing a human rights dialogue is a key part of the ongoing negotiations for that framework agreement between the European Union and Libya. The last round of negotiations took place in Tripoli in December and another round is due to take place in Brussels in March. We support a rapid conclusion to the negotiations in 2010, but within the parameters that the noble Lord has described.

My Lords, last week, the Foreign Secretary issued a statement expressing support for the efforts of Hisham Matar to ascertain the whereabouts of his father. The Foreign Secretary said: ""Hisham and his family need to know the truth now"."
Our embassy in Tripoli has raised this with the Libyans and has asked them to investigate further. We take all allegations of human rights abuses seriously and have urged the Libyan Government to address the specific cases highlighted in the Human Rights Watch report, which include that of Mr Hamed Said Khanfoor.

My Lords, I should declare a personal interest as the former co-counsel for Mr al-Megrahi in his unsuccessful application to the European Court of Human Rights. In the interests of justice and for the sake of the Lockerbie families, would the Government now seek to persuade the Scottish Executive to set up a full judicial inquiry into the matters raised by the Scottish Criminal Cases Review Commission and the UN observer, Professor Köchler, about a possible miscarriage of justice and abuses in the investigation, prosecution and trial?

My Lords, as yet the British Government have made no decisions on these matters. The Lockerbie investigation took place and the result was that al-Megrahi was imprisoned in Scotland under that legal system. That remains the case and nothing can change in terms of what is possible from the investigation. The Libyans paid substantial compensation to the Lockerbie victims, but we accept that that is no justification.

The Government believe that the Gaddafi Development Foundation (GDF) will carry out its functions as a monitoring body independently and effectively. Both the Libyan and British Governments have undertaken to support the monitoring body's full and unrestricted implementation of its terms of reference.
The GDF is the largest and most experienced non-governmental organisation in Libya. It has been operating since 1998. It frequently adopts public positions which are distinct from those of the Libyan authorities; for example, in its work on the case of the Bulgarian and Palestinian medical staff accused in 1999 of deliberately spreading HIV in a children's hospital in Benghazi. The British Government have undertaken to provide capacity building assistance which the GDF may request in preparation for carrying out its monitoring role. The GDF has so far identified a need for training in forensic medicine and on the application of international human rights law. The Government are making arrangements for such training to take place.
