Miss Widdecombe: To ask the Secretary of State for the Home Department how many asylum seekers whose claims were made (a) prior to 1 July 1993 and (b) between 1 July 1993 and 31 December 1995 have been granted leave to remain, and for what periods, under the backlog clearance exercise; how many granted leave to remain had their asylum applications considered under normal procedures and refused; how many did not receive an initial determination of their asylum application; and if he will make a statement. [134877] Mrs. Roche: [holding answer 26 October 2000]: The information requested is given in the table. Under the backlog clearance measures announced in the White Paper, applications lodged prior to July 1993 where granted indefinite leave to enter or remain without the asylum application being considered, provided they met specified criteria. Asylum applications lodged between 1 July 1993 and 31 December 1995 (6,135) were considered substantively against the normal criteria, however in the event that they failed, consideration was given to granting exceptional leave under extended criteria set out in the White Paper. The number of applications still not determined (15,400) under the backlog clearance exercise is now negligible. Mr. Colman: To ask the Secretary of State for the Home Department (1) in which countries with which the UK maintains diplomatic relations, the Home Office Certificate of Identity is accepted as a valid travel document by the relevant authorities; [135758] (2) if he will urgently replace, for grantees of exceptional leave to remain, the Home Office Certificate of Identity with a travel document accepted by all other EU member states. [135998] Mrs. Roche: The Home Office Certificate of Identity (CID) is a travel document issued to foreign nationals, other than refugees, who are resident in the United Kingdom and cannot obtain a passport from their national authorities. This type of document is not issued under an international convention but on a discretionary basis. The CID, which guarantees the holder return to the United Kingdom, has traditionally been widely accepted for travel and, as far as I am aware, still is. However, it is for the authorities of each country to decide whether they will accept the CID as a valid form of travel document and, in this connection, I am aware that a number of European Union partners are no longer doing so. My officials are in discussion with colleagues from the European Union countries concerned in order to identify their particular concerns and, if possible, give assurances, which might encourage them to accept the CID for travel. There are no proposals to replace the CID, which was created specifically to meet the travel needs of that category of foreign national described. The issue is one of acceptability of the document rather than replacement and it is that which we are addressing with our European partners.

Mr. Mitchell: To ask the Secretary of State for the Home Department, pursuant to his answer of 14 June 2000, Official Report, column 626W, on immigration, if he will list those parts of European treaties coming into force subsequent to the passage of the Immigration Act 1971 which permit questioning, searching and detention on grounds of public policy through derogation from treaty provisions concerning freedom of movement and absence of internal frontiers within the European Union and Community. [129754] Mrs. Roche: Under the Treaty establishing the European Community (TEC), the right to move and reside freely within the territory of the European Union is subject to derogations on grounds of public policy, public security and public health. These limitations on the Treaty freedoms are allowed by Article 39(3) (as regards freedom of movement for workers), Article 46 (as regards the right of establishment) and Article 55 (as regards the provision of services), and are also recognised by Article 18 (inserted by the Treaty on European Union). The same limitations can be found in the secondary Community legislation on freedom of movement, including Directives 68/360/EEC, 73/148/EEC and 75/34/EEC. The use by member states of these derogations is subject to Directive 64/221/EEC on the co-ordination of special measures concerning the movement and residence of foreign nationals which are justified on the grounds of public policy, public security, or public health, extended by Directives 72/194/EEC and 75/35/EEC. In order for Immigrations Officers to decide whether a person should be excluded on the grounds of public policy, public security or public health, Article 20(2)(e) of the Immigration (European Economic Area) Order 1994 applies the powers to question, search and detain contained in Schedule 2 to the Immigration Act 1971 to EEA nationals. In the case of the United Kingdom, the question of derogation from provision concerning the absence of internal frontiers within the EU does not arise, having regard to our special position on the maintenance of internal frontier controls.

Mr. Mitchell: To ask the Secretary of State for the Home Department how many citizens of the European Community or European Economic Area, or members of their families, were (a) questioned, (b) searched and (c) detained in (i) 1997, (ii) 1998 and (iii) 1999; and how the powers in these respects are exercised and at what location, in respect of those travelling by rail through the channel tunnel. [125385] Mrs. Roche: The information requested is not available. European Economic Area (EEA) nationals are normally admitted to the United Kingdom on production of a valid passport or identity card as evidence of nationality and identity, in accordance with Article 3(1) of the Immigration (European Economic Area) Order 1994 ("the EEA Order") and subject of Article 15(1) of the EEA Order. Under Article 3(3) of the EEA Order, an accompanying family member of an EEA national who is not himself an EEA national will normally be admitted to the United Kingdom, although he may, in addition, be required to hold an EEA family permit issued abroad. Under Article 15(1) of the EEA Order, immigration officers on arrival may refuse to admit a person if his exclusion is justified on grounds of public policy, public security or public health. This applies when the person is travelling by rail through the channel tunnel or by any other means of transport. Powers for immigration officers to question passengers arriving in the United Kingdom, whether they are citizens of the European Union or European Economic Area, or their accompanying (third country) relatives, are contained in paragraph 2 of Schedule 2 to the Immigration Act 1971. Schedule 2 applies to the examination of (EEA) nationals in accordance with Article 20(2)(e) of the EEA Order. Under paragraph 4(3) of Schedule 2 to the Immigration Act 1971, a person who is examined under paragraph 2 of Schedule 2 to the Immigration Act 1971 may be searched, and his belongings examined, and that person may be detained under paragraph 16 of Schedule 2 of the Immigration Act 1971. These powers are normally exercised where the passenger first encounters the immigration officer or, in the case of a person examined on board a train, immediately on his arrival in the United Kingdom.
