[181964] Mr. Connarty: To ask the Secretary of State for Environment, Food and Rural Affairs what the outcome was of the Environment Council on 28 to 29 June; what the Government's stance was on the issues discussed, including its voting record; and if she will make a statement. [181878] Mr. Morley: I attended the Environment Council on 28 June 2004, together with my right hon. Friend the Secretary of State for Environment, Food and Rural Affairs. The Council reached political agreement on two proposals. The first was an amendment to the Directive concerning the sulphur content of marine fuels, which is intended to lead to a significant reduction in sulphur dioxide emissions from ships operating within member states' waters. The text as adopted would fulfil the obligations of the UK (and other member states) under the recently ratified International Maritime Organisation rules relating to Sulphur Oxide Emission Control Areas and also includes provision for the use of approved abatement technologies as an alternative to low-sulphur fuel. The proposal was adopted by qualified majority, with UK support. Council also reached political agreement on a revised Bathing Water Directive, with unanimous support. The proposal sets standards for the monitoring and classification of bathing waters. It incorporates a new category of bathing water (`satisfactory/acceptable'), and flexible management arrangements including discounting of samples taken during short-term contamination incidents, within certain limits. We also discussed a proposed Regulation on shipments of waste. Agreement was not reached at this Council, because one member state maintained a general scrutiny reserve, and unanimity was required in the face of a Commission disagreement as Council decided to change the proposed legal base to Article 175. The proposal updates an existing Regulation to reflect revisions to the Basel Convention on the control of transboundary movements of hazardous waste and their disposal and the relevant OECD decision. Twenty- four member states, including the UK, were able to support the proposal. The dossier will be considered further in COREPER with a view to adoption at a future Council. Council adopted Conclusions relating to the Commission communication "Towards a thematic strategy on the prevention and recycling of waste". These were wide-ranging, and included encouragement to the Commission to develop this thematic strategy in tandem with its work on the use of natural resources and integrated product policy. We held a policy debate on various aspects of the proposed Regulation on registration, evaluation, authorisation and restriction of chemicals (REACH). As requested by the Presidency, the UK made only a short intervention, providing further comments in a written paper, a copy of which will be placed in the Library. The Presidency drew the conclusion that work should continue in the ad hoc working group. Council was asked to agree a decision concerning the placing on the market of a maize product (Zea mays L. line NK603), genetically modified for glyphosate intolerance. The UK supported the Decision, but no qualified majority was attained to either support or reject the proposal.In the absence of a Council decision, the Commission will be able to adopt its proposal. Council was briefed by the Presidency on the outcome of conferences on biodiversity held in Killarney and Malahide, and a further set of Conclusions was adopted on halting the loss of biodiversity by 2010. The UK was among a group of member states that successfully pressed for additional points on illegal logging, emphasising the need for urgent action to eliminate imports of illegally harvested timber as a contribution to halting biodiversity loss. Council also discussed the importance of effective financial arrangements to support the Natura 2000 network as an important contribution towards achieving global and regional biodiversity protection. We looked forward to debating the Commission's expected communication on financing Natura 2000. A further policy debate was held, on the proposed Directive on managing waste from the extractive industries. Again, the UK provided a written submission, a copy of which will be placed in the Library. A number of short information points were raised under Any Other Business. There was also an appeal by Germany, supported by several others, for an early proposal for new Euro V standards with a view to reducing particulate emissions from diesel cars.

Llew Smith: To ask the Secretary of State for Environment, Food and Rural Affairs if she will make a statement on matters discussed and decisions taken at the ministerial conference on the North sea, held in Bergen, in March; and if she will place in the Library copies of all United Kingdom submissions to the conference and submissions by other Governments and accredited bodies that are relevant to the United Kingdom. [47663] Mr. Meacher: The fifth North Sea Conference was held in Bergen, Norway, on 20 and 21 March. I represented the UK and was supported by Allan Wilson, Deputy Minister for Environment and Rural Development at the Scottish Executive. The Conference received a report on progress made in taking forward the commitments made at the fourth North Sea Conference held in Esbjerg, Denmark, in 1995. The outcome of the fifth North Sea Conference was a declaration for further action to protect the marine environment of the North Sea. It covered establishing an ecosystem approach, the conservation of habitats and species, fisheries, shipping, hazardous substances, eutrophication, offshore installations, radioactive substances, renewable energy, marine litter and waste management, spatial planning and future co-operation. The Conference was very successful in producing an agreed declaration which provides a worthwhile step for the further protection of the marine environment. Key initiatives include a commitment to develop and pilot ecological quality objectives to assess progress made towards an ecosystem-based approach, a commitment to designate relevant areas of the North Sea as a network of well-managed marine protected areas by 2010 and the creation of a network of investigators and prosecutors to tackle pollution from shipping. It was also agreed that Sweden would host a Ministerial meeting on the environmental impacts of shipping and fishing by 2006. The declaration also contains proposals to work through the OSPAR Convention for the Protection of the Marine Environment of the North East Atlantic to develop guidance on offshore wind energy schemes and consider how best to share information on spatial planning for the North Sea. It also endorses further work through OSPAR to tackle pollution from hazardous substances, offshore installations, radioactive substances and the prevention of eutrophication. I have placed copies of both the progress report and the declaration in the Library of the House. They are also available at http://www.northseaconference.no.

[143755] Mr. Llew Smith: To ask the Secretary of State for the Environment, Transport and the Regions if he will make a statement on the matters discussed and issues decided upon at the Ministerial Environment Council on 18 and 19 December 2000. [145277] Mr. Meacher: The Deputy Prime Minister and I represented the UK at the Environment Council in Brussels on 18 and 19 December 2000. One Common Position was agreed, one proposal was adopted at First Reading in agreement with the European Parliament, and three sets of Council Conclusions were agreed. The Council expressed its willingness to meet in Oslo for discussions on climate change with the Umbrella Group (including the US, Japan, Canada and Australia). After a lunchtime telephone discussion between the Troika and representatives of the Group, the Presidency reported that the Oslo meeting would not take place as the Group felt there to be insufficient common ground at the present time. Council Conclusions broadly reflect the outcome of these discussions, although the UK made a minutes statement to clarify one part of the Conclusions. Council reached agreement on a Community Framework for co-operation to promote sustainable urban development. The Council agreed on a budget of euro 14 million over a four-year period from 2001, the same figure as finally proposed by the European Parliament in amending the Commission's original proposal of euro 12.5 million over the same period. Since Council agreed the proposal in the same terms as voted by the European Parliament it was adopted without the need for a second reading. Council reached Common Position on the proposed Framework Directive on Assessment and Management of Environmental Noise. This will introduce a common EU standard for noise measurement, harmonised noise level monitoring and mapping, along with a new EU noise indicator, but does not impose an EU wide limit value for ambient noise. Council also invited the Commission to make proposals for new or more stringent binding noise emissions limits from specific sources, including vehicles and outdoor machinery. Conclusions were agreed on global environmental governance, essentially to strengthen the UN Environment Programme (UNEP) and improve the co-ordination of international environmental institutions. The EU will look into the possibilities of increasing its contribution to UNEP providing other contributors do likewise. Detailed proposals on these issues will be developed for discussion at the European Council in Gothenburg next June, in preparation for the Rio + 10 Conference in 2002. Proposals for Directives on Waste Electrical and Electronic Equipment (WEEE) and Restriction of use of certain Hazardous Substances in electrical and electronic equipment (RoHS) were discussed. The Presidency explained that the EP had not given its opinion so Common Position was not achievable, but it aimed to develop a view on a common approach. I made it clear that the proposals had not cleared Parliamentary Scrutiny and I could not, therefore, agree a text. However, a useful discussion enabled a clearer view to emerge of the possible range for agreement on the timetables for producer responsibility, and for recovery and recycling targets. Council adopted, without debate, brief Conclusions on the Commission's review of the Auto Oils II programme calling for further proposals on fuel specifications and the control of vehicle emissions. Orientation debates were held on: the application of the Aarhus Convention to European Institutions, as regards access to environmental information; the Commission's white paper on Environmental Liability; and on traceability and labelling of GMOs. Over dinner Ministers received informal progress reports from the Commission on the following, as there had been no time for taking these items during Council: Sixth Environmental Action Plan; the review of the EU chemical legislation; the planned Green Paper on Integrated Product Policy; Community guidelines on State Aid for the Environment; international negotiations on the Persistent Organic Pollutants Convention; and the Resolution adopted by the General Affairs Council on 4-5 December on the Precautionary Principle.

Mr. Llew Smith: To ask the Secretary of State for the Environment, Transport and the Regions from which sources the United Kingdom accepts the import of toxic waste for (a) incineration and (b) landfill. [129973] Mr. Meacher: UK policy on waste imports is set out in the legally binding United Kingdom Management Plan for Exports and Imports of Waste, which came into effect in June 1996. The policies in the UK Plan prohibit most waste imports for disposal, and are designed to encourage countries to become as self-sufficient as possible in waste disposal. However, where countries cannot reasonably be expected to deal with specific wastes in an environmentally sound manner, the UK is prepared to accept them given that we have the necessary treatment facilities which meet tough environmental standards. Consistent with this approach the UK currently accepts imports for disposal by high temperature incineration from Brazil, Guernsey, Ireland, the Isle of Man, Jersey, Portugal, South Africa and Thailand. We also have extant agreements to accept waste from Argentina, Chile, Egypt and Pakistan, although there have been no shipments to date from these countries. We have only accepted waste for landfilling from the British Antarctic Territory, the Falkland Islands and the Isle of Man. Earlier this year the UK made a bilateral arrangement to accept wastes from the Sovereign Base Areas of Akrotiri and Dhekelia on Cyprus for disposal by either option, although there have been no shipments under the arrangement to date. The position is different for imports for recovery, which under European law includes incineration where the primary purpose is energy recovery. The UK Plan, consistent with the EC Waste Shipments Regulation and OECD Decision C(92)39/Final, permits movements of wastes for recovery between OECD members on the basis that this trade provides a valuable source of raw materials; and that no country is self-sufficient in waste recovery. However, while any OECD member country may export hazardous wastes to the UK for incineration with energy recovery, to date we have only received hazardous wastes from Guernsey, Ireland, the Isle of Man, Jersey and the Netherlands. UK policies and procedures on the acceptance of waste imports are being considered as part of the current review of the UK Plan. I have made it clear that the UK would expect developing countries to develop, as quickly as is feasible, appropriate facilities to deal with their own waste, as far as is compatible with environmentally sound and efficient management.

[128861] Mr. Meacher: [holding answer 3 July 2000]: At its annual meeting in Copenhagen last week, the OSPAR Commission adopted, by consensus, a programme for more detailed work on the implementation of the OSPAR Commission's strategy on radioactive substances. This provides for the adoption of national plans, the submission of detailed forecasts of how the elimination or reduction of radioactive substances from both nuclear and non-nuclear sources will be achieved, in order to meet the OSPAR 2020 goal on radioactive discharges, emissions and losses, and to enable the Commission to develop a collective oversight of progress towards this goal. The OSPAR Commission finalised a first and essential step in the implementation of its long-term strategy on hazardous substances. As a result, twelve new hazardous substances were added to the OSPAR List of Chemicals for priority action. The Commission also adopted several measures to control chemicals from both offshore and land-based sources, including the setting of a new international standard for the regulation of the use and discharge of offshore chemicals and drilling fluids. Under the strategy to combat eutrophication, the OSPAR Commission agreed which areas of the North East Atlantic do not present eutrophication problems, adopted on a trial basis guidelines for evaluating nutrient inputs to the sea, and put in hand work on comprehensive assessments of the areas where there are, or may be, eutrophication problems. The Commission adopted and launched the Quality Status Report on the whole of the North East Atlantic, the "QSR 2000". This report, together with reports covering the five regions of the OSPAR maritime area, is the first review of the health of the North East Atlantic in such detail. The OSPAR Commission also finished reviewing its working methods and established a new organisational structure, to keep the effective implementation of its five long-term strategies and the effective follow-up to the QSR 2000. Twelve OSPAR states adopted a decision requiring a review of nuclear processing in preventing accidental pollution. Although the UK drew attention to its recently published draft national discharge strategy, all the OSPAR states except France supported the decision, and the UK and France abstained. I am arranging for copies of the Summary Record of the Commission's meeting to be placed in the Library when it becomes available.

Mr. Llew Smith: To ask the Secretary of State for the Environment, Transport and the Regions if he will make a statement on the outcome of the Fourth Meeting of the Parties to the Basel Convention on transfrontier movement of hazardous waste, held in Malaysia in February. [33111] Angela Eagle: The Conference was held in Kuching, Malaysia from 23-27 February. I attended the High Level segment from 26-27 February representing the Presidency of the European Union. This was a successful conference both for the UK and for the European Union. The Conference adopted an amendment to the Convention based on a joint proposal by Chile and the European Community which added new annexes listing hazardous and non-hazardous waste. The UK has been closely associated with the development of this proposal from its inception and was particularly active, as a member of the Troika, in support of the Luxembourg Presidency's negotiations with Chile to merge their proposal with the Community's. The new amendment will give legal clarity to the scope of the earlier `ban' amendment (Decision III/1) adopted by the Third Conference of Parties. The latter will ban exports of hazardous waste from Annex VII Parties (OECD countries, the EC and Liechtenstein) to non-Annex VII countries. The Chile/EC amendment should therefore add considerably to the prospects for securing enough ratifications to bring the ban amendment into force. It will not require ratification, but will enter into force within six months except for any Party notifying the United Nations that it does not accept the amendment. Proposals from Israel, Monaco and Slovenia to be added to Annex VII were unsuccessful. Instead, the Parties decided that Annex VII should not be amended until the ban amendment has entered into force. To date, nine Parties have ratified of the 65 required. The UK ratified on 13 October 1997. The conference also decided that an analysis should be prepared highlighting the issues related to Annex VII. The Conference extended the mandate of the legal group which is charged with developing a Protocol on liability and compensation for damage arising from transboundary movements of hazardous waste. The group was, however, instructed to consider the implications of the ban amendment and other relevant international conventions for the proposed Protocol. The Conference adopted a number of other decisions including one aimed at enhancing the capability of Parties to detect and enforce against illegal traffic and others concerned with capacity building in developing countries. The UK has recently agreed to fund two such projects forming part of an Action programme for the Caribbean.

Mr. Llew Smith: To ask the Secretary of State for the Environment, Transport and the Regions what reviews are being, or have recently been, conducted governing the adequacy of the safety arrangements for the import and export of dangerous and toxic substances (a) by air, (b) by ship and (c) via the Channel Tunnel. [31023] Ms Glenda Jackson: (a) United Kingdom legislation requires dangerous goods (which include toxic substances) carried by air to be in compliance with the International Civil Aviation Organization's Technical Instructions for the Safe Transport of Dangerous Goods by Air. These Instructions are subject to a biennial review and amendment cycle, and the United Kingdom provides a member for the Panel which carries this out. The Civil Aviation Authority is satisfied that there are adequate and up-to-date safety arrangements in place for all dangerous goods carried by air. (b) The carriage of dangerous goods by sea is governed by the International Maritime Dangerous Goods (IMDG) Code, which like the air regulations applies world wide. Its provisions have proved adequate for the safety of dangerous goods exported and imported to and from the United Kingdom. The Code is revised biennially on the basis of proposals presented at meetings of the International Maritime Organisation in London, and the United Kingdom plays an active role in these proceedings. It is implemented into United Kingdom regulations, the last revision of which came into force on 1 November 1997. (c) Dangerous goods are carried through the Channel Tunnel in accordance with Eurotunnel's arrangements, which were approved in 1994 by the UK/France Intergovernmental Commission, on the advice of the Channel Tunnel Safety Authority. These apply a number of restrictions additional to those already applicable to road and rail carriage which limit both the types and the quantities of dangerous goods that are permitted. These arrangements were reviewed after the fire in the Channel Tunnel on 18 November 1996 and as a result further restrictions were introduced in June 1997, when the suspended HGV shuttle services resumed.
