Mr. Loughton: To ask the Secretary of State for Education and Employment (1) what guidance his Department has given to jobcentres regarding the advertising of jobs in the sex industry; and what definition of the sex industry is used in the guidance; [129110] (2) what his Department's policy is regarding the use of public funds to subsidise job placement schemes with firms in the sex industry. [129835] Ms Jowell: [holding answers 4 and 10 July 2000]: Responsibility for the subject of these questions has been delegated to the Employment Service Agency under its Chief Executive. I have asked him to arrange for a reply to be given. Letter from Richard Foster to Mr. Tim Loughton, dated 12 July 2000: As the Employment Service is an Executive Agency, the Secretary of State for Education and Employment has asked Leigh Lewis to reply direct to your questions, about the guidance given to Jobcentres on the advertising of jobs in the sex industry; and what definition of the "sex industry" is used in the guidance and about what the Departments' policy is about the use of public funds to subsidise job placement schemes with firms in the sex industry. This is something which falls within the responsibilities delegated to Leigh Lewis as the Chief Executive of the Agency, I am replying in his absence. Jobcentres are instructed not to deal with job vacancies associated with the sex industry. The guidance dates from 1996 and does not seek to define precisely the boundaries of the sex industry but has as its prime aim the need to avoid causing genuine offence or embarrassment to jobseekers. All job placement subsidies provided by the Government require there to be a vacancy or opening with an employer. As the Employment Service does not deal with vacancies in the sex industry the question of subsidies does not arise. I hope this is helpful.

[128924] Ms Jowell: [holding answer 4 July 2000]: Responsibility for the subject of the question has been delegated to the Employment Service Agency under its Chief Executive. I have asked him to arrange for a reply to be given. Letter from Leigh Lewis to Mr. David Lidington, dated 10 July 2000: As the Employment Service is an Executive Agency, the Secretary of State has asked me to reply to your questions about ensuring that persons seeking employment in the United Kingdom are entitled to do so. Permission to work in the United Kingdom is a matter for the Immigration and Nationality Directorate of the Home Office. While Jobcentres do have advice available to them on which groups of jobseekers from outside the UK are entitled to work in the UK, it would not be practical for them to undertake nationality checks given the fact that they make some 20 million job submissions annually. It is the responsibility of employers to ensure that jobseekers have permission to work. Employment Service guidance to Jobcentres states that non-EEA (European Economic Area) jobseekers are not entitled to obtain work in the UK without a work permit. It advises staff to pass inquiries to the Immigration and Nationality Directorate. Similarly, vacancies advertised via the Employment Service website carry a statement which makes clear that the vacancies are not open to non-EEA jobseekers. I hope this is helpful.

Letter from Leigh Lewis to Caroline Flint, dated 12 June 2000: As the Employment Service is an Executive Agency, the Secretary of State has asked me to reply to your questions concerning the distances people live from a Jobcentre and the definition of a reasonable distance when determining access to a Jobcentre. These are issues which fall within the responsibilities delegated to me as Chief Executive of the Agency. I am afraid that we do not collect information about the distances at which jobseekers, or the population more generally, live from their nearest Jobcentre. However, with over 1000 Jobcentres nationwide, very many people will live within 3 miles of the one nearest to them. As to the definition of a "reasonable distance", it may be helpful to explain that jobseekers are normally required by regulations made under the Jobseeker's Act 1995 to attend a Jobcentre in person each fortnight in order to confirm that they are available and actively seeking work and that their circumstances have remained unchanged. Where, however, a jobseeker lives more than one hour, by public transport (in either direction), from their nearest Jobcentre; or if their attendance would result in an absence from home of more than four hours; or if they have a mental or physical disability which restricts their mobility, then they will be offered the opportunity to have their claims dealt with by post. In addition Jobcentre Managers may also exercise discretion in offering this facility to other jobseekers, even if their journey is possible within the time limits set out above, in circumstances where it would be unreasonable to expect a jobseeker to attend; for example, where they would have to use a form of transport which they could not be expected to use on a fortnightly basis, such as an Intercity train, a ferry or a plane.
