To ask Her Majesty's Government what controls and penalties are in place to ensure that providers of medical assessors for social security benefits maintain high standards of accuracy and integrity; and on how many occasions any such controls or penalties have been used since June 2018.

The department is committed to ensuring claimants receive high quality assessments. We set our assessment providers challenging targets and monitor performance closely against a range of measures including through independent audit to improve accuracy and decision making. Contractual remedies are in place if assessment providers fail to deliver against the service standards.
Contractual remedies for underperformance against a range of service levels are recovered through service credit mechanisms and through deductions of payments (a ‘No Pay’ mechanism). The extent of underperformance and application of related mechanisms varies significantly and the regularity of such remedies should not be seen as a measure of overall performance.
In relation to the HDAS contract covering Work Capability Assessments, service credits (the contractual remedy for SC1 – Quality) have been applied in 12 out of the 14 months from June 2018 to July 2019 (the date of the most recent statistical information available).
In relation to the Personal Independence Payment contracts, “No Pay” (the contractual remedy for SC1 – Quality) has been applied in one or more Lots in each month from June 18 to June 19 (the date of the most recent statistical information available).
Below is the breakdown of the totals by Lot:
Lot 1 – No pay was applied to SC1 in 8 of those months
Lot 2 – No pay was applied to SC1 in 5 of those months
Lot 3 – No pay was applied to SC1 in 11 of those months.

The Food Standards Agency’s programme of audits of local authority food law enforcement services included the following number of audits of food standards enforcement in the years specified:
2016 – nine;
2017 – nine; and
2018 – two carried out to date and five planned by the end of 2018.

Responsibility for the control of ragwort rests with the landowner or occupier in the first instance. A complainant concerned about the spread of ragwort, or any of the other injurious weeds specified in the Weeds Act, should contact the owner or occupier of the land in question to address the problem.
If reasonable efforts are not made by those responsible, the complainant should contact Natural England which has been delegated responsibility for investigating complaints about ragwort and other injurious weeds and, where necessary, for taking the appropriate enforcement action. However, neither Natural England nor Defra have the resources to investigate all weeds complaints. In determining what follow up action is to be taken, priority is given to complaints involving possible spread to land being used for:
Keeping or grazing horses and other livestock;
Farmland used to produce conserved forage, and;
Other agricultural land activities.
In order to assist public bodies (along with other landowners and occupiers) in fulfilling their responsibilities, the Government amended the Weeds Act with the Ragwort Control Act 2003. This provided for a Code of Practice on preventing Ragwort spread. My colleague, Richard Benyon, the Parliamentary Under-Secretary
of State wrote to land owning Public bodies and over 500 local authorities in February this year reminding them of their responsibilities under the Act and enclosing our Code of Practice.

The Civil Aviation Authority (CAA) does not enforce the Health and Safety at Work etc Act 1974 or the Control of Substances Hazardous to Health Regulations 2002 (as amended). The CAA does enforce Regulation 6 of the Civil Aviation Authority (Working Time) Regulations 2004 (as amended). The CAA is the UK’s independent aviation regulator and the greater part of its income comes from the range of regulatory charges it imposes on industry. It is accountable to Parliament through the Secretary of State for its functions. Funding for the enforcement of these regulations comes within the standard funding arrangements of the CAA.
