My Lords, I am sure that the Minister is aware that the Government of Wales have banned fracking, not just on the question of environmental impact in the conventional sense but because of the uncertainty of the underground workings in many of the coalfields and other mineral areas of Wales. In those circumstances, in the context of the possibility of fracking in west Cheshire and the Wirral, and the uncertainty about many of the underground tunnels in the industrial area of Flintshire, can he ensure that there is close co-operation and discussion with the Government of Wales before any consent is given on the eastern side of the border?

My Lords, the noble Baroness will be aware that there is a moratorium on fracking in Wales. In those circumstances, is it not a bit ironic that the Gwent police force was sent up to Lancashire for the purposes of controlling the protesters? Given that the costs of such an exercise can sometimes become very great, can she give an assurance that all the costs incurred by Gwent will be paid for from central funds?

My Lords, does the Minister accept that one of the main considerations with regard to fracking is the geological stability of the land, particularly in those areas where there has been coal mining and the seepage of water can go many miles? Does she accept that, in these circumstances, any decision on fracking should be taken as locally as possible so that local opinions are taken into account?

My Lords, does the Minister accept that, irrespective of the fact that he cannot go into detail about Lancashire, it is vital for the communities potentially affected by fracking, for local authority employees and councillors, and indeed for the companies that may be interested in fracking, to know exactly where responsibility lies on these matters? In that context, and given the statement made by his right honourable friend the Secretary of State for Wales in March about transferring powers to the National Assembly for Wales, can he now tell us from what date that will be effective?

My Lords, does the Minister accept that, since the Infrastructure Bill went through this Chamber a few months ago, there have been changes with regard to both Scotland and Wales and that control over on-land fracking will be devolved? Indeed, in the National Assembly in Cardiff, an indicative resolution was passed supporting a moratorium, supported by Members of all parties. In these circumstances, can she give an assurance that all those approaching the department with regard to fracking will be notified that the situation in Wales and Scotland may be different?

My Lords, may I interpret that Answer as an indication that we can look forward to a Statement being made by the Secretary of State on St David’s Day to indeed confirm a transfer of responsibility for fracking to Wales? Since the Government have their own amendment to the Infrastructure Bill, Amendment 86, on Report in the House of Commons on Monday, removing Scotland from the provisions of that Bill concerning the right to use deep-level land for fracking, why is there not a similar amendment for Wales, if that is indeed the direction in which the Government are going? Will the Minister link up with the department today to see whether it is possible, even at this late stage, to table such an amendment?

My Lords, in view of the recommendations of the Smith Commission report that responsibility for the licensing of onshore gas development in Scotland should be transferred to the Scottish Parliament, and in view of the commitment given by the Prime Minister on 19 September that Wales would not miss out with regards to any such development in Scotland, can the Minister give an assurance that consideration will now be given to transferring to the National Assembly for Wales and to the Welsh Government responsibility for fracking in Wales?
